Notice is hereby given that the City Council of the City of Paris shall meet in regular session
at 5:30 p.m. on Monday, November 8, 2010. The meeting will be held at the City Council
Chamber, 107 E. Kaufman Street, in Paris, Texas. The matters to be discussed and acted
upon are as follows:
Opening Agenda
l. Call meeting to order.
2. Invocation.
3. Pledge of Allegiance.
4. Citizens' forum.
(Persons desiring to address the Council must limit their presentation to no more than two
minutes. The Texas Open Meetings Act prohibits the Council from responding to any
comments other than to refer the matter to a future agenda, to an existing policy, or to a staff
person with specific factual information. Claims against the City, Council Members, or
employees, as well as individual personnel appeals are not appropriate for citizens' forum.)
Consent Agenda
Items on the Consent Agenda are approved by a single action of the Council, with such approval applicable
to all items appearing on the Consent Agenda. A Council Member may request any item to be removed
from the Consent Agenda and considered as a separate item.
5. Deliberate and act on the approval of minutes from the meeting on October 25,
2010.
6. Receive and deliberate on reports and/or minutes from the following boards,
commissions, and committees:
a. Paris Public Library Advisory Board minutes (9-15-10
b. Traffic Commission minutes (10-20-10)
Regular Agenda
7. Public hearing, deliberate, and act on an Ordinance of the City of Paris, Texas,
regulating procedures and policies pertaining to the operations of Wrecker,
towing, and Storage Facilities in the City of Paris.
8. Second reading and deliberate on an Ordinance granting to Steve B. Raney and
Wendy L. Raney, d/b/a Yellow Cab Company, an extension of an existing
franchise to use the public streets, alleys, and highways of the City of Paris for the
purpose of transporting passengers for hire in motor vehicles. (requires three readings)
9. Second reading and deliberate on an Ordinance granting to Steve B. Raney and
Wendy L. Raney, d/b/a City Cab Company, an extension of an existing franchise
to use the public streets, alleys, and highways of the City of Paris for the purpose
of transporting passengers for hire in motor vehicles. (requires three readings)
10. Second reading and deliberate on an Ordinance granting to David Thompson,
d/b/a Lone Star Cab Company, an extension of an existing franchise to use the
public streets, alleys, and highways of the City of Paris for the purpose of
transporting passengers for hire in motor vehicles. (requires three readings)
11. Second reading, deliberate and possibly act on an Ordinance establishing a
mitigation services recovery fee plan for the City of Paris for the reimbursement
of costs associated with the use, loss, damage, equipment, and materials incurred
in connection with the act of rendering emergency services to non-citizens of the
City of Paris.
12. Deliberate and possibly act on a Resolution authorizing an agreement with
Revenue Rescue, Inc. for the collection of fees and costs for services rendered at
vehicle fires, vehicle accidents, hazardous waste spills, and rescue incidents; and
authorizing the Mayor to negotiate and execute all necessary documents.
13. Deliberate and possibly act on a Resolution authorizing an agreement with the
Chamber of Commerce of Lamar County, Inc. to maintain the Visitors &
Convention Council for the purpose of managing the municipal hotel occupancy
tax fund; and authorizing the Mayor to negotiate and execute all necessary
dOCUments. (A motion to remove this item from the table is required before deliberating)
14. Deliberate and possibly act on a Resolution authorizing the Mayor to execute a
Lease Agreement between the City of Paris and Paris Radio Control Association
to lease 3.673 acres of land near Lake Gibbons for the purpose of model
aeronautics activities; and authorizing the Mayor to negotiate and execute all
necessary documents.
15. Deliberate and possibly act on a Resolution authorizing the purchase of a 0.9585
acre tract of land from Union Pacific Railroad for the West extension of the Trail
De Paris from 12th Street SE to 8th Street SE; and authorizing the Mayor to
negotiate and execute all necessary documents.
16. Deliberate and possibly act on authorizing funding for the Bywaters Park
Peristyle restoration project.
17. Deliberate and possibly act on establishing a sanitation RFP review committee
and/or selecting a provider for landfill services and a provider for residential
collection services.
18. Deliberate and possibly act on meeting dates for November and December.
19. Convene into Executive Session:
(a) Pursuant to Section 551.071 of the Texas Government Code, Consultation
with Attorney, to receive legal advice from the City Attorney about pending
or contemplated litigation and/or on matters in which the duty of an attorney
to his client under the Texas Disciplinary Rules of Professional Conduct of the
State Bar of Texas, clearly conflict with this chapter, to-wit:
• Ranger Abbott vs. City of Paris, Texas, et al; Cause No. 79627; in the
62°d Judicial District Court of Lamar County, Texas; and
• Ranger Abbott vs. City of Paris, Texas; Cause No. 79683; in the 62nd
Judicial District Court of Lamar County, Texas.
(b) Pursuant to Section 551.074 of the Texas Government Code to deliberate
the appointment, employment, evaluation, reassignment, duties, discipline, or
dismissal of a public officer or employee as follows: Evaluation and
discussion of the retention, suspension, or termination of the City Manager.
20. Reconvene into open session and possibly discuss and/or act on matters discussed
in executive session.
21. Deliberate and act on a request for the resignation of the City Manager.
22. Deliberate and act on a Resolution requesting the resignation of the City Manager,
or in the alternative, suspending and proposing the removal of Kevin Carruth
from his position as City Manager and designating a qualified person to serve in
the capacity of Interim City Manager.
23. Consider and approve future events for City Council and/or City Staff pursuant to
Resolution No. 2004-081.
24. Adj ournment.
