J MINUTES SPECIAL MEETING CITY OF PARIS BOARD OF ADJUSTMENT CITY OF PARIS - CITY HALL COUNCIL CHAMBERS 107 E. KAUFMAN STREET PARIS, TEXAS MONDAY, MAY11, 2009 12:00 O'CLOCK P.M. The Board of Adjustment meeting was called to order by Chairman Terry Christian at 12:00 p.m. B. The following members were present: Terry Christian, Chairman Chester Martindale Kyle McCarley Rick Hundley C. The following members were absent: David Glass C. Also present was Jeanna Scott, Administrative Assistant. 2. Approval of minutes.fi•om previous meetings. Motion to approve the minutes of the Apri17, 2009, meeting was made by Chester Martindale, seconded by Kyle McCarley. Motion carried 4-0. 3. Public hearing and consideration of and action on the petition of the Girl Scouts to grant a var-iance of Section 28-23(1) of the Sign Or•dinance which provides that "the total area per . face of an attached sign shall not exceed one (1) square foot of face ar•ea per-, front foot of leased or occupied fascia length, " to allow 1.48 square foot offace ar•ea per.front foot of occupied fascia length, which is a.48 squar•e foot per front foot variance, on Lot 1, Block A, Petco Plaza Addition, being number 3920 Lamar Avenue (var•iance to apply to the suite occupied by Girl Scouts only). Public hearing was declared open. A. The following individuals spoke in favor of the petition. Georgia Welks, 548 CR 44605, Blossoin, TX, representing Girl Scouts, spoke asking for the sign to help with visibility. Ray Beck, Paradise Signs, representing sign company and Girl Scouts, Mr. Beck stated the property sits back 600 feet from the street. This makes is difficult to see the sign and it is a safety issue because there is only one turn. They are asking for A UUo()1o a little over a nine foot variance. A lot of people will be coming in and out and will need the visibility. Mr. Beck further asked the board to approve the variance. Chester Martindale asked if the owner of the center approves the sign size. Mr. Beck stated yes he does support what is permutable to city code. Terry Christian stated he is concerned about sign encroaching on other suite, thought the column was egress. Mr. Beck stated he was also concerned and will ensure the sign is centered. Kyle McCarley asked if the signs a present designed, and will it cost the Girl Scouts to redesign to meet sign ordinance. Mr. Beck state no they are built as needed, however, he already built the sign before he applied for a permit. Terry Christian expressed concern about ganting the variance and the effect it could have on the rest of the center. B. No one spoke in opposition. Public hearing was declared closed. Motion was made by Rick Hundley, seconded by Kyle McCarley to deny the variance request. Motion carried 3-1. 4. Public hearing and consideration of and action on the petition of Mitchell White to grant a var•iance of Zonifig Ordinance No. 1710, Section 9-602(5), to modi fy the required side yard setback. from 25' to 8; which would be a 17' variance, on Lot 8, City Block 257-D, being number 2702 E. Cherry Street. A. Public hearing was declared open. Mitchell White, 2702 E. Cherry St., home owner, Mr. White stated carport was there for 23 years but, recently the whole thing came down. The new carport will be a foot shorter. His wife has been disabled since 1992 with a broken vertebrae in her neck. If it is raining, sleeting or snowing it would be hard on his wife. Mr. White stated he is asking for the variance to be ganted. B. No one spoke in opposition. Public hearing was declared closed. Motion was made by Chester Martindale, seconded by Kyle McCarley to grant the variance. Motion carried 4-0. 5.
