the TDHCA HOME Owner-Occupied Program and authorizing the City Manager to negotiate and
execute all necessary documents.

BACKGROUND:
The City received a HOME Owner-Occupied Program grant from the Texas Department of Housing and
Community Affairs to build up to five new homes for qualified low- and moderate-income homeowners.
A request for proposals was issued in January for construction of the homes and there were three
respondents. While Brookwood Homes had a slightly lower bid than Whitaker Homes, the evaluation
process determined that Whitaker was better qualified. Staff recommends Whitaker Homes because
they were higher rated than Brookwood and only slightly more expensive.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, ACCEPTING
THE PROPOSAL OF WHITAKER HOMES TO CONSTRUCT UP TO FIVE NEW SINGLE
FAMILY HOMES IN THE CITY OF PARIS, TEXAS UNDER THE TEXAS DEPARTMEIVT
OF HOUSING AND COMMUNITY AFFAIRS HOME OWNER-OCCUPIED PROGRAM
GRANT CONTRACT N0. 1001053; MAKING OTHER FINDINGS AND PROVISIONS
RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Paris did heretofore, request proposals from
building contractors to furnish plant, labor, materials, and equipment, and for performing all work
required for the construction of up to five (5) new single-family homes in the City of Paris, Texas
under the guidelines and requirements of the Texas Department of Housing and Community Affairs
HOME Owner-Occupied Program Contract No. 1001053, which bids were received unti110:00 o'clock
A.M., Tuesday, the 2nd day of February, 2010; and,
WHEREAS, the proposals received were noted and scored in accordance with the Program
and the highest scoring proposal was submitted by Whitaker Homes, 2550 Lamar Ave., Paris, Texas
75460, in the amounts shown on the attached tabulation and the bid should be accepted and contract
should be awarded to Whitaker Homes in accordance with the unit prices bid and the other terms
and conditions set out in the bid documents attached hereto as Exhibit A; and,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS,
TEXAS:
Section 1. That the findings set out in the preamble of this resolution are hereby in all
things approved.
Section 2. That the proposal of Whitaker Homes of Paris, Texas, for the "TDHCA HOME
Owner-Occupied Program Contract No. 1001053 housing construction builder, is hereby accepted as
the highest scoring proposal which provides the best value to the City and the contract for this
project is hereby let conditioned upon said contractor's execution of a contract with the City of Paris
and satisfaction of the terms and specifications included in the contract and bid documents attached
hereto as Exhibit A and providing all required performance and payment bonds and insurance
certificates as required.
Section 3. That the City Manager be and he is hereby authorized and directed to execute
on behalf of the City of Paris a contract for the housing construction builder in the form attached
hereto and incorporated herein as Exhibit A.
Section 4. That this resolution shall be effective from and after its date of passage.

The City of Paris is soliciting proposals for the construction of single-family homes
within the City of Paris. Up to five homes may be constructed under a HOME Program
grant received from the Texas Department of Housing and Community Affairs
(TDHCA). These homes will average between 800 and 1050 square feet.
Contract documents, including house plans are on file for review at the following places:
City of Paris, City Clerk, 150 SE ls` St., Paris, TX 75460 and Resource Management &
Consulting Co., 3727 Lamar Ave., Pazis, Texas 75460, 903/784-6439
Copies of the contract documents may lie obtained from Resource Management &
Consulting Co. (Consultant) upon the payment of $35.00 (payable to Resource
Management & Consulting Co.). Consultant shall refund $25.00 per complete set of
contract documents, including house plans, which are returned in good condition to
Consultant within 30 days after the date bids are received.
All proposals must be sealed and submitted by the bidder to the City of Paris on or before
9:30 a.m. on the 2"d day of February, 2010. Proposals may be delivered to Paris City
Hall, City Manager's office located at 135 Se. lst St., Paris, TX 75460. All bids will be
publicly opened and read aloud at 10:00 a.m. at the City of Paris, City Hall Council
Chamber located at 107 E. Kaufman Street, Paris, TX 75460.
The Contractor must ensure that employees/applicants for employment are not
discriminated against because of race, color, religion, sex or national origin.

GENERAL INSTRUCTIONS AND NOTES
The City of Pazis is soliciting proposals for the construction of single-family homes within the city limits of Paris.
The homes will be constructed on the site of the existing home of the owner after their existing home has been
demolished. Five homes will be constructed under a HOME Program grant received from the Texas Department
of Housing and Community Affairs (TDHCA).
All proposals must be submitted by the bidder to the City of Pazis, 135 SE 15` St., Pazis, Texas 75460 on or before
9:30 a.m. on the 2nd day of February, 2010. All bids will be publicly opened and read aloud at 10:00
a.m. at the City of Paris, Council Chamber located at 107 E. Kaufiman St., Paris, TX 75460. The City
will select the general contractor that submits the most favorable bid and is qualified to do the work with the
lowest combined base bid for the house plans including alternatives selected by the City.
Without limiting any of the other obligations or liabilities of the bidder (contractor), the contractor and each
subcontractor shall, during the term of the contract, acquire and maintain the hereinafter stipulated minunum
insurance with companies duly authorized to do business in State of Texas. Certificates of each policy shall be
delivered to the City before any work is started. The minimum insurance requirements are as follows:
1. Workers' Compensation as required by state law;
2. Comprehensive general liability fully insuring contractor liability for injury to or death, in the amount of at
least $250,000;
3. Comprehensive automobile and truck liability insurance in accordance with state law; and
4. A performance bond on the part of the contractor for 100 percent of the contract price. A"performance
bond" is one executed in connection with a contract to secure fulfillment of all the contractor's obligations
under such contract.
5. A payment bond on the part of the contractor for 100 percent of the contract price. A"payment bond" is
one executed in connection with a contract to assure payment as required by law of all persons supplying
labor and material in the execution of the work provided for in the contract.
All contractors will be required to bid on the home based on the attached construction drawings/plans and
construction specifications. All houses will be constructed to meet the Texas Minimum Construction Standazds,
including certain accessibility requirements, Residential Energy Code and locaUstate codes.
Since the City will be funding this home with a grant received from TDHCA, payment for work will be made
only upon completion of the vazious stages of the home and after progress and final inspections have been made
and approved by the City or by their designated representatives. Payment will be made within 30 days after the
approval of each invoice. Construction of the home shall be completed within 120 days from the date a notice to
proceed is issued to the contractor unless a longer time period has been stipulated as part of the bid price.
Construction must begin within 10 working days from the issuance of the notice to proceed.
All bid proposals must include, at a minimum:
1. Bid Sheet;
2. Detailed bid sheet for each plan;
3. Contractor Application, which lists contractor's qualifications, experiences, and work references; and
4. Affidavits included in bid packet
5. Evaluation Form
6. A full set of house plans, if submitting an alternative plan bid.
Bidding procedures, bidder selection, and any subsequent bidder appeal will be conducted in accordance with the
applicable local, state, and federal procurement regulations and protest procedures established by the City of Paris
in compliance with 24 CFR 8536.

Bidder Eligibility:
1. All contractors must be registered with the Texas Residential Construction Commission and shall
register each house with the State at the appropriate time and shall pay all registration fees.
2. Bids received after the deadline shall not be accepted and shall be returned, unopened, to the Bidder
3. Bid submission must include all referenced attachments and required documents
4. Bidders must have at least five years' full-time experience in construction and rehabilitation of
dwelling units.
Potential Disqualification Factors:
1. Unsatisfactory past performance of a particulaz Contractor on projects of similar scope and complexity.
References WILL be contacted and verified.
2. If the Bidder has altered the ProposaUBid Form during preparation of bid which will change the
conditions and/or scope of the work to be performed. Any bid exemption, variation, adjustment, or
modifications without written approval by the City prior to submission will disqualify bidders.
3. The bid package must be submitted in a sealed envelope. Bids shall not be submitted in any manner
whereby the amounts of bid or bids may be disclosed, examined or read prior to the time of the bid
opening.

1. I understand that I am bidding on a construction contract funded with federal dollars and administered by
the Texas Department of Housing and Community Affairs (TDHCA). I understand that debarment by either
the State of Texas or the federal government will make me ineligible.
2. I understand that all work must be completed in accordance with HOME Program requirements and, as
applicable:

■ Texas Minimum Construction Specifications (TMC Specs)
■ International Residential Code (IRC) - new construction and reconstruction
■ Colonia Housing Standards (CHS) - only in areas specifically designated as colonias
■ All local building codes, standards, and specifications
3. I hereby certify that all work performed will meet or exceed applicable codes, standards, and specifications
as they apply to the construction work for which I am bidding. I also understand that compliance with
applicable minimum construction codes, standazds, and specifications will be considered part of my contract
in the event that my bid is accepted by the above-referenced Contract Administrator. I understand that
failure to meet or exceed applicable codes, standards, and specifications may result in debarment from
future federally funded construction contracts.
4. I understand that I must provide a one-year warranty on all work performed and that failure to complete
warranty work in a timely manner may result in my debarment from future federally funded construction
contracts.
5. I understand that at least ten percent (10%) of project construction funds will be retained for thirty (30) days

CONTRACTOR LOCAL OPPORTUNITY PLAN
Agrees to implement the following specific
affirmative action steps directed at inc a ing the utilization of lower income residents and
businesses with the City of Paris.
A. To ascertain from the locality's TDHCA program official the exact boundaries of the
project area and where advantageous, seek the assistance of local officials in
preparing and implementing the affirmative action plan.
B. To attempt to recruit from within the city the necessary number of lower income
residents through: local advertising media, signs placed at the proposed site for the
project, and community organizations and public or private institutions operating
within and servicing the project area such as Service Employment and
Redevelopment (SER), Opportunities Industrialization Center (OIC), Urban League,
Concentrated Employment Program, Hometown Plan, or the U.S. Employment
Service.
C. To maintain a list of all lower income residents who have applied wither on their own
or on referral from any source, and to employ such person, if otherwise eligible and if
a vacancy exists.
D. To insert this plan in all bid documents and to require all bidders on subcontract to
submit an affirmative action plan including utilization goals and the specific steps
planned to accomplish these goals.
E. To insure that subcontracts (greater than $10,000) which are a typically let on a
negotiated rather than a bid basis in areas other than the project area are also let on a
negotiated basis, whenever feasible, in a covered project area.
F. To formally contact unions, subcontractors, and trade associations to secure their
cooperation in this effort.
G. To insure that all appropriate project area business concerns are notified of pending
subcontractual opportunities.
H. To maintain records, including copies of correspondence, memoranda, et., which
document that all of the above affirmative action steps have been taken.
I. To appoint or recruit an executive official f the company or agency as Equal
Opportunity officer to coordinate the implementation of his plan.
J. To maintain records concerning the amount and number of contracts, subcontracts,
and purchases which contribute to objectives.
K. To maintain records of all projected work force needs for all phases of the project by
occupation, trade, skill level, and umber of positions and to update these projections
based on the extent to which hiring meets these Local Opportunity objectives.
