2011-039 RES APPROVING AN APPLICATION FOR AN AUTOMOBILE BURGLARYRESOLUTION N0. 2011-039 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS; APPROVING AN APPLICATION FOR AN AUTOMOBILE BURGLARY & THEFT PREVENTION GRANT FOR CONTINUATION OF OUR AUTO THEFT TASK FORCE THE TOTAL OF THE GRANT IS EXPECTED TO BE $139,522.00 WITH A CASH MATCH OF $41,993.00 ALONG WITH AN IN-KIND MATCH OF $2,900.00; AUTHORIZING THE EXECUTION OF ANY AND ALL DOCUMENTS NECESSARY FOR ACCEPTANCE AND IMPLEMENTATION OF SAID GRANT UPON NOTICE THEREOF; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Texas Automobile Theft Prevention Authority provides funding for automobile theft prevention grants; and, WHEREAS, the City Council of the City of Paris desires to apply for an Automobile Burglary & Theft Prevention Grant entitled "Northeast Texas Automobile Theft Task Force" project beginning September 1, 2011 and ending August 31, 2012, in the amount of $139,522.00 with a cash match of $41,933.00 along with an in-kind match of $2,900.00 for continuation of our existing Auto Theft Task Force; and, WHEREAS, the City Council hereby authorizes the City Manager, Police Chief, and other appropriate City staff to make application, accept and implement said grant (if same is received) without further action of City Council; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, THAT: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That an application to the Texas Automobile Burglary & Theft Prevention Authority be made and approved for an Automobile Theft Prevention Grant entitled "Northeast Texas Automobile Theft Task Force" project for the year beginning September 1, 2011 and ending August 31, 2012, in the amount of $139,522.00 with a cash match of $41,933.00 along with an in-kind match of $2,900.00. Section 3. That the City Manager be, and he is hereby, appointed as the Authorized Official of said project and is authorized and directed to execute, on behalf of the City of Paris, an application for said grant. Section 4. That the Police Chief be, and he is hereby, appointed as Project Director and is hereby authorized to execute and deliver, on behalf of the City of Paris, all reports, communications, assurances, and documents necessary for the completion of said project. Section S. That the Director of Finance be, and he is hereby, authorized and directed to serve as the Financial Officer for said project and to receive and distribute funds for purposes of the Automobile Burglary & Theft Prevention Program. Section 6. That the City Manager, Police Chief, and the Finance Director be, and they are hereby, authorized and directed to execute, on behalf of the City of Paris, any and all documents necessary for acceptance and implementation of said grant upon notice of award thereof by the Texas Automobile Theft prevention Authority, under the terms and conditions and in the forms approved by the City Attorney, and to proceed with use of said funds upon receipt thereof for the purposes stated herein and in accordance with the grant conditions. The City of Paris began the Northeast Texas Auto Theft Task Force, with the assistance of ATPA, in September, 1994. The Task Force assists agencies in Lamar, Red River, Fannin, Delta, Franklin, Hopkins, Titus, Grayson, Hunt, Bowie, and Southeast Oklahoma. We cover approxisaately 8,000 square miles with a population of about 500, 000. We strive each year to meet the goal of reducing auto theft in our area. We always make it a goal to educate the law enforcement personnel and public in this part of Texas. We accomplish these goals by salvage yard inspections, vehicle dealer inspections, maintaining checks on repair shops to check for stolen vehicles and parts. Working closely with all agencies is helping to accomplish our goals. We have two officers that use 100% of their time to combat auto theft and auta related crimes. Some of the Tax Assessors in our area have jumped an the wagon to assist in every way possible to help prevent auto theft, title fraud, and all other document fraud. We meet with agencies on a regular basis to collect and distribute intelligence. The Paris Chief of Police and the County Attorney evaluate the program monthly. (40 hours per week) ABTPA-7 (Attachment) ATPA -7 Senior Detective The Senior Detective will be in charge of the day to day operations of the Auto Theft Task Force and shall be subject to the direct supervision of a Sergeant within the Criminal Investigations Division of the Paris Police Department and within the Department's Chain of Command up to the Chief of Police. The Senior Detective will be subject to such orders as the Chief of Police or his designee may prescribe, not inconsistent with the laws on the State of Texas or the mandates of the Texas Automobile Theft Prevention Authority grant. The Senior Detective shall devote 100$ of his time to official duties, unless granted leave by the Chief of Police or his designee. The Senior Detective's responsibilities shall be: 1) Supervise the Task Force in all of its operations. 2) Keep the proper records and be responsible for the maintenance of all reports to the State of Texas and the Chief of Police. 3) Work with every responsible, legitimate group or agency in a cooperative effort to prevent motor vehicle theft by educating the public and law enforcement officers in the area of motor vehicle crimes. 4) Work diligently and relentlessly in the investigation of, and pursuit of, all crimes involving motor vehicles. 5) Enforce all laws relating to the theft of motor vehicles. 6) Assist in the prosecution of all those charged with the crime of motor vehicle theft or related crimes. ABTPA-19 ABTPA-20 AUTOMOBILE BURGLARY & THEFT PREVENTION AUTHORITY SCHEDULE F NARRATIVE Currently ABTPA does not fund indirect costs, except for the Council of Governments agencies. Applicants may not use option (A) without having an official cost allocation plan developed in accordance with OMB Circular No. A-87. The amount may be entered as ABTPA funds or cash match for those applicants having such an approved plan. ABTPA-21 AUTOMOBILE BURGLARY & THEFT PREVENTION AUTHORITY PROGRAM NARRATIVE (Instructions) 1. To be considered for funding, a proposed grant project: 1. Must address a problem that is clearly identified, is measurable and is supported by relevant statistical evidence; 2. Must minimize duplication or overlapping of existing programs; 3. Must have a design wherein the activities and goals are realistic and attainable; 4. Preferably should, but is not required to, be innovative in its concepU design/operation; (a project is considered innovative if it provides a new and different strategy or approach that prevents, deters, intervenes, or stops a criminal act from occurring); 5. Must have a cost structure which is realistic when compared to its goals; 6. Must cooperate and coordinate its activities with other appropriate agencies/projects; 7. Must include measures to assure that it demonstrates cross-cultural awareness in all project activities and in its staffing and training; and Must include a proposed evaluation design that provides relevant data to measure the effectiveness of the project and a plan for performing such evaluation. II. Accordingly, the Program Narrative must present the information by which the eligibility and merit of the project can be assessed. Applications will be scored and ranked numerically, for funding consideration, according to the congruence of the project with the criteria stated above. At a minimum, the five sections of the Program Narrative must include the following information: 1. PROBLEM STATEMENT & HISTORICAL INFORMATION: (Please limit information to 2 pgs) ♦ Provide an assessment of the auto theft problem in the areas of coverage and what efforts have been undertaken to address it. a. Describe and document trends of the problem and the need that makes this grant necessary. (e.g., cite 3 years of UCR data) b. Identify the target population and the geographic target area. c. Describe existing activities that address the problem. d. Describe the extent to which this project will duplicate or overlap existing activities, and why that (if any) is necessary. e. PROPOSED GOALS & OBJECTIVES: ♦ The applicant must provide specific goals and objectives for the project that are consistent with the proposal. Describe the mechanism to evaluate the program's progress. ABTPA-23 AUTOMOBILE BURGLARY $ THEFT PREVENTION AUTHORITY PROGRAM NARRATIVE 1. Problem Statement and Historical Information (See instructions on page 17) The Northeast Texas Auto Theft Task Force was first funded by the Texas Automobile Burglary Theft Prevention Authority in 1994. The Texas Department of Public Safety Motor Vehicle Theft Service had the only full-time motor vehicle theft investigators in the northeast Texas area. The Texas Department of Public safety had two sergeants assigned to our area at that time. Today they have three. According to the 2010 U.S. Census, the population in our coverage area is approximately 500,000. The Northeast Texas Auto Theft Task Force consists of two officers, a Senior Detective and an Investigator. One hundred percent of the officers' time is used to investigate motor vehicle crimes. In 2009 to 2010 we saw an approximate 12°, increase in motor vehicle theft for our coverage area. The Northeast Texas ATTF works closely with all agencies in the coverage area. We assist all agencies that request our help. This is figure is based on the increase in motor vehicle theft for the 2009 to 2010 reporting period. We have identified several small groups in our area that are committing the BMV's. In January 2011 we arrested a ring of (4) individuals that had committed (12) twelve burglaries of auto in one night. All individuals have been arrested and sentenced to jail time. December and January, 2009-10 were the biggest months for BMV's in Paris. Trailer and tractor theft have become a problem in our coverage area. It is my belief that a large percentage of vehicle thefts and burglary of motor vehicles in our coverage area is connected to our drug users. Coverage area: Bowie, Camp, Delta, Fannin, Franklin, Grayson, Hopkins, Hunt, Lamar, Morris, Red River, and Titus Counties. ABTPA-24 We will strive to meet our goal next year and determine the problem areas. There is a training class scheduled in Texarkana and Paris in April. There are plans to have another training class in our coverage area. Historical Information The Northeast Texas Auto Theft Task Force consists of two officers from the Paris Police Department. A Senior Detective, and a Detective, that spend 1000 of their time investigating auto crimes in the twelve county coverage areas. Goals and Objectives (See instructions on page 18) The total vehicle theft in the twelve county coverage area in 2009 was 863. This is a 19% increase from the 701 in 2008. We will strive to accomplish the goal of a 3% decrease in the next grant year. In the past year we have seen several vehicles stolen with the keys left inside the vehicle. We plan to increase the public awareness for "Watch Your Car" to hopefully combat this trend. In January 2010 we arrested (4) four offenders that had committed multiple burglaries of vehicles and their arrest and conviction led to an immediate reduction of burglary of vehicles in the Paris area. In 2008 there was approximately 1395 BMV's in our area. We are working with the patrol officers to process the vehicles for what evidence we can obtain. The pawn tickets are checked to develop leads also and LEADS ON LINE has become a valuable tool in the recovery of property stolen from Burglary Motor Vehicles. We have aired a PSA on the local Paris TV station and have had some success in getting the local newspapers to print several articles in an effort to increase the public awareness of various preventative measures. Due to our current manpower shortage, we are performing more reactive than proactive operations. Due to the complete turnover of all Task Force Personnel and the loss of those Officers experience we expect to see a decrease in our productivity until the new personnel are trained and their experience level increases. These are the tools we use to complete investigations to the end: • Obtain and develop information on vehicles crimes (thefts, UUV, BMV, etc.)and identification of offenders • Interview and interrogate offenders and witnesses • Locate and recover stolen vehicles, parts, etc.(LEADS ON LINE) • Identify altered vehicles (salvage yard inspections & 68A inspections) ABTPA-28 • Investigate insurance fraud • Arrest offenders and use the required follow-up for prosecution • Set and appear at hearings to restore the stolen property • Communicate with pawn details to develop possible leads or suspects (LEADS ON LINE and Paris Police database of pawn tickets) • Educate the officers and public in ways to prevent vehicle thefts and BMV's • Inspect salvage dealers, repair shops, and vehicle dealers • Assist Tax-Assessors in identifying fraudulent documents • Assist Tax-Assessors in training personnel on proper documentation The Northeast Texas ATTF will continue to do H.E.A.T. programs with VIN etchings when requested. We make public presentations to civic groups and have booths at local fairs and car shows. We have been asked to instruct police academy students during their basic training and plan to assist in (2) two classes in 2011. We are also instructing a block of instruction in the Citizens Police Academies that are currently being held in Paris. We work with all agencies in our coverage area to combat auto theft and other related crimes. Continuing goals of the Northeast Texas ATTF for next year are: • Strive to continue the reduction of auto theft in our coverage area • Continue our efforts at crime prevention • Strive to reduce the Burglary Motor Vehicles rate 3% in our coverage area • Work diligently to present two Auto Theft Training classes • Continue the monthly meetings with agencies and prosecutors to determine the types and locations of investigations Our officers are trained in cultural diversity, public awareness, and legal updates of all Federal, State, and case laws on a regular basis. ABTPA-29 Proposed Project Activities We cover approximately 8,000 square miles with a population of about 500,000. There are over 750,000 vehicles registered in our area with an estimated five (5) percent average increase over our coverage area. We assist with cases in forty (40) different agencies. The agencies in our area are smaller agencies with no full-time auto theft investigators. We have had the same number of officers since the inception in September, 1994. Due to the transitional state of our Task Force at this time, the current budget crisis, and unknown future determining our direction at this time is difficult. We have had maintained the same number of Task Force officers since the inception of the Northeast Texas Auto Theft Task Force in September, 1994. Due to the transitional state of our Task Force at this time, the current budget crisis, and the unknown future, determining the direction for our Task Force at this time is challenging. We would propose that with the demise of the Texas Motor Vehicle Crimes Services, additional personnel are needed to provide adequate coverage for our large geographical area. However, with the unknown budget situation at the State level, we understand that a request for additional personnel at this time would not be feasible. With the resignation of one member of the Task Force this past year and the retirement of the other member, we are currently working to get the new personnel trained and up to speed with the program and responsibilities. During remainder of this and the upcoming budget cycle, we plan to -t-e increase the public awareness in our coverage area and plan to use the internet more to obtain this goal. A more structured or formal partnership or working agreement with the Lamar County Crime Stoppers will be sought this year. ABTPA-30 AUTOMOBILE BURGLARY & THEFT PREVENTION AUTHORITY PROGRAM NARRATIVE 3. Functions of the Proposed Project (See Instructions on page 18) The Northeast Texas Auto Theft Task Force has a coverage area of 8,000 square miles which covers most of northeast Texas. Our officers handle all auto thefts, burglary motor vehicle, and related crimes, whether covert or overt. The Task Force performs inspections on salvage yards, dealers, repair shops, and scrap metal yards. A new problem that has popped up for everyone is vehicles being stolen and sold to scrap yards not salvage yards. It has been a chore regulating these businesses and training them about what has to be documented. This has helped to prevent some thefts of older vehicles and other related crimes as, parts thefts. The Task Force sergeant uses records to document the types of cases, property involved, disposition of the cases, recoveries of vehicles and other property and the values, and types and number of arrests is made. The records are then used to complete quarterly reports. The Senior Detective meets weekly with the Paris Police Chief and the Lamar County Sheriff, at least monthly with Sheriffs and Chiefs of Delta, Fannin, Franklin, Red River, and Hopkins Counties. He meets when necessary with the Prosecutors. We always strive to reach the primary goal of reducing auto theft, Burglary Motor Vehicles, and other related crimes. ABTPA-31 ABTPA-32 AUTOMOBILE BURGLARY $ THEFT PREVENTION AUTHORITY PROGRAM NARRATIVE 4. Proposed Evaluation Design (See Instructions on page 18) The Northeast Texas Auto Theft Task Force Senior Detective will meet monthly with the Chief of Police, Sheriffs, And Prosecutors in the coverage area in an effort to provide ongoing evaluation of the program.
