2010-016 ORD APPROVING PLACEMENT OF SIGNAL LIGHT AND PEDESTRIAN CROSSWALK AT 33RD ST SE AND LAMAR AVEORDINANCE NO. 2010-016 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING THE TRAFFIC CONTROL MAP ADOPTED IN SECTION 31- 65(b) OF THE CODE OF ORDINANCES OF THE CITY OF PARIS, TEXAS; APPROVING THE PLACEMENT OF A SIGNAL LIGHT A1VD PEDESTRIAIV CROSSWALK AT 33RD STREET SE AND LAMAR AVENUE; MAKING OTHER FINDIIVGS A1VD PROVISIOIVS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Traffic Commission, at its regular meeting of March 2, 2010, considered a request to place a signal light and pedestrian crosswalk at 33rd Street SE and Lamar Avenue and approved the request; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That the Traffic Control Map adopted in Paragraph (b) of Section 31- 65 of the Code of Ordinances of the City of Paris, Paris, Texas, be, and the same is hereby, amended to include the following signal light and pedestrian crosswalk in accordance with Exhibit A attached hereto and made a part hereof: "Placement of a signal light to control traffic coming from the private property located north of the intersection of 33rd St. SE and Lamar Avenue and to add Pedestrian Crosswalk on the west and south sides of the intersection at 33rd Street SE and Lamar Avenue." Section 3. That all provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 4. That the repeal of any ordinance or part of ordinances affected by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance. Section S. That it is the intention of the City Council of the City of Paris that this ordinance, and every provision hereof, shall be considered severable, and the invalidity or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section 6. That any person violating any of the provisions of this ordinance shall be guilty of a Misdemeanor, and, upon conviction, shall be subject to a fine in accordance with provisions of Sec. 1-6 of Chapter One of the City of Paris Code of Ordinances and each and every day's continuance of any violation of the above- enumerated sections shall constitute and be deemed a separate offense. Section 7. That by a supermajority vote of 6 ayes and 0 nays, the City Council voted to suspend the rule requiring two readings before adoption of this ordinance. Section 8. That this ordinance shall become effective from and after its passage of the first reading and publication as required by law. S i 14 !i j ; , Minutes Traffic Commission City of Paris The Traffic Commission met on Tuesday, March 2nd, 2010, at 5:15 P.M. in the Municipal Courtroom with the following members present: 1. Matt Frierson (arrived during item #3) 2. Ray Banks 3. Jon McFadden 4. Stephen Holmes 5. George Kimbrough The city staff was represented by Asst. Chief Randy Tuttle. Councilman Joe McCarthy was present a council liaison member The meeting was called to order at 5:17pm by Chairman Kimbrough. A quorum was established by 5 members being present. Mr. Kimbrough asked the commission members to review the submitted minutes of the February 2, 2010 meeting. Mr. Banks made a motion to approve the minutes which was seconded by Mr. Holmes and passed 4-0. Mr. Kimbrough moved to item #3 regarding the discussion and action for a request to place a school zone at the new Paris High School on S. Collegiate from Jefferson Rd south to Loop 286. After discussion of this item Mr. Holmes made a motion for the placement of a school zone at this location. The motion was seconded by Mr. Banks and passed 5-0. Mr. Kimbrough moved to item #4 regarding discussion and action concerning a request for a school zone in the 2000 block 24th SE. Mr Tuttle informed the members that the City Engineer did not recommend placement of a school zone at this location. After discussion of this item a motion to deny the request was made by Mr. Holmes and second by Mr. Banks. Motion passed 5-0. Mr. Kimbrough moved to item #5 regarding discussion and action concerning traffic study at 33rd SE & Lamar. Mr Tuttle advised members that TXDOT had completed the traffic study and recommended a traffic signal be placed to control traffic leaving the Continental Village apartments into the intersection. A pedestrian crossing at west side and south side of intersection was also proposed. After discussion of this item Mr. McFadden made a motion for placement of traffic signal and pedestrian crosswalk at this location and seconded by Mr. Banks. Motion passed 5-0. Mr. Kimbrough moved to item #6 regarding a request for placement of a no parking zone in 200 block 2"d SW. Mr. Tuttle advised members that Fire Marshall Dale Maberry requested the placement of a no parking zone in front of Christians in Action to keep entrance clear for emergency vehicles. After discussion of this item Mr. Holmes made a motion to place a no parking zone at this location. Motion was second by Mr. Frierson and carried 5-0. Mr. Kimbrough moved to item #7 regarding presentation of information concerning school zones within the city and placement of cell phone use signage in school zones. Mr. Tuttle informed members that city staff was in the process of installing cell phone usage signs in the school zones. Mr. Tuttle also informed members that some school zones may need to be moved to be in compliance with regulations and if so a change in ordinance may be needed. Mr Kimbrough moved to item #8 regarding future agenda items. There were no future agenda items. Mr. Holmes moved for adjournment, seconded by Mr Frierson at 5:38pm. Motion carried 5-0.
