RECOMMENDED MOTION:
Deliberate and act on a Resolution approving change order #2 to the contract with Richard Drake
Construction Co., LP in the amount of $4,629.50 for the Trail de Paris extension between SE 8th and 12tn
Streets; authorizing the City Manager to negotiate and execute all necessary documents.
POLICY ISSUE(S):

BACKGROUND:
This change order is needed in order to add additional subgrade preparation and base rock to the project.
The reason the additional work is needed is because the trail location was moved away from the actual
railroad bed. The City of Paris purchased a section of Right-of-Way from Union Pacific railroad in
order to build the Trail de Paris all the way to SE 8t" Street. Union Pacific sold the City 50-feet of the
100-foot ROW width. The portion the City purchased did not have railroad tracks. The tracks extended
from the retained Union Pacific railroad property onto property that we have leased from Greater Paris
Development Foundation. In order to avoid the existing tracks the Trail was moved off the existing
railroad bed sooner than had been planned for.
Staff recommends approving the change order in the amount of $4,629.50, which will make the new
contact amount $122,306.50.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS, APPROVING CHANGE ORDER NO. TWO TO THE
CONTRACT WITH RICHARD DRAKE CONSTRUCTION FOR THE
CONSTRUCTION OF THE TRAIL DE PARIS EXTENSION
PROJECT - S.E. 8th STREET TO S.E. 12th STREET; MAKING
OTHER FINDINGS AND PROVISIONS RELATED TO THE
SUBJECT; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, on August 25, 2008, the City Council of the City of Paris passed
Resolution No.2008-068 awarding a contract in the amount of $111,553.00 to Richard Drake
Construction Company for the construction of the Trail de Paris Extension Project, SE 8th Street to
SE 12th Street, Paris, Texas; and,
WHEREAS, the contract amount adjusted by previous change orders is $117,677.00;
and
WHEREAS, Shawn Napier, City Engineer, recommends that the City Council approve
Change Order No. 2 in the amount of $4,629.50 to pay for additional subgrade preparation and
base rock for the trial extension for a revised contract price of $122,306.50 with no addition days
added to the contract completion date; and
WHEREAS, the form of Change Order No. Two, attached hereto as Exhibit A, should,
in all things, be approved, and the City Manager should be authorized to execute the same;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PARIS, TEXAS:
Section 1. That the findings set out in the preamble of this resolution are hereby in all
things approved.
Section 2. That the form of Change Order No. Two to the contract with Richard Drake
Construction Company for the Trail de Paris Extension Project - S.E. 8th Street to S.E. 12t1i Street,
attached hereto as Exhibit A, providing for a net increase of $4,629.50 and a revised Total Contract
Price of $122,306.50 be, and the same is hereby, approved.
Section 3. That the City Manager be, and he is hereby, authorized and directed to
execute, on behalf of the City of Paris, said Change Order No. Two, upon the terms and
conditions and in the form shown in Exhibit A, attached hereto.
Section 4. That this resolution shall be effective from and after its date of passage.
