POLICY ISSUE(S): Stop Sign - Intersection of 3rd NW & Provine BACKGROUND: A request was made to the traffic commission regarding the intersection of 3`d NW & Provine. The traffic in this intersection is currently not controlled by a traffic device. A complaint was received that traffic not being regulated at this intersection created a traffic hazard. A review of Police records revealed three non-injury accidents at this intersection within the last five years. The stop sign request was presented to the traffic commission on April 5, 2011 which recommended a stop sign be placed at the intersection for east and westbound traffic. AN ORDINANCE OF THE CITY COUIVCIL OF THE CITY OF PARIS, TEXAS, AMENDING THE TRAFFIC CONTROL MAP ADOPTED IN SECTION 31-65, OF THE CODE OF ORDINANCES OF THE CITY OF PARIS, TEXAS; ESTABLISHING A STOP SIGN ON PROVINE STREET AT 3RD STREET NW STOPPING EAST-BOUND AND WEST-BOUND TRAFFIC; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLUASE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Paris Traffic Commission is charged with reviewing and evaluating proposals to add or remove traffic control devices on City streets and roadways throughout the City of Paris; and, WHEREAS, among those traffic control devices evaluated by the Traffic Commission is the placement of stop signs at various intersections throughout the City; and, WHEREAS, the Traffic Commission, at its regular meeting of April 5, 2011, considered and evaluated a request for the placement of a stop sign at the intersection of 3rd NW and Provine Street, to stop the East-bound and West-bound traffic on Provine Street and, having done so, found and determined that the placement of stop signs at this location in the City of Paris is necessary to protect the health and safety and is in the best interests of the citizens of the City of Paris. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That the Traffic Control Map of the City of Paris, Texas, Section 31-65, Chapter 31, of the Code of Ordinances of the City of Paris, Texas, as amended, be, and the same is hereby further amended to include the following stop signs: "Stop Sign - on Provine Street at 3rd NW Street stopping East-bound and West-bound traffic." Section 3. That all provisions of the ordinances of the City of Paris, Texas in conflict with the provision of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. - 112 Section 4. That the repeal of any ordinance or part of ordinances affected by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance. Section S. That it is the intention of the City Council of the City of Paris that this ordinance and every provision hereof, shall be considered severable, and the invalidity or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section 6. That any person violating any provision of this ordinance shall be guilty of a Misdemeanor, and upon conviction, shall be subject to a fine in accordance with provisions of Sec. 1-6 of Chapter One of the Ciry of Paris Code of Ordinances, and each and every day's continuance of any violation of the above-enumerated sections shall constitute and be deemed a separate offense. Section 7. That by a supermajority vote of _ ayes and _ nays, the City Council voted to suspend the rule requiring two readings before adoption of this ordinance. Section B. That this ordinance shall become effective from and after its passage of the first reading and publication as required by law. PASSED AND ADOPTED this 27th day of June, 2011. Kent McIlyar, City Attorney 113 Minutes Traffic Commission City of Paris The Traffic Commission met on Tuesday, April 5, 2011, at 5:15 P.M. in the Municipal Courtroom with the following members present: 1. Ken Kohls 2. Barry Shiver 3. Matt Frierson 4. Stephen Holmes The city staff was represented by Asst. Chief Randy Tuttle. Chief Bob Hundley was also present. The meeting was called to order at 5:23pm by Chairman Stephen Holmes. A quorum was established by 4 members being present. Mr. Holmes moved to item #2 to approve minutes from March 8, 2011 meeting. Mr. Shiver made a motion to approve minutes and Mr. Kohls second the motion. Motion carried 4-0. Mr. Holmes moved to item #3 regarding discussion and possible action on installing a four-way stop sign at 20t" NE & E. Price. Mr. Tuttle informed members that a citizen had requested the Traffic Commission consider placing a four-way stop at this location due to heavy traffic. After discussion of the issue Mr. Kohls made a motion to deny the request. The motion was seconded by Mr. Frierson and motion carried 4-0. Mr. Holmes moved to item #4 regarding the presentation of information to the Traffic Commission regarding the request for TXDOT to install a protected- permissive left turn signal at Clarksville & Collegiate Drive. Mr. Tuttle informed members that TXDOT was in the process of installing a protected-permissive left turn signal at Clarksville and Collegiate for east and west bound traffic on Clarksville St. and should be completed soon. Mr. Holmes moved to item #5 regarding the discussion and possible action regarding the installation of stop sign at 3rd NW & W. Provine. This item had been tabled at March 8, 2011 meeting. Mr. Shiver made a motion to remove the item from table. Mr. Frierson second the motion and it carried 4-0. Mr. Tuttle informed members that citizens had complained about traffic at the intersection not stopping which created a traffic hazard almost causing traffic accidents. Mr. Tuttle informed members that there had been three accidents at the intersection 114 within the last five years, all non-injury. After discussion Mr. Frierson made a motion to recommend a stop sign be installed at the intersection of 3rd NW & Provine to stop east and west bound traffic. Mr. Shiver second the motion and it carried 4-0. Mr. Holmes moved to item #6 regarding the discussion and possible action concerning the installation of traffic calming device in 1800 block E. Polk. Mr. Tuttle informed members that a resident in the area had made a complaint about vehicles speeding and requested speed bumps be placed in the street. Mr. Tuttle advised members that alert strips had been placed at that location several years ago due to a disabled individual residing in the block. After discussion it was decided by members that no action be taken. Mr. Holmes moved to item #7 regarding future agenda items. There were no future agenda items. Mr. Shiver did have a request that TXDOT be contacted to review the traffic signal at 20th NE & Lamar. Mr. Shiver said he had received complaints about traffic backing up to 17t" & Lamar due to a possible timing issue with the traffic light at 20t" & Lamar. Mr. Tuttle stated he would report this to TXDOT. Mr. Kohls had concern with thru truck traffic in violation of city ordinance. Mr. Kohls was informed that Paris PD Officers had been made aware of this issue. Mr. Tuttle informed members that this was Mr. Frierson's last meeting as his term on the Traffic Commission expires April 30, 2011.
