2010-006 ORD ESTABLISHING A STOP SIGN AT 24TH ST NW AT GRAHAM STORDINAIVCE 1V0. 2010-006 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING THE TRAFFIC CONTROL MAP ADOPTED IN SECTION 31- 65(b), OF THE CODE OF ORDINANCES OF THE CITY OF PARIS, TEXAS; ESTABLISHING A STOP SIGN ON 24th STREET NW AT GRAHAM STREET STOPPIIVG SOUTHBOUND TRAFFIC; MAKING OTHER FIIVDIIVGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Paris Traffic Commission is charged with reviewing and evaluating proposals to add or remove traffic control devices on City streets and roadways throughout the City of Paris; and, WHEREAS, among those traffic control devices evaluated by the Traffic Commission is the placement of stop signs at various intersections throughout the City; and, WHEREAS, the Traffic Commission, at its regular meeting of November 3, 2009, considered and evaluated a request for the placement of a stop sign at the intersection of 24th Street NW and Graham Street, to stop the southbound traffic on 24th Street NW and, having done so, found and determined that the placement of stop signs at this location in the City of Paris is necessary to protect the health and safety and is in the best interests of the citizens of the City of Paris. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That the Traffic Control Map of the City of Paris, Texas, as amended, and as adopted in Paragraph (b) of Section 31-65, Chapter 31, of the Code of Ordinances of the City of Paris, Paris, Texas, be, and the same is hereby, further amended to include the following stop sign: "Stop Sign - on 24th Street NW at Graham Street stopping Southbound traffic." Section 3. That all provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 4. That the repeal of any ordinance or part of ordinances affected by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance. Section 5. That it is the intention of the City Council of the City of Paris that this ordinance, and every provision hereof, shall be considered severable, and the invalidity or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section 6. That any person violating any provision of this ordinance shall be guilty of a Misdemeanor, and upon conviction, shall be subject to a fine in accordance with provisions of Sec. 1-6 of Chapter One of the City of Paris Code of Ordinances, and each and every day's continuance of any violation of the above-enumerated sections shall constitute and be deemed a separate offense. Section 7. That by a supermajority vote of 6 ayes and 0 nays, the City Council voted to suspend the rule requiring two readings before adoption of this ordinance. Section B. That this ordinance shall become effective from and after its passage of the first reading and publication as required by law. Ken Kohls 2. Ray Banks 3. Jon McFadden 4. Stephen Holmes The city staff was represented by Asst. Chief Randy Tuttle. Councilman Joe McCarthy was present a council liaison member The meeting was called to order at 5:30pm by Assistant Chairman McFadden. A quorum was established by 4 members being present. Mr. McFadden asked the commission members to review the submitted minutes of the October 6th, 2009 meeting. Mr. Holmes made a motion to approve the minutes which was seconded by Mr. Kohls and passed 4-0. Mr. McFadden moved to item #3 regarding the discussion and action for a request to place a stop sign for southbound traffic at 24th NW & Graham. After discussion of this item Mr. Holmes made a motion to place a stop sign at 24th NW & Graham for southbound traffic. The motion was seconded by Mr. Banks and passed 4-0. Mr. McFadden moved to item #4 to present information to Commission concerning updates to widening of Stillhouse Road. Mr Tuttle informed the Commission members that the project had been presented to City Council. Mr. Tuttle stated the council had approved this project and it is scheduled to begin at end of the current school year. Mr. McFadden moved to item #5 to present information to Commission concerning a request for a No Parking Zone on south side of E. Cherry between N. Main and 1St NE. which was tabled during October 6th meeting. Mr. Tuttle informed the Commission members that the owner of Kiddie Korner Daycare was attempting to purchase property adjoining her business for a parking lot so her employees would have a place to park instead of parking on E. Cherry. The owner requested time to pursue this and other options. The Commission did not remove this item from the table. Mr. McFadden moved to item #6 regarding future agenda items. There were no future agenda items. Mr Holmes moved for adjournment, seconded by Mr Banks at 5:43pm. Motion carried 4-0. Submitted by Asst. Chief Randy Tuttle
