POLICY ISSUE(S): Economic development; Required by program BACKGROUND: The Texas Capital Fund (TCF) provides no-match grants for up to $1,000,000 to build public infrastructure to assist a business that commits to create and/or retain permanent jobs, of which a minimum of 51 percent or more the jobs must benefit persons who qualify as low- and moderate- income. The proposed project will build a water main from the south boundary of Chisum ISD south along Hwy. 19/24 approximately four miles to the proposed location of Daisy Farms. In exchange, Daisy Farms agrees to create a minimum of 100 new jobs. Although the estimated cost of the project is greater than the amount of the grant, Daisy Farms has committed to pay for the difference between the grant funds and the total cost of the water main. The grant consultant will be paid out of the $60,000 included in the grant for administration. The Texas Capital Fund (TCF) program is administered by the Texas Department of Agriculture through an interagency agreement with the Office of Rural Community Affairs (ORCA). The TCF program encourages business development, retention, or expansion by providing funds to eligible applicants. Funds will be awarded for the express purpose of assisting in the creation of new permanent jobs or retention of existing permanent jobs, primarily for low and moderate income (LMI) persons. In order to comply with the national goal of expanding economic opportunities for LMI persons, a minimum of 51 percent or more of all the jobs created or retained by the business must benefit persons who qualify as LMI. These funds are a part of the U. S. Department of Housing and Urban Development's (HUD) Community Development Block Grant (CDBG) program and is known as the Texas Community Development Program (TCDP) in our state. The program is only available to non-entitlement city or county governments. Non-entitlement cities/counties do not receive direct funding from HUD and typically include cities with a population of less than 50,000 and counties of less than 200,000. There are over 1,200 eligible cities and counties in the state. Awarded cities and counties receive funds to make public infrastructure and/or real estate improvements to support a specific business that is expanding or beginning operations in the applicant's jurisdiction and are contingent upon the business making a capital investment and creating/retaining jobs for Texans. INFRASTRUCTURE PROGRAM OVERVIEW The Texas Capital Fund Infrastructure Development Program is an economic development tool designed to provide financial resources to non-entitlement communities. Funds from this program can be utilized for public infrastructure needed to assist a business which commits to create and/or retain permanent jobs, primarily for low and moderate income persons. This program encourages new business development and expansions. WHEREAS, The City Council of the City of Paris is desirous of processing an application to the Texas Department of Agriculture/Office of Rural Community Affairs for the Texas Capital Fund (TCF) Infrastructure Grant Program in the amount of $1,000,000.00 to fund infrastructure improvements for a commercial dairy operation locating in Lamar County, Texas and the City Manager should be authorized to execute any and all documents necessary for acceptance and implementation of said grant upon notice thereof. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, THAT: ~ Section 1. The findings set out in the preamble to this resolution are hereby in all things approved. Section 2. The submission of an application to the Texas Department of Agriculture, Office of Rural Community Affairs Texas Capital Fund Infrastructure Grant Program be, and the same is hereby approved to provide infrastructure improvements for a commercial dairy farm to locate in Lamar Counry, Texas, in the amount of $1,000,000.00 with $940,000.00 to be for the infrastructure project and $60,000.00 for the administration of said grant. Section 3. The City of Paris agrees to comply with all commitments and assurances set forth in the grant application and, if funded, the award, and the City Manager of the City of Paris be, and he is hereby authorized and directed to execute on behalf of the City of Paris, an application for said grant. Section 4. The City Engineer be, and he is hereby appointed as Project Director and is hereby authorized and directed to execute and deliver, on behalf of the City of Paris all reports, communications, assurances, and documents necessary for the completion of said project. Section 5. That the Director of Finance be, and he is hereby, authorized and directed to serve as the Financial Officer for said project and to receive and distribute funds for said infrastructure project. Section 6. That the Ciry Mayor, City Manager, the City Engineer and Finance Director be authorized and directed to execute, on behalf of the City of Paris, and and all documents necessary for acceptance and implementation of said grant upon notice of award thereof by the Texas Department of Agriculture under the terms and conditions and in the forms approved by the City Attorney, and to proceed with the use of said funds upon receipt thereof for purposes stated herein and in accordance with the grant conditions. Section 7. The City has reviewed and hereby agrees not to participate in program income recapture and will return all program income to the state to be placed in a statewide Revolving Loan Fund to be used by the state to fund future economic development awards. By agreeing to this measure, the City understands that it will be eligible to receive as many Texas Capital Fund awards per program year as it has eligible projects. Section 8.
