BACKGROUND:
Council Member Biard has requested that Council discuss asking Planning & Zoning Commission to
consider amending the City's Zoning Ordinance to require a specific use permit (SUP) for the loading,
unloading or transloading of crude oil in the city limits.
The SUP process provides a means for allowing certain uses to be developed in certain zoning districts
in which the use is not allowed by right, but, with special conditions and restrictions, may be considered
compatible with adjacent property and consistent with the character of the neighborhood.
Section 12 of the City Zoning Ordinance sets out the procedure for application, notice and review of
specific use permit applications. In summary, the SUP application is filed with the Engineering,
Planning & Department at the City, notices are sent out to surrounding property owners, a public hearing
is held before the Planning and Zoning Commission and a recommendation is made to City Council for
final decision.
The City Council must refer this item to the Planning and Zoning Commission for their consideration
and recommendation. P&Z's next meeting is January 4, 2010.
