RECOMMENDED MOTION:
Move to approve a resolution adding additional language required by the Governor's office for the Live Scan
Interface Project providing for the repayment or return of any grant monies if any of the monies are lost or
misused.

BACKGROUND:
Council approved this application by resolution 2009-059 on June 8, 2009. The grant has been preliminarily
approved, but staff has been contacted by the governor's office regarding additional language now needed in the
resolution. The additional language provides for repayment or return of any grant monies if any of the monies are
lost or misused.
The America Recovery and Reinvestment Act provided funding through the Edward C. Byrne Justice Assistance
Grant for local grant applications submitted through the Governors Criminal Justice Division (GCJD). These
grant applications will be processed through the GCJD and passed to the local Regional Council of Governments
for approval.
The Police Department grant of $61,500 is for the purchase of `live scan' computer equipment and related
software interfaces for the CIS Records Management System and Municipal Court Software. The system allows
inkless fingerprinting and computerization of 10-print fingerprints and palm prints for submission to DPS and
comparison with the departments existing AFIX Tracker fingerprint recognition system.

A RESOLUTION OF THE CITY COUIVCIL OF THE CITY OF PARIS, TEXAS,
AMENDING RESOLUTION N0. 2009-059 WHICH AUTHORIZED AN
APPLICATION FOR FUNDIIVG FOR THE JUSTICE ASSISTANCE GRANT
(jAG) RECOVERY ACT PROGRAM FOR LIVE SCA1V FIIVGERPRIIVT
EQUIPMENT, TO ADD REQUIRED WORDING TO THE RESOLUTION;
MAKING OTHER FINDIIVGS A1VD PROVISIOIVS RELATED TO THE
SUBJECT; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Paris did heretofore, on the 8th day of June,
2009, pass Resolution No. 2009-059, which authorized an application for funding for the
Justice Assistance Grant (JAG) Recovery Act Program for Live Scan Fingerprint Equipment
for the Paris Police Department; and,
WHEREAS, Resolution No. 2009-059 was amended by Resolution No. 2009-085
correcting the amount of the grant from $65,000.00 to $61,500.
WHEREAS, Resolution No. 2009-059 needs to be further amended by adding
required wording that in the event of loss or misuse of the Criminal Justice Division funds,
the City Council assures that the funds will be returned to the Criminal Justice Division in
full.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
Section 1. That the findings set out in the preamble of this resolution are hereby
in all things approved.
Section 2. That Resolution No. 2009-059, be, and the same is hereby, amended so
that such shall read as follows:
"A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
TEXAS, APPROVING AND AUTHORIZING THE CITY MANAGER AND
OTHER CITY OFFICIALS TO EXECUTE THE APPLICATION AND ALL
OTHER NECESSARY DOCUMENTS INCIDENT TO SEEKING A GRANT
FROM THE CRIMINAL JUSTICE DIVISION OF THE GOVERNOR'S
OFFICE, FOR FUIVDIIVG FOR THE JUSTICE ASSISTANCE GRAIVT
(JAG) RECOVERY ACT PROGRAM FOR LIVE SCAN FINGERPRINT
EQUIPMENT; MAKING OTHER FINDINGS AND PROVISIONS
RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE
DATE.
WHEREAS, the Criminal Justice Division, of the Governor's Office,

provides funding for JAG Recovery Act Program Grants; and,
WHEREAS, the City Council of the City of Paris is desirous of
processing an application through the JAG Recovery Act Program Grants to
fund Live Scan Fingerprint Equipment along with all necessary software
interfaces for the CIS records management system, at a total cost of
$61,500.00, with no matching funds from the City of Paris.
WHEREAS, the City Council of the City of Paris assures that, in the
event of loss or misuse of the Criminal Justice Division funds, the funds will
be returned to the Criminal Justice Division in full; and,
WHEREAS, the City Council hereby authorizes the City Manager,
Interim Police Chief, and other appropriate City staff to make application,
accept and implement said grant, if same is received, without further action
of City Council;
1VOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PARIS, TEXAS:
Section 1. That the findings set out in the preamble to this
resolution are hereby in all things approved.
Section 2. That an application be made to the Criminal Justice
Division of the Governor's Office, to provide funding for the JAG Recovery Act
Program Grant, in the amount of $61,500.00, to pay for Live Scan Fingerprint
Equipment along with all necessary software interfaces for the CIS records
management system.
Section 3. That the City Manager be, and he is hereby, appointed as
the Authorized Official of said project and is authorized and directed to
execute, on behalf of the City of Paris, an application for said grant, and the
grant acceptance notice at such time the grant is awarded.
Section 4. That the Police Chief of the City of Paris be, and he is
hereby, appointed as Project Director and is hereby authorized to execute
and deliver, on behalf of the City of Paris, all reports, communications,
assurances, and documents necessary for the grant program.
Section S. That the Director of Finance be, and he is hereby,
authorized and directed to serve as the Financial Officer for said project and
to receive and distribute funds for purposes of paying for the Live Scan
Fingerprint equipment.
Section 6. That, in the event of loss or misuse of the Criminal
Justice Division funds, the City Council of the City of Paris assures that the

Section 7. That this resolution shall be effective from and after its
date of passage.
