RECOMMENDED MOTION:
Deliberate and possibly act on a Resolution approving change order #1, authorizing final payment and
closing the contract with Richard Drake Construction Co. for the Stillhouse Road Widening Project; and
authorizing the City Manager to negotiate and execute all necessary documents.

BACKGROUND:
On December 13, 2010, the City of Paris approved a contract with Richard Drake Construction for the
widening of Stillhouse Road. The original contract amount was $172,111.11.
The change order involves two items. The first part ($1,800.00) is for the removal of two sections of
asphalt paving that extended from the two driveway entrances into Cecil Everett Elementary School.
The decision was made to remove these two areas and repave them because both had sections where the
pavement section had failed. The second part of the change order involves a driveway that Dr. Swint
requested for property within the project limits. The driveway cost that is included in the change order
is the difference in price between actual cost ($2,313.60) for the driveway less the price of the curb and
gutter ($900) that would have been constructed. Dr. Swint paid the additional cost ($1,414.60) for the
driveway. The change order amount is $3,214.60, which brings the total project construction cost to
$175,325.71
The total project cost including construction and engineering is $201,109.25.

RESOLUTION N0.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
APPROVING CHANGE ORDER N0. ONE TO THE CONTRACT FOR THE
STILLHOUSE ROAD WIDENING PROJECT FROM LEVI LANE TO LEWIS
LANE; AUTHORIZING FINAL PAYMENT; MAKING OTHER FINDINGS AND
PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN
EFFECTIVE DATE.
WHEREAS, on December 13, 2010, the City Council of the City of Paris passed
Resolution No. 2010-119, awarding the contract for Stillhouse Road Widening Project from
Levi Lane to Lewis Lane, to Richard Drake Construction Company of Paris, Texas; and,
WHEREAS, the City Engineer, Shawn Napier, acting as project engineer,
recommends the amendment of the contract for said Project based on the additional work
performed and actual materials used, providing for a net increase of $3214.60 in the
contract price, for a revised contract price of $175,325.71 and authorized final payment of
the Contract in full; and,
WHEREAS, Change Order No. One attached hereto as Exhibit "A," should in all
things, be approved, and the City Manager should be authorized to execute the necessary
documents; and,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
Section 1. That the findings set out in the preamble of this resolution are hereby
in all things approved.
Section 2. That Change Order No. One to the Contract for the Stillhouse Road
Widening Project Phase I, attached hereto as Exhibit "A", and providing for a net increase of
$3214.60 in the contract price, for an amended total contract price of $175,325.71, be, and
the same is hereby approved and final payment made to Richard Drake Construction
Company, L.P.
Section 3. That the City Manager be, and he is hereby, authorized and directed to
execute, on behalf of the City of Paris, any necessary documents, upon the terms and
conditions in Exhibit "A", attached hereto.
Section 4. That this resolution shall be effective immediately upon passage.
