vehicle fires, vehicle accidents, hazardous material spills or releases, and low-water crossing rescues and
attempted rescues.

BACKGROUND:
The Paris Fire Department provides both emergency and non-emergency response within the service
area of the City of Paris and Lamar County. Increased costs associated with providing that service,
coupled with lean economic support, has strained our ability to properly sustain our services and
maintain and/or replace apparatus and equipment. Many fire departments have opted to assess a fee for
services (for those services which meet predetermined criteria) and do so by entering into a contract or
agreement with a third-party billing and revenue recovery agency. Simply stated, the Fire Department
identifies those responses which meet the criteria for billing, forwards the pertinent information to the
billing agency, and the agency then pursues billing of the associated insurance companies. The end
result being a reimbursement check forwarded to the City of Paris for FD services rendered. The
proposed ordinance only authorizes fees to be assessed against non-residents and only for vehicle fires,
vehicle accidents, hazardous material spills or releases, and low-water crossing rescues and attempted
rescues.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
ENACTING A NEW ARTICLE IV, FIRE AND RESCUE SERVICE FEES, TO
CHAPTER 12 OF THE CODE OF ORDINANCES OF THE CITY OF PARIS,
TEXAS; PROVIDING FOR THE COLLECTION OF FEES AND COSTS FOR
SERVICES RENDERED AT VEHICLE FIRES, VEHICLE ACCIDENTS,
HAZARDOUS WASTE SPILLS AND RESCUE INCIDEIVTS; MAKING OTHER
FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A
REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A
PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Paris Fire Department (the "Department") provides both
emergency and non-emergency response within the service area of the City of Paris, Texas;
and,
WHEREAS, the City of Paris Fire Department is equipped with and utilizes certain
apparatus, emergency tools, equipment, and materials as a means of saving lives and
property; and,
WHEREAS, the persons or entities requiring emergency services from the Department,
and for whom the referenced apparatus, tools, equipment, and materials have been utilized,
should reimburse the Department a portion of the costs associated with the use, loss, damage
and wear and tear to said tools, equipment, and materials incurred in connection with the act
of rendering emergency services to said persons or entities; and,
WHEREAS, the City Council has determined that it is in the best interest of the City of
Paris citizens to recoup the costs incurred by the Fire Department when providing emergency
and fire rescue services to persons involved in vehicle fires, accidents, hazardous waste spills,
etc. in the City of Paris, Texas;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUIVCIL OF THE CITY OF
PARIS, TEXAS, THAT:
Section 1. The findings set out in the preamble to this ordinance are hereby in all
things approved.
Section Z. A new Article IV Fire and Rescue Service Fees to Chapter 12 of the Code
of Ordinances of the City of Paris, Texas is hereby enacted to read in its entirety as follows:

"ARTICLE IV.
FIRE AND RESCUE SERVICE FEES
Sec. 12-55. Service and Fees.
The City of Paris shall assess and collect fees for certain services rendered by
the Fire Department. The fees for use of equipment and supplies set out in this
Article shall be assessed and collected when such equipment and/or supplies are
used in connection with the following events or incidents:
1. Vehicle fires,
2. Vehicle accidents,
3. Hazardous material spills or releases, and
4. Rescues or rescue attempts at low water crossings.
Sec. 12-56. Fee Collection.
(a) The owner or occupant of the motor vehicle to which the Paris Fire
Department provides fire and/or rescue services (the "responsible party") shall pay
the cost of such service; provided, however, no resident of the City of Paris shall be
charged or billed for these services.
(b) The Fire Department or its authorized billing company shall send an
invoice to the responsible party for the cost of the services provided. Fees assessed
for fire and rescue services as provided in this Article are due and payable by the
responsible party within twenty (20) days of receipt of an invoice from the Fire
Department or its authorized billing and collection company.
(c) The Fire Chief or designee shall keep records of the costs incurred in
performing fire and rescue services and shall coordinate with other departments of
the City as necessary to collect the fees authorized by this Article.
Sec. 12-58. Schedule of Fees.
The following fees shall be assessed and collected for the use of apparatus,
tools, equipment and materials in the provision of fire and rescue services:

Section 3. All provisions of the ordinances of the City of Paris, Texas in conflict
with the provisions of this ordinance are hereby repealed, and all other provisions of the
ordinances of the City of Paris not in conflict with the provisions of this ordinance shall
remain in full force and effect.
Section 4. The repeal of any ordinance or part of ordinances affected by the
enactment of this ordinance shall not be construed as abandoning any action now pending
under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering
any penalty accruing or to accrue, or as affecting any rights of the municipality under any
section or provisions of any ordinance at the time of passage of this ordinance.
Section 5. It is the intention of the City Council of the City of Paris that this
ordinance, and every provision hereof, shall be considered severable, and the invalidity or
partial invalidity of any section, clause, or provisions of this ordinance shall not affect the
validity of any other portion of this ordinance.
Section 7. Any person violating any provision of this ordinance shall be guilty of
a Misdemeanor, and upon conviction, shall be subject to a fine in accordance with
provisions of Sec. 1-6 of Chapter One of the City of Paris Code of Ordinances, and each and
every day's continuance of any violation of the above-enumerated sections shall constitute
and be deemed a separate offense.
Section 8. Introduced and read on first reading on October 25, 2010, at a regular
meeting of the City Council of the City of Paris and read and passed on second reading on
November 8, 2010, at a regular meeting of the City Council of the City of Paris; the same
being two (2) separate regular meetings of the City Council of the City of Paris.
Section 9. That this ordinance shall become effective from and after its passage
of the first reading and publication as required by law.
