Kaufrnan, Paris, Texas. Present: Mayor: Will Biard Council Members: Joe McCarthy; Jason Rogers; John Wright; Stephen Brown; Edwin Pickle; and Rhonda Rogers City Staff: Kevin Carruth, City Manager; Kent McIlyar, City Attorney; Janice Ellis, City C1erk; Bob Hundley, Police Chief; Ronnie Grooms, Fire Chief; Gene Anderson, Finance Director; Shawn Napier, Director of Engineering; and Priscilla McAnally, Library Director Opening Agenda 1. Call meeting to order. Mayor Biard called the meeting to order at 5:31 p.m. 2. Invocation. Pastor Bill Felts gave the invocation. 3. Pledge of Allegiance. Council Member John Wright led the pledge. 4. Citizens' forum. Thelma Clement, 1471 N.E. 15`h Street - she complained about problems with a water drain and inquired if the City was responsible or if she was responsible for repairing it. Ranger Abbott, 125 S.W. 41s` Street - he said his request to be on the Agenda had been denied three times. He also said that his property was already zoned for non-conforming use and asked the City Council to read the letter from the City Manager that was sent to him in 2008. Gene McWaters, 415 S.W. 39'1' Street - he spoke in opposition to raising fees with regard to items 10 and 11. ~ 4v/ Regular Council Meeting luly 12, 2010 Page 2 Ronnie Abbott, 1450 CR 36330 - he stated his support for his son, Ranger Abbott and said the City should encourage gowth. Consent Atzenda Mayor Biard inquired of Council Members if they wished to pull any items ftom the Consent Agenda for discussion. There were none. Council Member Pickle made a Motion to approve the Consent Agenda and Council Mernber McCarthy seconded the Motion. The Council voted seven (7) for and none (0) opposed to approve and adopt Consent Agenda Items 5, 6, 7, 8, and 9. 5. Deliberate and act on the approval of minutes from the meeting on June 28, 2010. 6. Receive and deliberate on reports and/or minutes from the following boards, commissions, and committees: a. Paris Public Library Advisory Board minutes (5-19-2010) b. Planning and Zoning minutes (6-7-2010) 7. Deliberate and act on RESOLUTION NO. 2010-076: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING AND AUTHORIZING AN INTERLOCAL AGREEMENT WITH PARIS INDEPENDENT SCHOOL DISTRIGT FOR PROVISION OF SCHOOL RESOURCE OFFICER SERVICES; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. 8. Deliberate and act on RESOLUTION NO. 2010-077: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PAR1S, TEXAS, APPROVING AND AUTHORIZING AN INTERLOCAL AGREEMENT WITH NORTH LAMAR INDEPENDENT SCHOOL DISTRICT FOR PROVISION OF SCHOOL RESOURCE OFFICER SERVICES; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. 9. Deliberate and act on RESOLUTION NO. 2010-078: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, NOMINATING KEVIN CARRUTH FOR PLACE 2 ON THE TEXAS MUNICIPAL LEAGUE INTERGOVERNMENTAL RISK POOL BOARD OF TRUSTEES; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. Second reading, deliberate and possibly act on ORDINANCE NO. 2010-024: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PAR1S, TEXAS ~ Regular Councii Meeting July 12, 2010 Page 3 AMENDING ARTICLE IV OF CHAPTER 12, FIRE PREVENTION AND PROTECTION OF THE CODE OF ORDINANCES OF THE CITY OF PARIS, TEXAS, BY AMENDING SEGTION 12-89 PERMIT FEES; ESTABLISHING PERMIT FEES REQUIRED BY THE FIRE CODE; MAKIN`G OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTNE DATE. A Motion to approve this item was made by Council Member Rhonda Rogers and seconded by Council Meinber Pickle. Motion carried, 7 ayes - 0 nays. 11. Second reading, deliberate and possibly act on ORDINANCE NO. 2010-025: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING SECTION 16-28, RESIDENTIAL COLLECTION RATE OF ARTICLE II, REGULATION OF THE COLLECTION OF SOLID WASTE, CHAPTER 16, GARBAGE AND OTHER WASTE MATERIAL, OF THE CODE OF ORDINANCES OF THE C1TY OF PARIS, TEXAS, BY AMENDING SEC. 16-28(a); PROVIDING FOR ANINCREASE 1N THE COLLECITON RATE; AND BY ADDING SECTION 16-28(d), DESIGNATING THE FINANCE DIRECTOR TO HEAR ANY APPEALS RELATED TO SANITATION ACGOUNTS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDIIVG A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. A Motion to approve this item was made by Council Member Brown and seconded by Council Member Pickle. Motion carried, 6 ayes - 1 nay, with Council Member Rhonda Rogers casting the dissenting vote. 12. Deliberate and act on RESOLUTION NO. 2010-079: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, NAMING THE TEXAS DEPARTMENT OF TRANSPORTATION AS ITS AGENT FOR THE PURPOSES OF APPLYING FOR, RECEIVING AND DISBURSING ALL FUNDS FOR CERTAIN AIRPORT IMPROVEMENTS AND FOR THE ADMINISTRATION OF CONTRACTS NECESSARY FOR THE IMPLEMENTATION OF SAID IMPROVEMENTS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. A Motion to approve this item was rnade by Council Member McCarthy and seconded by Council Member Rhonda Rogers. Motion carried, 7 ayes - 0 nays. 13. Convene into Executive Session: Pursuant to Section 551.071 of the Texas Government Code, Consultation with Attorney, to receive legal advice from the City Attorney about legal issues raised in connection with awarding a contract and/or on matters in which the duty of an attorney to his client ~ Regular Council Meeting July 12, 2010 Page 4 under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas, clearly conflict with this chapter. Mayor Biard recessed City Council into executive session at 5:53 p.m. 14. Reconvene into Open Session. Mayor Biard reconvened City Council into open session at 6:21 p.m. and said that there was no action to be taken on items discussed in executive session. 15. Consider and approve future events for City Council and/or City Staff pursuant to Resolution No. 2004-081. Mayor Biard reminded everyone about the Paris Diversity Dinner scheduled for July 31yt from 5:30 to 8:00 p.m. at the Red River Valley Fairgounds. Council Member Pickle said there was an Airport meeting scheduled for Thursday. Mr. Carruth reminded everyone about the blood drive taking place from noon until 4:00 p.m. on Friday at the Library. 16. Adjournment. There being no further business, a Motion to adjourn was made by Council Member Pickle and was seconded by Council Member Jason Rogers. Motion carried, 7 ayes - 0 nays.
