RECOMMENDED MOTION:
Move to approve a resolution authorizing a$233,000 application to the Office of the Governor, Criminal
Justice Division for a Felony Crimes Unit Grant for the period of September 30, 2010 through October
l, 2011, and authorizing the City Manager to negotiate and execute all necessary documents.

This grant funds salary and benefits for two Paris Police Officers and one Lamar County Sheriff's
Deputy to investigate felony crimes committed in the City of Paris and Lamar County. The Felony
Crimes Unit (FCU) has now been in existence for two years and the City acts as the fiscal agent for the
grant. Staff has been informed that our current grant is in its last year of funding and the proposed
application is an opportunity for funding FCU from a different grant source to continue the program.
The new grant application does not have any cash match and will be for a total of $233,000. This is a
$71,000 increase from the previous grant and is due for equipment requests in the grant from Lamar
County. The equipment in the grant can be cut for scoring purposes to insure the continuation of
funding for the officer positions if it is determined that will improve the competitiveness of the
application. When the grant is awarded, an interlocal agreement with Lamar County will be necessary.
From March through September of 2009, FCU reported 41 felony arrests involving 44 felony charges.
A total of $41,223.00 of cash, drugs, firearms, and other property have been seized during this reporting
period.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
AUTHORIZING AN APPLICATION TO THE GOVERNOR'S OFFICE, CRIMINAL
JUSTICE DIVISION FOR FUNDING FOR THE LAMAR COUNTY FELONY
CRIMES UNIT; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND
EXECUTE ANY AND ALL NECESSARY DOCUMENTS; MAKING OTHER
FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING
AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Paris, Texas finds it in the best interest of the
citizens of Paris, Texas and Lamar County to seek funding from the Governor's Office, Criminal
Justice Division to continue the Lamar County Felony Crimes Unit through Fiscal Year 2010-
2011; and,
WHEREAS, the City of Paris will enter into an Interlocal Agreement with Lamar County
to provide for the division and use of said funding; and,
WHEREAS, the City of Paris agrees that in the event of loss or misuse of the Criminal
Justice Division funds, the City of Paris assures that the funds will be returned to the Criminal
Justice Division in full; and,
WHEREAS, the City of Paris, Texas designates the City Manager as the grantee's
authorized official. The authorized official is given the power to apply for, accept, reject, alter
or terminate the grant on behalf of the applicant agency.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS, THAT:
Section 1. The findings set out in the preamble to this resolution are hereby in all
things approved.
Section 2. The City Council of the City of Paris, Texas approves submission of the
grant application for the Lamar County Felony Crimes Unit to the Governor's Office, Criminal
Justice Division.
Section 3. The City Manager of the City of Paris be, and he is hereby designated as
the grantee's authorized official and is authorized and directed to negotiate and execute, on
behalf of the City of Paris any and all documents necessary to apply for, accept, reject, alter or
terminate the grant and to enter into an Interlocal Agreement with Lamar County for the
division and use of said grant funds.
Section 4. This resolution shall be effective immediately upon passage.

Mandatory Drup Courts - Pursuant to Texas Heaith and Safety Code g469.006, counties with a populatfon of more than 200,000 are
required to establish a drug court. Applicants from these counties must alsa apply to the federel govemment for any funds available to pay
the costs of the program. A county with a population of 200,000 or more that does not establfsh and maintain a drug court progrem is
ineligible to receive state funds for a community supervision and corrections department, and grants for substance abuse treatment
programs administered by the Govemor's Criminal ]ustlce Division.

Lamar County, a rural area of 50,000 people in Northeast Texas, is plagued with aggravated assaults, sexual assaults, and homicides that
overburden the lfmited manpower of law enforcement officers. A largely rural, limited industrial tax base does not provide locai
governmental entities adequate financial resources to effectively dedicate law enforcement officers who can investigate these crimes. Lack
of manpower to investigate crimes often feads to cases remaining unsolved or un-prosecuted for up to five (5) years while
suspects/defendants remain un-arrested, abscond, and/or re-offend as victims and residents live in fear of criminals waiking their small-
town streets.

In 2004, the U.S. Bureau of Justice Statistics piaced the City of Paris among the top 100 most violent crime cities per capita in the United
States. Texas Department of Public Safety crime records state that violent crime accounted for 11% of ali crimes in Texas for 2004. In
Lamar County for 2005, 34% of all felony crimes were violent. In 2006, agencies in Lamar County repor[ed the following activities:

The City of Parls Police Department and officials from the County of Lamar participated in the local community planning process that
resulted in the Northeast Texas Regional Community Plan (the Plan). One of the funding priorities in the Plan under Criminal Justice Issues
relates to speciai crimes, such as fraud, racketeering, theft, burglaries, prostitution, and narcotics. It recommends aggressive enforcement
of City, State, and local laws related to these crimes. Additionally, this local project comes at the strong behest of administrators of the
Paris Police Department, Lamar County Sheriff's Office, and Lamar County and District Attorney's Office who painfully recognize the need
for dedicated and more effective investigation of violent crimes. This focus group resolutely and unanimously has made a commitment to
establishing this project and have designated it as priori[y one for the foreseeable future.

Participating law enforcement agencies (Paris Police Department, Lamar County Sheriff's Office, and Lamar County and District Attorney's
Office) will collectively and cooperatively continue the operation of a felony crimes unit (FCU) for specialized investigations targeting felony
crimes against persons. The intent of this (FCU) wili be to decrease the number of violent crimes occurring to Lamar County residents.
These specialized investigatory efforts, coupled with a dedicated prosecutor to handle these specific cases, will result in a safer community,

When a grantee intends to carry out a grant project through cooperating or participatiny with one or more outside organizatlons, the

PartfCipating law enforcement agencies (Paris Police Department, Lamar County Sheriff's Office, and Lamar County and District Attorney's
Office) wiil collectively and cooperetively continue the operation of a felony crimes unit for specialized investigations targeting felony crimes
against persons. This project will utilize numerous methods and taols to strike at the target audience, normally beginning with intelligence
gathering related to violent crimes. Criminal informants, as well as years of information gathered from the investigation and prosecution of
previous crimes, will assist officers in targeting high-risk individuals. Additionally, crime stoppers information, surveillance, and constant
pressure will result in an overall reduction of crimes this project targets: violent crlmes against Lamar County citizens. The principle method
of investigating and solving violent crimes against persons is reactive in nature. The continued operation of this unit and what is
accomplished will lead to a proactive crackdown on crime, especially as the target audience of repeat offenders becomes aware of stiffer
and swifter penalties. The specialized investigators wiil assist ail county agencfes' criminal investigation divisions (CIDS) in making
connections between felony cases and sharing informatinn. Information shared between cooperative agencies frequently solves challenging
cases. In 2005 alone, two homicides were solved due to !nteiligence gathering within the local law enforcement community - one out of
Tarrant County which exemplifies this pro,iect's willingness to assist wherever the need may arise.

Although the prior grant was for an 18 month period, the City of Paris did not receive funding untii February 2007; therefore, the felony
crimes (FCU) unit has oniy been in operaton for 6 months. Incidents of drug activity, drug transactions, and violent crimes have actually
increased simply due to the existence of the FCU because more resources are now devoted to investigating this type of activity.

Assaults, sexual assaults, and homicides overburden the Iimited manpower of law enforcement officers in Lamar County. Local financial
resources and manpower are inadequate for effectively carrying out justice and often leads to cases remaining unsoived or un-prosecuted
efficiently. The City of Paris has been ranked among the top 100 most violent crime cities in the United States. Thirty-four (34) percent of
felony crimes in the project area were violent in nature in 2005 while the overall Texas rate was 11% the previous year. Six homicides
awaited further investigation or prosecution in 2005 while other violent crimes burdened as follows: 43 robberies and 1,407 assaults. This
project will decrease the number of violent crimes occurring to Lamar County residents while creating a better quality of life for residents.
The target for this project is anyone who chooses to commit a violent offense against another person. The project intends to cooperatively
investigate the more than 1,000 violent felony offenses and the anticipated increase of said by util(zing this grant funding in an effort with
both the Paris Police Department, the Lamar County Sheriff's Office, and the Lamar County District Attorney and other agencies to initiate
the reduction in violent criminal activity in Paris and Lamar County, Texas. Investigators will make use of every available crime fighting
method to ultimately create a proactive crackdown against violent crime. This grant shall enable our law enforcement agencies to
cooperatively act as a significant deterrant as the target audience of repeat offenders becomes aware of stiffer and swifter penalties.
