BACKGROUND:
TxDOT has requested that the City establish a school zone on FM 1507/Jefferson Road in anticipation
of the completion of the new Paris High School in the fall 2010. TxDOT's request to regulate speed at
this location to 35 mph forty-five minutes prior to start of school and thirty minutes at close of school
was forwarded to the Traffic Commission for consideration at their February 2 meeting. approved this
item as presented.

The Traffic Commission recommends establishment of a school zone in 2900 block Jefferson Road as
requested.

Dear Mayor Freelen:
Enclosed is the updated ordinance and map for FM 1507 ( Evergreen and Jefferson Road)
showing the new school zone at the high school facility. We are aware and submitting
this now knowing that construction will take place on the roadway, but may not be totally
completed before school starts in August 2010. By doing his now, we are insuring that a
school zone will be in place before school begins for the safety of the students and
traveling public another study can be done and adjustments made if needed after
roadwork is completed.
Please present the proposed speed-zoning plan to the city council for their review and
passage of the required ordinance. When approved, two (2) signed and sealed original
copies of the completed ordinance should be sent to this office so arrangement can be
made to place signage and documented.

AN ORDIIVANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
ESTABLISHING MAXIMUM, REASONABLE AND PRUDENT RATES OF
SPEED ON FM 1507 (JEFFERSON ROAD AND EVERGREEN) FROM ITS
BEGINNING AT THE INTERSECTION WITH SH 19/24 TO ITS
INTERSECTION WITH FM 905, WHICH INCLUDES THE LOCATIOIVS OF
THE NEW PARIS HIGH SCHOOL AND THE OLD PARIS HIGH SCHOOL IN
THE CITY OF PARIS, TEXAS; PROVIDING A REPEALER CLAUSE, A
SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, by authoriry and direction of the City Council of the City of Paris, Texas
an engineering and traffic study and survey has been made by the Transportation
Operations Office of the Texas Department of Transportation to determine the maximum,
reasonable and prudent speeds for vehicles traveling upon the following named streets and
highways and parts thereof, to facilitate the most effective use of said streets and highways
and the safe and effective movement of vehicular traffic thereon; and
WHEREAS, such study and survey establishes, and it is so found by the City Council
of the City of Paris, Texas, that the following are the maximum, reasonable and prudent
rates of speed for vehicular traffic upon said streets and highways and parts thereof;
NOW, THEREFORE, BE IT ORDAIIVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
Section 1. That the findings set out in the preamble to this ordinance are hereby in
all things approved.
Section 2. That no person shall drive a vehicle upon a public road, street and
highway in the City of Paris, Texas, at a speed greater than is reasonable and prudent under
the conditions and circumstances then existing. Except when a special hazard exists that
requires lower speeds for compliance with the above requirement, the limits hereinafter
set out below shall be lawful and any speed in excess of the limits as hereinafter set out for
the streets and highways and portions thereof to which they apply shall be prima facie
evidence that the speed is not reasonable or prudent.
Section 3. That on Farm-to-Market Road 1507 (Jefferson Road and Evergreen)
from its beginning at the intersection with SH 19/24 in an easterly direction a distance of
approximately 0.958 miles, a speed limit of 50 (fifty) miles per hour at all times; thence
easterly a distance of approximately 0.577 miles, a speed limit of 45 (forty-five) miles per
hour at all times except that a school speed limit of 30 (thirty) miles per hour will be
effective on school days while school zone lights are flashing, from highway mile point
2.230 to mile point 2.476 only during the following hours:

From 45 minutes before school opens until classes begin; from the beginning
to the end of the lunch period, if needed; and for a 30 minute period
beginning at the close of school;
Thence southeasterly direction a distance of approximately 1.917 miles, a speed limit of 50
(fifty) miles per hour at all times to the intersection of FM 1507 with FM 905 except that a
school speed limit of 35 (thirty-five) miles per hour will be effective on school days while
school zone lights are flashing, from highway mile point 3.067 to mile point 3.211 only
during the following hours:
From 45 minutes before school opens until classes begin; from the beginning
to the end of the lunch period, if needed; and for a 30 minute period
beginning at the close of school;
Section 4. That the fact that present traffic regulations are inadequate to control
traffic in areas covered by this ordinance creates an emergency which is here and now
declared, and all rules and regulations providing for the reading of ordinance is passed as
an emergency measure and shall be in full force and effect from and after its passage and
publication and after the installation of speed limit signs.
Section 5. That the speed limits for Farm-to-Market Road 1507 (Jefferson Road
and Evergreen), as set forth herein and as further described and depicted in the Speed Zone
Plan attached hereto and incorporated herein as Exhibit A are hereby established.
Section 6. That all provisions of the ordinances of the City of Paris, Texas in conflict
with the provisions of this ordinance are hereby repealed, and all other provisions of the
ordinances of the City of Paris not in conflict with the provisions of this ordinance shall
remain in full force and effect.
Section 7. That the repeal of any ordinance or part of ordinances affected by the
enactment of this ordinance shall not be construed as abandoning any action now pending
under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any
penalty accruing or to accrue, or as affecting any rights of the municipality under any
section or provisions of any ordinance at the time of passage of this ordinance.
Section 8. That it is the intention of the City Council of the Ciry of Paris that this
ordinance, and every provision hereof, shall be considered severable, and the invalidity or
partial invalidiry of any section, clause, or provisions of this ordinance shall not affect the
validity of any other portion of this ordinance.
Section 9. That any person violating any of the provisions of this ordinance shall be
guilty of a Misdemeanor, and, upon conviction, shall be fined in accordance with the
provisions of Section 1-6 of the City of Paris Code of Ordinances, and each and every day's
continuance of any violation of the above-enumerated sections shall constitute and be
deemed a separate offense.

Section 10. That by supermajority vote of _ ayes and _ nays, the City Council
voted to suspend the rule requiring two readings before adoption of this ordinance.
Section 11. That this ordinance shall become effective from and after its passage of
the first reading and publication as required by law.

Traffic Commission
City of Paris
The Traffic Commission met on Tuesday, February 2nd, 2010, at 5:15 P.M. in the
Municipal Courtroom with the following members present:
Ken Kohls
2. Ray Banks
3. Jon McFadden
4. Stephen Holmes
5. George Kimbrough
The city staff was represented by Asst. Chief Randy Tuttle.
Councilman Joe McCarthy was present a council liaison member
The meeting was called to order at 5:15pm by Chairman Kimbrough. A quorum
was established by 5 members being present.
Mr. Kimbrough asked the commission members to review the submitted minutes
of the January 5th, 2010 meeting. Mr. Holmes made a motion to approve the
minutes which was seconded by Mr. Banks and passed 5-0.
Mr. Kimbrough moved to item #3 regarding the discussion and action for a
request to place a school zone at the new Paris High School in the 2900 block
SE Loop 286. After discussion of this item Mr. Holmes made a motion to request
TXDOT do a traffic study for the placement of a school zone at this location. The
motion was seconded by Mr. McFadden and passed 5-0.
Mr. Kimbrough moved to item #4 regarding discussion and action concerning a
request for a school zone in the 2900 block Jefferson at the new Paris High
School. Mr Tuttle informed the members that the Mayor had received a letter
from TXDOT requesting an ordinance on this school zone. The school zone
would be in effect from forty-five minutes prior to school and thirty minutes after
school dismisses at a speed of 35 mph. After discussion of this item a motion to
approve the request was made by Mr. Holmes and second by Mr. Kohls. Motion
passed 5-0.
Mr. Kimbrough moved to item #5 regarding the presentation and discussion
concerning traffic study at 33rd SE & Lamar. Mr Tuttle advised members that
TXDOT had completed the traffic study and recommended a traffic signal be
placed to control traffic leaving the Continental Village apartments into the
intersection. A pedestrian crossing at west side and south side of intersection
was also proposed. This was not an action item so it will be placed on March
agenda as an action item.

Mr. Kimbrough moved to item #6 regarding a request for placement of a stop
sign at 17th SW & Kaufman. After discussion of this item Mr. Kohls made a
motion to place a stop sign at this intersection stopping north and south bound
traffic. Motion was second by Mr. Banks and carried 5-0.
Mr. Kimbrough moved to item #7 regarding a request for placement of a stop
sign at 17t" SW & Austin. After discussion of this item Mr. Holmes made a motion
to deny a request for placement of a stop sign at this intersection. Motion was
second by Mr. McFadden and carried 5-0.
Mr Kimbrough moved to item #8 regarding future agenda items. A request was
made for discussion and action on placement of a school zone on S. Collegiate
at the new Paris High School location. Another request to place an item for
discussion and action concerned placement of a school zone on 24th SE north of
current High School location.
Mr. McFadden moved for adjournment, seconded by Mr Banks at 5:45pm.
Motion carried 5-0.
