POLICY ISSUE(S): Plat Approval BACKGROUND: This is the preliminary and final plat for Lot 1, Block A, Burress Addition, being located at 1215 Bonham Street. Mr. Joe Burress would like to construct a laundromat. The owner has submitted a variance request from the requirement to dedicate Right-of-Way (ROW) on the three street frontages. The Major Thoroughfare Plan identifies Bonham Street as an Arterial level roadway which would require 80-feet of ROW. 12t" and 13`h Streets SW are identified as standard city streets that would require 50-feet of ROW. A five-foot ROW dedication would be required along 12`n Street SW, a 12.5-foot ROW dedication would be required along Bonham Street and a 10-foot ROW dedication would be required along 13th Street SW. The owner is proposing to dedicate 2.5-feet of ROW along Bonham Street to bring his half of the roadway to a Collector level (60-feet of ROW). Staff recommends approval of the variance request, preliminary plat and final plat. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission recommended approval of the preliminary and final plat, subject to City Engineer's recommendation by a vote of 4-0. It appears that the preliminary plat complies with the City of Paris subdivision regulations with the following exceptions: 1. Provide a pavement width for 131h Street SW. 2. The Major Thoroughfare Plan for the City of Paris calls for Bonharn Street to be an Arterial level roadway which requires at least 80-feet of Right-of-Way (ROW). The existing ROW width in front of the subject property is 55.5 feet. The owner is proposing to dedicate 2.5 feet of ROW to bring his half of the ROW to 30-feet which is half of a Collector level roadway. An additional 10-foot dedication is required. 3. 12t'' Street SW has 40-feet of ROW. It is required to have 50-feet. A five-foot ROW dedication is required. 4. 13`h Street SW has 30-feet of ROW. I BOUNDARY • TOPOGRAPHY • CONSTRUCTION May 20, 2011 Re: Request for variance regarding the dedication of rights- of-way along streets adjoining the proposed Burress 128 addition. The City of Paris, Joe Burress, the developer, hereby requests a variance from the requirement for the dedication of rights-of-way along the south side of Bonham Street, the west side of 12th Street SW, and the east side of 13th Street SW, all adjacent to the proposed Burress 128 addition to the City of Paris. The primary reason for this is that the current dimensions of the property severely limit what can be built on it, and making it smaller by the requested amounts may eliminate the economic viability of the property altogether. In addition, there aze physical obstacles to widening the roads adjacent to the property. Regxrding the right-of-way of Bonham Street, a 12.5-foot dedication along the north side of the property is requested to bring the width of the south half of the Bonham Street right-of-way to 40 feet, in compliance with the requirements of its classification as an arterial street. However, eacisting buildings east, west, and north of the proposed addition do not allow for the possibility of an 80-foot right-of- way in this azea. West of the property, the porch an the house located at 1225 Bonham Street is 46.3 feet from the existing pavement center line; east of the property, the north side of the Dadant & Sons brick building located at 1169 Bonham Street is 54.8 feet south of the existing north right-of-way line of Bonham Street; and north of the property, the buildings located at 1200, 1204, and 1220 Bonham Street lie between 28 feet and 30 feet north of the existing center line of Bonham Street, all of which constitute physical barriers to increasing the width of Bonham Street. A 2.5-foot dedication aioag the south side of Bonham Street is proposed on the plat to bring its width into compliance with the requirements for a collector-level street. Regarding the right-of-way of 12"' Street SW, a 5-foot dedication is requested. Adjacent to the east side of City Btock 128, the pavement on 12`h SW is currently 30.8 feet wide with concrete curb and gutter, and there are no houses currently fronting 12'h SW from Bonham Street south to its terminus at Sherman Street. Therefore, the existing pavement width should easily accommodate the traffic on this street for decades to come. Regarding the right-of-way of 13"' Street SW, a 10-foot dedication is requested. This street is one block long, lying between Bonham Street and Kaufman Street, and there are no houses or businesses fronting it. South of the property, the house located at 1214 Kaufman Street is only 14.5 feet east of the eacisting center line of the pavement, coustituting a physical impediment to the widening of the street. To accommodated futare needs of pub6c and private utilities in the area, a 5-foot atility easement is proposed abng the east, north, and west sides of the addition. In conclusion, Mr. Burress asserts that reducing the size of this small lot any further will prevent its development, and that the locations of existing structures north, south, east, and west of the property prevent the expansion of the streets adjacent to the proposed addition; therefore, he requests relief from the requirements to dedicate 12.5 feet of right-of-way along Bonham Street, and a total of 15 feet of right-of-way along 12'h Street SW and 13t° Street SW.
