These specifications are intended to describe the use of a landfill for the City and the collection of residential solid waste. There will be a pre-proposal meeting at 9:30 a.m. on September 23, 2010, in the Paris City Council Chamber, 150 Kaufman Street, Paris. Proposals addressed to the City of Paris will be received until 3:00 p.m. Friday, October 14, 2010, and then publicly opened and read aloud. No PROPOSALS may be withdrawn after the scheduled opening time. Any bids received after scheduled bid opening time will be returned unopened. Bids must be submitted on City Bid Forms. If a proposal for 20 residential collection is selected, the effective date will be negotiated but will be no later than 21 August 2011. 22 23 24 REQUIREMENTS 25 All proposals for landfill services must be prepared and signed by the proposer in Exhibit "A." 26 Proposals for residential solid waste collection must be prepared and signed by the proposer in 27 Exhibit "B." Additional copies of the proposal form may be obtained from the City Manager's 28 office. All blank spaces in each proposal form, together with appropriate schedules, must be 29 completed in ink or typewritten. The City further reserves the right to accept any proposal or reject any or 46 all proposals and to waive defects or irregularities in any proposal that the City Council may 47 deem to be in the best interest of the City. Any proposal may be withdrawn prior to the 48 scheduled 3:00 p.m. Friday, October 14, 2010 opening of the proposals or authorized 49 postponement thereof. Any proposal received after 3:00 p.m. Friday, October 14, 2010 will not 50 be considered. 51 52 Each bid must be accompanied by appropriate proposal security in the form of a certified or 53 cashier's check or an approved bidder's bond made payable unconditionally to the City in the 54 amount of fifty thousand dollars ($50,000.00) as a guarantee that, if awarded the contract, the 55 bidder shall enter into a contract and execute all necessary bonds. Checks and bonds will be 56 returned promptly after the City and the selected Contractor have executed the Contract, or, if no 57 Contractor's Proposal has been selected within ninety (90) days after the date of the opening of 58 the Proposals, upon demand of the Contractor at any time thereafter, so long as he has not been 59 notified of the acceptance of his Proposal. 60 61 Refusal to execute the contract in accordance with the proposal or the failure to give such bonds 62 as may be specified in the Contract documents shall cause forfeiture of the proposal security set 63 out above without necessity of court action or any other formality. 64 65 Each proposal must be accompanied by a certificate of insurance evidencing the coverage set 66 forth in Section 16 of the General Specifications. 67 68 Performance and payment bonds are to be submitted on the forms provided as part of the 69 Contract Documents. Performance bonds are to be in the amount of not less than one hundred 70 percent (100%) of the contract price for one (1) year, conditioned upon the faithful performance 71 of the contract, and upon payment of all persons supplying labar or furnishing materials. Bonds 72 shall be executed by a surety company authorized to do business in the State of Texas. Owner 73 shall approve bonds as to form. The Owner may, in its discretion, reject a surety it believes 74 unacceptable; a failure to reject a surety who is unacceptable or fails to perform its obligations 75 shall incur no liability to Owner. 76 77 If any person contemplating submitting a bid is in doubt as to the meaning of any part of the 78 plans, specifications, or other proposed contract documents, he may submit to the City's contact 79 a written request for an interpretation thereof prior to seven (7) days of the time of opening of 80 bids. The person submitting the request will be responsible for its prompt delivery. Any 81 interpretation of these documents will be made only by addendum duly issued and a copy of such 82 addendum will be mailed or delivered to each person receiving a set of such documents. The 83 City's contact will not be responsible for any other explanations or interpretations. 84 85 86 Specifications for Solid Waste Disposal Landfill Facility and Residential Solid Waste Collection Page 2 187 87 QUANTITIES 88 The City estimates that initial service under the contract will be for approximately 7,868 89 residential accounts, which is estimated to produce the last three approximate annual amounts of 90 the following material: 91 92 93 While the estimated volumes of the materials noted above are based on the most recent 36 94 months of data, the City makes no representation as to the reliability of its estimates to predict 95 future need. Each proposer is encouraged to utilize its own method of determining amounts to 96 be generated in each category and to provide for growth or shrinkage factors. 97 98 99 CITY FACILITIES & EVENTS l00 Proposers are required to make unlimited tandfill space available to the City at no extra charge 101 for waste collected and disposed of by the City as follows (the number of events and volume of 102 waste may increase or decrease from year to year): 103 104 1. City wide clean-ups (twice a year) 105 2. Neighborhood Beautification Program clean-ups (weekly) 106 3. Pumpkin Festival (annual) 107 4. City buildings, offices, & facilities (weekly or more often, as needed) 108 109 Waste will be collected by the City's choice of collection companies at different periods chosen 11 o by the City throughout each year. During each of these periods, the proposer will also accept 111 large, unusual, and bulky waste at its disposal site free of charge. 112 113 114 ADDITIONAL SERVICES 115 Proposers may include additional services beyond the specifications described in this RFP. 116 Details, including must be listed in Exhibit "A" or "B," as appropriate. 117 118 119 1'ERM 120 A contract for landfill services will be for a ten (10) year period, with an option to renew for an 121 additional ten (10) year period, beginning on April 1, 2011, Either party may cancel the contract 122 by notifying the other party by certified mail a minimum of one (1) year prior to the expiration 123 date of the term. Either party may cancel the contract by notifying the other party by certified mail a 128 minimum of one (1) year prior to the expiration date of the term. 129 130 131 REMUNERATION 132 Upon the completion of the second year of the contracts contemplated by this Request for 133 Proposals and annually thereafter, the rates for the disposal of solid waste at the proposer's site 134 or for residential collection services shall be subject to adjustments proportionate to any 135 increases or decreases in the Consumer Price Index (CPI) issued by the U.S. Department of 136 Labor, Bureau of Labor Statistics for the Dallas/Fort Worth (or any other successor agency of the 137 United States that shall issue such indexes or data) and shall provided for the pass-through of any 138 increases in the Texas state tipping fee or any new (after the effective date of the contract) 139 federal government tax levied on municipal solid waste disposal. Any changes in any law, 140 federal or state, which causes an increase in the costs associated with the provision of services 141 pursuant to this agreement shall be presented to the City with the background information which 142 Proposer/Contractor believes evidences the need for a cost increase with a request to increase the 143 amount of remuneration due pursuant to this Agreement. The City shall conduct a due diligence 144 investigation to determine whether a requested increase is justified. Following an investigation 145 and evaluation of the request the City Council shall act to approve or deny the request. 146 147 Either party may cancel a Contract by notifying the other party in writing by certified mail a 148 minimum of one (1) year prior to the expiration date of the Contract to the address provided in 149 the Contract, as updated throughout the Term, for notices. 150 151 The Contractor will be responsible for all City, State, and Federal landfill fees and taxes. 152 153 154 INDEMNITY 155 The successful proposer will defend, indemnify, and hold the City, its officers, agents, servants 156 and employees harmlessfrom and against any and all suits, actions, legal proceedings, claims, 157 demands, damages, costs, expenses, and attorney's fees incident to any work done in the 158 performance of the Contract arising out of any act or omission of the successful proposer, its 159 officers, agents, servants and employees; provided, however, that the successful proposer shall 160 not be liable for any suits, legal actions, claims, demands, damages, costs expenses, and 161 attorney's fees caused solely by a negligent act or omission of the City, its officers, agents, 162 servants and employees. 163 164 165 Specifications for Solid Waste Disposal Landfll Facility and Residential Solid Waste Collection Page 4 -1 189 166 GENERAL SPECIFICATIONS 167 168 Section 1- GRANT 169 The Contractor (hereinafter all references to Contractor shall mean the successful proposer who 170 submits a proposal pursuant to this Request for Proposal) shall: 171 172 1. Be the sole provider of solid waste disposal services through the provision of a landfill 173 for use by the City's chosen Solid Waste Collection company, such services does not 174 include the actual collection of solid waste on behalf of the City which will be procured 175 by a separate agreement, for a term of ten (10) years beginning on April l, 2011 with an 176 option to renew for an additional ten (10) year period, subject to each and all of the terms, 177 conditions and covenants, whether expressed, implied or embodied by reference, set forth 178 and contained herein. 179 180 2. Be the sole provider of residential solid waste collection services-(such services does not 181 include the disposal of solid waste on behalf of the City, which will be procured by a 182 separate agreement) for a term of ten (10) years beginning on negotiated date no later 183 than August 31, 2011, with an option to renew for an additional ten (10) year period, 184 subject to each and all of the terms, canditions and covenants, whether expressed, implied iss or embodied by reference, set forth and contained herein. 186 187 Section 2 - DEFINITIONS 188 Bags: Plastic sacks designed to store refuse wiih sufficient wall strength to maintain physical 189 integrity when lifted by the top. Total weight of a bag and its content shall not exceed 30 pounds 190 in weight. 191 192 Brush: Tree trimmings, lawn trimmings, weeds, hedge trimmings and trees not to exceed 193 eighteen (18) inches in diameter, cut in lengths not to exceed six (6) feet and securely bundled in 194 sizes not exceeding fifty (50) pounds. 195 196 Bulky Waste: Stoves, refrigerators (certified as having the properly refrigerant removed), 197 washing machines, furniture and other waste materials other than construction debris, dead 198 animals, hazardous waste or stable matter with weights or volumes greater than those allowed for 199 containers or bins, as the case may be. 200 201 Bundle: Newspapers and magazines securely tied together forming an easily handled package 202 not exceeding four feet in length nor exceeding 30 pounds in weight. 203 204 Citv: The City of Paris, Texas. 205 206 Construction Debris: Waste building materials resulting from construction, remodeling, repair or 207 demolition operations. 208 209 Container: A plastic bag not to exceed 55 gallons or 50 pounds. 210 Specifications for Solid Waste Disposal Landtill Facility and Residential Solid Waste Collection Page 5 1- 190 211 Contract Documents: The Request for Proposals, Instructions to Proposers, Contractor's 212 Proposal, General Specifications, Resolution of the City authorizing the execution of the 213 Contract, the Contract, the Contract Performance and Payment Bond or Letter of Credit, 214 insurance policies and/or certificates of insurance, and any addenda or changes to the foregoing 215 documents agreed to by the City and the Contractor. 216 217 Dead Animals: Animals or portions thereof equal to or greater than 10 pounds in weight that 218 have expired from any cause, except those slaughtered or killed for human use. 219 220 Disposal Site: A refuse depository including but not limited to the landfills, transfer stations, 221 incinerators and waste processing/separation center licensed, permitted or approved by all 222 governmental bodies and agencies having jurisdiction and requiring such licenses, permits, or 223 approvals to receive refuse and/ar dead animals for processing or final disposal. 224 225 Garbage: Any and all dead animals of less than 10 pounds in weight, except those slaughtered 226 for human use; every day accumulation of waste (animal, vegetable and/or other matter) that 227 results from the preparation, processing, consumption, dealing in, handling, packing, canning, 228 storage, transportation, decay or decomposition of ineats, fish, fowl, birds, fruits, grains or other 229 animal or vegetable matter (including, but not by way of limitation, that used in tin cans and 230 other food containers; and all putrescible or easily decomposable waste animal or vegetable 231 matter which is likely to attract flies or rodents); except bulky waste, construction debris, dead 232 animals 10 pounds or more in weight, hazardous waste, rubbish or stable matter. 233 234 Hazardous Waste: Any chemical, compound, mixture, substance or article which is designated 235 by the United States Environmental Protection Agency ar appropriate agency of the State to be 236 "hazardous" as that term is defined by or pursuant to Federal or State Law. 237 238 Landfill: A facility used by the contractor where trash and garbage are disposed of by burying 239 between layers of earth or other approved daily cover. 240 241 Municipal Solid Waste: Residential refuse and bulky waste, construction debris, rubbish, and 242 stable matter generated at a residential unit, unless the context otherwise requires and 243 commercial and industrial refuse. 244 245 Producer: An occupant of a residential unit who generates refuse. 246 247 Residential Refuse: All garbage and rubbish generated by a producer at a residential unit. 248 249 Rubbish: Nonputrescible solid waste (excluding ashes), consisting of both combustible and non 250 combustible waste materials; combustible rubbish includes paper, rags, cartons, wood, excelsior, 251 furniture, rubber, plastics, yard trimmings, leaves, and similar materials; noncombustible rubbish 252 includes glass, crockery, tin cans, aluminum cans, metal furniture, and the like materials which 253 will not burn at ordinary incinerator temperatures (1600 to 1800 degrees F). 254 255 Sludge: Any solid, semi-solid, or liquid waste generated from a municipal, commercial, or 256 industrial wastewater treatment plant, water supply treatment plant, or air pollution control Specifications for Solid Waste Disposal Landfill Facility and Residential Solid Waste Collection Page 6 ` ' ~ ~ ~ 257 258 259 260 261 262 263 264 265 266 267 268 269 270 271 272 273 274 275 276 277 278 279 280 281 282 283 284 285 286 287 288 289 290 291 292 293 294 295 296 297 298 299 300 301 facility or any other such waste having similar characteristics and effect, exclusive or the treated effluent from a wastewater treatment plant. Solid Waste: Any garbage, refuse, sludge from a waste treatment plant, water supply treatment plant or air pollution control facility, and other discarded material, including solid, liquid, semi- solid, or contained gaseous material resulting from industrial, municipal, commercial, mining, and agricultural operations, and from community and institutional activities, but does not include: A. solid or dissolved material in domestic sewage, or solid or dissolved material in irrigation retain flows, or industrial discharges subject to regulation by permit issued pursuant to Chapter 26, Water Code. B. soil, dirt, rock, sand and other natural man-made inert solid materials used to fill land if the object of the fill is to make the land suitable for the construction of surface improvements; or C. waste materials that result from aetivities associated with the exploration, development, or production or oil or gas and are subject to control by the Railroad Commission of Texas. Section 3- SCOPE OF SERVICES A. The work under this Contract shall consist of the items contained in the proposal including all the supervision, materials, equipment, labor and all other items necessary to complete said work in accordance with the Contract. B. In the event of a flood, tornado, severe inclement weather or similar or different act of God over which the Contractor has no control, the City may suspend collection and the Contractor and the City will negotiate the payment to be made to the Contractar. In addition, the City agrees that such increase volume is to be handled by the Contractor. Further, if the City and the Contractor reach such an agreement, then the City shall grant the Contractor variances in routes and schedules as deemed necessary by the City Manager. Section 4 - DISPOSAL SITE The Contractor shall specify the name(s), location(s), and owner(s) (including the percentage of ownership) of the disposal site(s) which the Contractor intends to use to perform the franchise. The disposal site(s) shall be approved by the State of Texas, and written proof of the disposal site's ability to handle all waste contemplated in this agreement shall be furnished to the City. The Contractor shall also submit to the City proof that the disposal site(s) has/have complied with annual licensing requirements, of the State of Texas for an annual fee and permit. Further, the Contractor shall provide reasonable and satisfactory evidence to the City that the Contractor will have the right to use the disposal site(s) under and for the duration of the franchise, Specifications for Solid Waste Disposal Landfill Facility and Residential Solid Waste Collection Page 7 .1 192 302 303 304 Section 5- MAINTAINING ALL-WEATHER ROAD AND WET WEATHER AREAS 305 The Contractor shall maintain all-weather roads leading to the landfill from public streets as well 306 as maintaining all-weather roads from the entrance of the landfill to the dumping site(s) or 307 transfer stations for the City. 308 309 Furthermore, the Contractor shall always provide one or more wet weather areas as needed to 310 maintain sufficient auxiliary equipment and labor at the landfill site to get any af the equipment 311 used by the City or its agents or servants out of muddy or flooded wet areas. 312 313 Section 6 - EQUIPMENT 314 A landfill services contractor agrees to furnish, at its own expense, all trucks, equipment, 315 machinery and labor which are necessary to adequately, efficiently and properly dispose of solid 316 waste and brush from accounts serviced by the City's choice of waste collection Franchise. 317 318 A residential collection services contractor agrees to furnish, at its own expense, all trucks, 319 equipment, machinery and labor which are necessary to adequately, efficiently and properly 320 collect solid waste and brush and dispose of it at the City's choice of landfill services provider. 321 322 Section 7 - OFFICE 323 Contractor shall maintain an office and keep such office open to the public on the days of the 324 week, Monday-Friday, except those days of the week observed as legal holidays by the City, 325 from at least 8:00 a.m. until 5:00 p.m., in order to service all complaints relating to its waste 326 disposal service. Contractor shall keep competent personnel in the office during the time that the 327 office is required to be open to the public and to the City's choice of waste collection franchise. 328 329 Contractor shall furnish to the City a name(s) and telephone number(s) of an officer(s) and/or 330 employee(s) who can be contacted after normal business hours if an emergency or critical 331 situation should occur. 332 333 Section 8 - HOLIDAYS 334 The following shall be holidays for purposes of this contract: 335 336 1. Section 9 - PERSONNEL The Contractor shall assign a qualified person to be in charge of the Contractor's operations in the City; such person shall be responsible for responding to requests for service and com laints relative to inadeQuate service. Section 10 - DISPOSAL OF WASTE FOR MUNICIPAL FACILITIES Contractor shall make no charge for the disposal of waste accumulation by the City at City- owned, operated or other City designated sites, including City parks, so long as the same can be collected on a regular route of the City's choice of waste collection Franchise. Section 11- CUSTOMER SERVICE REPORT Contractor shall provide the City a customer service report by the 10th day of the month reflecting customer service calls for the previous month. This report shall contain the following minimum information on each call: 1. Customer name 2. Service address 3. Customer telephone number 4. Synopsis of complaint or comment 5. Date and time complaint or comment received 6. Synopsis of resolution of complaint or comment 7. Date and time complaint or comment resolved The report shall be submitted in hardcopy form as well as in a mutually agreeable electronic format. Section 13 - PROHIBITION OF MIXING WASTE STREAMS 38o Residential Services Contractor shall not mix City waste collected under this Contract with waste 381 from any other source. 382 383 Section 14 - TRANSFERABILITY OF AGREEMENT 384 No assignment of this Contract or any right occurring under this Contract shall be made in whole 385 or in part by the Contractor or without the express written consent of the City. In the event of any 386 assignment, the assignee shall assume the full liability of the Contract. 387 388 Section 15 - COMPLIANCE WITH LAW 389 The Contractor shall conduct operations under this Contract in compliance with all applicable Specifications for Solid Waste Disposal Landfill Facility and Residential Solid Waste Collection Page 9 . . 19`3 390 laws; provided, however, that the general specifications shall govern the obligations of the 391 Contractor where there exists conflicting ordinances of the City on the subject. 392 393 Section 16 - EFFECTIVE DATE 394 A Contract for landfill services shall be effective upon the execution of the contract and 395 performance of such contract shall begin on April 1, 2011. The Contractor's representatives shall meet with City staff periodically in order to review 524 contract performance. Zones 1 and 3 will be collected on Monday and Thursday. Zone 2 will be collected on 922 Tuesday and Friday (see map on reverse side). 923 924 2. Items for collection must be placed together at curbside no earlier than dusk the day prior to 925 scheduled collection and no later than 7:30 A.M. the day of collection. All items used for 926 storage or containment of bags, bundles and containers must be removed following collection 927 by the city no later than 11:00 P.M. the day of collection. Storage containers shall be made of 928 a solid and durable grade of inetal or plastic with a capacity of not less than ten (10) gallons 929 and a capacity of not more than sixty (60) gallons. No permanent structures sha11 be 930 constructed or placed at or near the curbside. 931 932 3. Properly secured disposable bags will be removed from rigid or semi rigid containers. The 933 weight limit for disposable bags or brush bundles should not exceed fifty (50) pounds. All 934 containers will be left at the point of collection. For health and safety reasons, garbage that is 935 loose in containers other than leaves will not be collected. Leaves that are placed loosely in 936 containers should have a securely fastened lid to prevent leaves from blowing out of 937 containers. 938 939 4. No more than a total of six (6) disposable bags or brush bundles will be collected on any 940 regular collection day. On Thursday and Friday one bulk item will be picked up in addition to 941 the six (6) bags or bundles. This item can be up to two (2) cubic yards in size (for example a 942 refrigerator). Six (6) additional bags may be set out in lieu of placing a bulk item at the 943 curbside. 944 945 5. Tires: Tires will be picked up for a charge of $5.00 (five dollars) each with a four (4) tire limit 966 per month. Only tires from a passenger car or light duty truck (one-ton or less) will be picked 967 up for this fee. These tires shall be the standard manufactures recommended size for the 968 vehicle they were removed from. 969 970 8. Brush cut in three (3) foot lengths and tied in small bundles (no more than the [3] cubic feet) 971 will be picked up on regular collection days. 972 973 9. Lartze brush/limb nickun; fees. For large accumulation of brush or loose limbs the resident 974 shall be charged a separate fee of ten-dollars ($10.00) for each three hundred fifty (350) cubic 975 feet or portion thereof, of accumulated brush/limbs. PLEASE NOTE: 350 cubic feet is 976 equivalent to 7'x7'x7'. The additional charge will be assessed on the monthly water bill in 977 accordance with Section 16-28 (b) of the Code. Only brush accumulated from the individual 978 residential lot will be eligible for the large brush pickup service; brush from contractors, land 979 clearing, or brush moved to residence from another location will not be accepted. 980 981 10. In lieu of brush pickup, residents may personally deliver their residential brush to the City of 982 Paris compost site on Field Road with no additional fee. A maximum of two (2) loads 983 containing no more than 350 cubic feet per load may be taken to the compost site per month. 984 At the time of drop off, a current water bill and a driver's license will be required. Compost 985 site hours of operation are Wednesday 9:00 am to 11:30 am and 1:30 pm to 4:30 pm and 986 Thursday/Friday from 8:30 am to 11:30 am and 1:30 pm to 4:30 pm. It is also open on 987 Saturday's from 10:00 am to 2:00 pm. 988 989 11. Brush: Limb size shall not exceed eighteen (18) inches in diameter and cut no longer than six 990 (6) foot to eight (8) foot in length. Brush pick-up will be accomplished by picking limbs up 991 curbside with the boom truck and hauling away. Limbs/brush placed for pick-up shall not 992 block drainage ditches nor sidewalks and shall not be placed in the street. New brush lists are 993 distributed and started on Wednesday of each week. New lists are not worked until previous 994 lists are completed which may require more than one (1) week. For brush pick-up, call Public 995 Works office at 903-784-9266. Residents who place piles of brush at curbside for pickup, but 996 fail to contact the Public Works office to schedule the pickup shall be charged two times (2X) 997 the normal rate. Curbside: Refers to that portion of the public right-of-way or private property adjacent to 1001 paved or traveled City roadways (including alleys). I have clarified that this information applies only to the residential collection portion of the RFP. This is in here mainly because having the ability to know how a contractor's employees are being compensated would be helpful to the City in the event the City has to assume collection services at some point in the future. 4. Line 764: Residential Collection Personnel - Change from a minimum of 2 years to 90 days. Remove the next sentence which extends to Line 765 I have left this in because the consensus of the Council was that protecting the employees was a top priority.
