RECOMMENDED MOTION:
Move to approve a resolution authorizing final payment and closing the contract with Spann Concrete
Construction, LLC for the Smith Creek Bridge Replacement and authorizing the City Manager to
negotiate and execute all necessary documents.

BACKGROUND:
The City of Paris received four bids for the Smith Creek Bridge replacement project on CR 32900 with
Spann Concrete the low bidder. The project replaced the bridge that was damaged a few years ago and
was totally removed last year. The new bridge is 60-foot long with steel beams and a concrete deck. It
was designed to carry tractor trailers (HS-20 loading) so supplies and equipment can be delivered to the
water treatment plant in the event the main entrance, Lake Crook Road, is impassable.
This project had no change orders. Staff recommends closing the contract and making the final payment
to Spann Concrete Construction, LLC in the amount of $15,035.47.

RESOLUTION N0.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
APPROVING FINAL PAYMENT AND CLOSING THE CONTRACT FOR THE
SMITH CREEK BRIDGE REPLACEMENT PROJECT, TO SPANN CONCRETE
CONSTRUCTION, LLC; MAKING OTHER FINDINGS AND PROVISIONS
RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, on June 14, 2010, the City Council of the City of Paris passed Resolution
No. 2010-068, awarding the contract for the construction of the Smith Creek Bridge
Replacement Project to Spann Concrete Construction, LLC, of Paris, Texas; and,
WHEREAS, the bridge is complete and has been inspected and approved and the
City Engineer recommends that the contract now be closed upon receipt of an executed
Affidavit of Final Payment and Release of All Claims; and,
WHEREAS, the final payment to Spann Concrete Construction, LLC in the amount of
$15,035.47 should, in all things, be approved and the City manager should be authorized to
execute any necessary documents.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
Section 1. That the findings set out in the preamble of this resolution are hereby
in all things approved.
Section 2. That final payment to Spann Concrete Construction, LLC in the
amount of $15,035.47 be approved and the closing of the Contract for the construction
project at the Smith Creek Bridge Replacement Project be accepted upon receipt of an
executed Final Payment and Release of All Claims Affidavit by Spann Concrete
Construction, LLC.
Section 3. That the City Manager be, and he is hereby, authorized and directed to
execute, on behalf of the City of Paris, any necessary documents.
Section 4. That the Director of Finance be, and he is hereby, authorized and
directed to distribute funds for purposes of final payment and closing of the contract.
Section S. That this resolution shall be effective immediately upon passage.
