POLICY ISSUE(S): Fire prevention; Code enforcement; Public safety BACKGROUND: Though the City Charter allows for Fire Prevention Fees, no official schedule has ever been adopted. With the ever increasing number of plans reviews, fire system inspections, burn permits, etc., we are modifying our process in order to be more efficient, effective, and to be able to offset the overall cost associated with these processes. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING ARTICLE IV OF CHAPTER 12, FIRE PREVENTION AND PROTECTION OF THE CODE OF ORDINANCES OF THE CITY OF PARIS, TEXAS, BY AMENDIIVG SECTION 12-89 PERMIT FEES; ESTABLISHING PERMIT FEES REQUIRED BY THE FIRE CODE; MAKING OTHER FINDIIVGS A1VD PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; A1VD PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Paris, Texas requested staff to amend the City's Fire Prevention and Protection Code establishing permit fees required by the Fire Code; and WHEREAS, the City Council of the City of Paris hereby finds and determines that the changes recommended below are in the best interest of the City of Paris and its citizens and should be adopted. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That Sec. 12-89 of Chapter 12, Article IV, Fire Prevention and Protection of the Code of Ordinances of the City of Paris, Texas, be, and the same is hereby amended to read as follows and all remaining subsections to be renumbered accordingly: " Sec.12-89. Permit fees. (a) Required Fire Plans Review Fees Underground Fire Main Plan $50.00 fee per each fire main. Additionally: (1) A detailed plan shall be submitted to the City of Paris for review on the installation andlor modification of any underground fire main. Above Ground Fire Systems A$75.00 minimum or $.50 per fire sprinkler head whichever is greater with the fee not to exceed $500.00. Additionally: (1) The fee will be calculated according to the total number of sprinkler heads shown on plans. (2) An approved third-pariy plans review is required when the installation or relocation of sprinkler heads exceeds twenty (20) heads. -1- 3.0 (3) An approved list of third-party fire protection engineers will be provided upon request. Fire Alarm S. sty ems A$75.00 minimum or $.50 per fire alarm device whichever is greater, with the fee not to exceed $500.00. Additionally: (1) The fee will be calculated according to the total number of devices shown on plans. (2) An approved third-party plans review is required when the installation or relocation exceeds ten (10) devices. (3) An approved list of third-party fire protection engineers will be provided upon request. (b) Required Fire Construction Permit Fees Underground Fire Main $50.00 permit fee per each fire main, is required for the installation and/or modification of any underground fire main. Above Ground Fire Sprinkler Systems $75.00 Minimum or $.SO per fire sprinkler head, whichever is greater, with the fee not to exceed $500.00. Additionally: (1) The fee will be calculated according to the total number of sprinkler heads shown on plans. Fire Alarm Svstems $75.00 Minimum or $.50 per fire alarm device, whichever is greater, with the fee not to exceed $500.00. Additionally: (1)The fee will be calculated according to the total number of devices shown on plans. Fixed Fire Extinguishing Svstem A$50.00 fee is required for the installation and/or modification of any fixed fire extinguishing system. Flammable and Combustible Liquids A$100.00 fee is required for the installation and/or removal of any above/below ground flammable or combustible liquid tank. LP-Gas A$50.00 fee is required for the installation andlor modification of any LP-Gas System. -2- 31 Spraying or Dipping A$100.00 fee is required for the installation and/or modification of any spray room, dip tank or spray booth. Standpipe svstems A$100.00 fee is required for the installation and/or modification of any standpipe system that is not a component of an automatic sprinkler system. (c) Required Fire Operational Permit Fees Explosives: A$100.00 fee is required far the use of an explosive or explosive device when such use is not related to a public fireworks display with free admission to the public. Fire h,ydrants and valves; A $50.00 fee is required. Exceptions: (1) The permit fee will be waived for authorized employees of the City of Paris in performance of their duties. (2) A fire permit fee will be waived for the use of a hydrant whereby a meter has been installed in accordance with a billing arrangement through the City of Paris Water Billing Department or the Lamar County Water Supply District. Additionally: The Fire Code Official will be notified of all hydrant use including the installation of hydrant meters. Hot-Work Operations: A$25.00 event fee is required for public hot-work exhibitions and demonstrations. Open Burning: A permit, issued at no charge, is required for the kindling and maintaining of any and all fires that meet the definition of "Open Burning" within the City of Paris. Exceptions: (1) A"Training Fire" conducted by the Paris Fire Department. Additionally: (1) A property of at least ten (10) acres in size and zoned "Agricultural" by the City of Paris, may qualify for an Agricultural Burn Permit. (2) An Agricultural Burn Permit will be valid for one (1) full year beginning the date of issuance. (3) Only brush, limbs, leaves, trees, andlor other natural vegetation generated from the property in question, may be burned. (4) A Standard Burn Permit may be issued for "Disposal" and "Recreational" fires. Only brush, limbs, leaves, trees, and clean-untreated lumber may be burned." -3- 3 ' Section 3. That all provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 4. That the repeal of any ordinance or part of ordinances affected by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance. Section S. That it is the intention of the City Council of the City of Paris that this ordinance, and every provision hereof, shall be considered severable, and the invalidity or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section 6. That any person violating any provision of this ordinance shall be guilty of a Misdemeanor, and upon conviction, shall be subject to a fine in accordance with provisions of Sec. 1-6 of Chapter One of the City of Paris Code of Ordinances, and each and every day's continuance of any violation of the above-enumerated sections shall constitute and be deemed a separate offense. Section 7. Introduced and read on first reading on June 28, 2010, at a regular meeting of the City Council of the City of Paris and read and passed on second reading on July 12, 2010, at a regular meeting of the City Council of the City of Paris; the same being two (2) separate regular meetings of the City Council of the City of Paris Section 8. That this ordinance shall become effective from and after its passage of the second reading and publication as required by law.
