BACKGROUND:
Paul Holden has requested that the zoning on the property located on a 6.5 acre tract (part of the Enoch
Crow Survey, Abstract No. 208) located in the 4500 block of Lamar Avenue be changed from an
Agricultural District (A) to a Planned Development District (PD-b) Housing Development or
Community Unit Development for the purpose of constructing an apartment complex. The Planning and
Zoning Commission recommended approval of this request on April 6, 2009.
Additionally, on April 3, 2009, the City of Paris was presented with a petition from property owners
adjoining the above-subject property in opposition of the zoning change request (attached). Section 21-
105 of Zoning Ordinance No. 1710 states as follows:
"Unless a proposed amendment, supplement or change has been approved by the Planning and
Zoning Commission, or if a protest against such proposed amendment, supplement or change has
been filed with the City Secretary, duly signed and acknowledged by the owners of twenty (20)
percent or more either of the area of the lots included in such a proposed change or those
immediately adjacent in the rear thereof extending two hundred (200) feet there from or of those
directly opposite thereto extending two hundred (200) feet from the street frontage of such
opposite lots, such amendment shall not become effective except by a three-fourths vote of the
governing body.

After reviewing the petition, staff has determined that it contains 11 of the 14 signatures from neighbors in
the vicinity of the requested change, with 78 percent of adjoining property owners as described in Section
21-105 above having signed the petition.
The Comprehensive Plan recommends that this property be used for Low Density Residential purposes;
therefore, approval of this request would be contingent upon the City Council approving the related
amendment to the Future Land Use Plan Map to allow for High Density Residential uses, which action
precedes this item on the agenda.
The development of this property will have to meet City and State standards for development which
includes: utility installation, grading and drainage. By law the property must accept the water that is
currently flowing across and cannot release more that what was flowing to the downstream neighbor. This
will most likely dictate that a detention pond be constructed with this development.
On April 6, 2009, the Planning and Zoning Commission recommended that the City Council approve the
requested change to Planned Development District (PD-b) Housing Development or Community Unit
Development and several people spoke in opposition to this item. A related agenda item (no. 16) precedes
this request. The property owner has requested another delay in Council action until July 20 due to an
"unforeseen condition." Our procedures do not have a deadline for Council action on this type of item but
almost without exception Council acts on P&Z items the first council meeting after P&Z makes a
recommendation. Since the latest rescheduling request will make a Council decision a 107 days after
P&Z's recommendation, staff did not feel it appropriate to grant the request administratively since it was so
unusual compared to the City's historical practice. Council can decide to grant the request or vote to deny
the change in zoning now.

WHEREAS, the Planning & Zoning Commission received a request for an
amendment to the Zoning Ordinance of the City of Paris to rezone a 6.5 acre tract being a
part of the Enoch Crow Survey, Abstract No. 208, located in the 4500 Block of Lamar
Avenue, City of Paris, Lamar County, Texas from an Agricultural District (A) to a Planned
Development District (PD-b) Housing Development or Community Unit Development; and,
WHEREAS, on April 6, 2009, the Planning and Zoning Commission conducted a
public hearing on the proposed amendment to the City zoning ordinance and, following
said hearing, made formal recommendation to the City Council to approve the requested
~ zoning change; and,
WHEREAS, a written protest against the proposed rezoning of this property has
been received from in excess of twenty percent (20%) of the owners of the property within
200 feet of the boundary lines of the proposed tract to be rezoned, thereby requiring a
three-quarter (3/4) majority vote of the City Council to approve the rezoning of the
property; and,
WHEREAS, on April 27, 2009, following notice and publication as required by law,
the City Council of the City of Paris conducted a public hearing on the proposed
amendment to the City zoning ordinance, and having considered the recommendations of
the Planning and Zoning Commission and the testimony and evidence introduced at said
public hearing, found and determined that approving the aforesaid zoning change would be
consistent with the comprehensive plan of the City of Paris, consistent with the City zoning
ordinance, and in the best interests of the public health, safery, and welfare of the citizens
of the City of Paris, and approved the rezoning of the property from Agricultural District
(A) to Planned Development District (PD-b) Housing Development or Community Unit
Development by a vote of ayes and _ nays.
NOW, THEREFORE, BE IT ORDAIIVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
Section 1. That the findings set out in the preamble to this ordinance are hereby in
all things approved.
Section 2. That the Official Zoning Map of the City of Paris, Texas and Zoning
Ordinance 1Vo. 1710 of the City of Paris as heretofore amended is hereby further amended
to rezone a 6.5 acre tract being a part of the Enoch Crow Survey, Abstract No. 208, being
located in the 4500 Block of Lamar Avenue, City of Paris, Lamar County, Texas, from
Agricultural District (A) to Planned Development District (PB-b) Housing Development or
Community Unit Development, said property being more particularly described in Exhibit
A attached hereto and made a part hereof.
Section 3. that the zoning herein granted is conditioned upon the submission of a
Site Plan in accordance with Section 8-302 of Ordinance IVo. 1710, which after full
compliance with the procedure established in Section 8-302 of Ordinance No. 1710, which
after full compliance with the procedure established in Section 21 of said Ordinance No.
1710, must be approved by the City Council prior to the issuance of any building permits.
Section 4. That the Chief Building Official of the City of Paris be, and he is hereby,
directed to change the Official Zoning Map of the City of Paris, Texas to reflect the changes
set forth in this ordinance.
Section 5. That all provisions of the ordinances of the City of Paris, Texas in conflict
with the provisions of this ordinance are hereby repealed, and all other provisions of the
ordinances of the City of Paris not in conflict with the provisions of this ordinance shall
remain in full force and effect.
Section 6. That the repeal of any ordinance or part of ordinances affected by the
enactment of this ordinance shall not be construed as abandoning any action now pending
under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering
any penalty accruing or to accrue, or as affecting any rights of the municipality under any
section or provisions of any ordinance at the time of passage of this ordinance.
Section 7. That it is the intention of the City Council of the City of Paris that this
ordinance, and every provision hereof, shall be considered severable, and the invalidity or
partial invalidity of any section, clause, or provisions of this ordinance shall not affect the
validity of any other portion of this ordinance.
Section B. That any person violating any provision of this ordinance shall be guilty of a
Misdemeanor, and upon conviction, shall be subject to a fine in accordance with provisions of
Sec. 1-6 of Chapter One of the City of Paris Code of Ordinances, and each and every day's
continuance of any violation of the above-enumerated sections shall constitute and be deemed
a separate offense.
Section 9. Introduced and read on first reading on June 22, 2009, at a regular
meeting of the City Council of the City of Paris and read and passed on second reading on
July 13, 2009, at a regular meeting of the City Council of the City of Paris; the same being

Section 9. That the City Council voted by a supermajority vote of the entire Council
to suspend the rule requiring two readings before adoption of ordinances ayes and

DATE: March 26, 2009
The following zoning change request will be presented at the Apri16, 2009, meeting of the
Planning and Zoning Commission and the April 27, 2009, meeting of the City Council of the City
of Paris for consideration:
Paul Holden is requesting that a 6.5 acre tract of land, a part of the Enoch Crow Survey,
Abstract No. 208, being located in the 4500 block of Lamar Avenue, be rezoned from an
Agricultural District (A) to a Planned Development District (PD-b) Housing development
or community unit development. The Comprehensive Plan recommends that this
property be zoned Low Density Residential. Approval of this request would require an
amendment to the Comprehensive Land Use Map.
