RECOMMENDED MOTION:
Approve Ordinance Banning the sale or possession of "K2"
PoLicY IssuE(s):
Health and Safety
BACKGROUND:
We have been watching far any problems associated with "K2" since first discovered being sold in our
community in 2010. We made contact with our health care community to monitor any adverse reactions
or increased health visits and found only 1 patient admitting to K2 use in the first 6 months. Our
narcotics officers also reported not finding very much on the street. At that time, a decision was made to
wait for the anticipated filing of state legislation banning the substance.
Senator Shapiro has filed SB 331 with the 2011 Texas Legislature to add the chemical compounds used
to make the synthetic cannabinoid drugs to the list of controlled substances under the Texas Health and
Safety Code. If this proposed legislation passes, it will make the sale, possession and use of these drugs
a state jail felony.
Approximately 2 weeks ago, I received information from our narcotics officers that they were seeing a
"
"
in
streets
sudden and tremendous increase in the use of synthetic cannabinoids ("K2" drugs) on the
Paris. About that same time, I received an e-mail from a concerned mother who knew of her child and
other kids who were using it. In talking with local health care facilities, they have seen 8-10 adverse
reactions in the last 2-3 months.
Last year, the Drug Enforcement Agency banned S different chemicals which were being used to
manufacture "K2." Since that time, the drug suppliers have changed chemical compounds and are
manufacturing and still selling this substance legally. I'm sure you noticed the extremely long list of
chemicals in the proposed ordinance. This list was taken from SB 331 which is very extensive and
necessary to keep the drug suppliers from changing the chemical compound of "K2" to something that is
not illegal. I think we need to pass this City ordinance now to give local 1aw enforcement some
authority to slow down the sale, possession and use of these unregulated drugs in the Paris community.

DEA did an emergency prohibition on 5 chemicals used in `K2" products. Our local
head shops have removed those products that have these 5 chemicals but others are
still being sold. Shapiro has introduced SB 331 which totally bans all chemicals people
are using in K2. The list is lengthy, but necessary,
These are the chemicals associated with the senate bill banning the sale of K2 which
we will need in our local ordinance:
4) any quantity of a synthetic chemical compound that is a cannabinoid receptor agonist and mimics the
pharmacological effect of naturally occurring cannabinoids, including:

ATTEST:
Janice Ellis, Ciry Clerk
APPROVED AS TO FORM:
W. Kent McIlyar, City Attorney
