00-AMENDED AGENDAAMENDED CITY COUNCIL AGENDA Notice is hereby given that the City Council of the City of Paris shall meet in regular session at 5:30 p.m. on Monday, September 12, 2011. The meeting will be held at the City Council Chamber, 107 E. Kaufman Street, in Paris, Texas. The matters to be discussed and acted upon are as follows: Opening Agenda 1. Call meeting to order. 2. Invocation. 3. Pledge of Allegiance. 4. Citizens' forum. (Persons desiring to address the Council must limit their presentation to no more than two minutes. The Texas Open Meetings Act prohibits the Council from responding to any comments other than to refer the matter to a future agenda, to an existing policy, or to a staff person with specific factual information. Claims against the City, Council Members, or employees, as well as individual personnel appeals are not appropriate for citizens' forum.) 5. Public Announcements. a. Proclamation declaring Paris Majors All Star Dixie World Series Champions Day. Consent Agenda Items on the Consent Agenda are approved by a single action of the Council, with such approval applicable to all items appearing on the Consent Agenda. A Council Member may request any item to be removed from the Consent Agenda and considered as a separate item. 6. Deliberate and act on the approval of minutes from the meeting on August 19, 2011; August 22, 2011; August 26, 2011; and August 29, 2011. 7. Receive and deliberate on reports and/or minutes from the following boards, commissions, and committees: a. Historic Preservation Commission (6-8-2011 and 8-10-2011) b. Planning and Zoning Commission (8-1-2011) Regular Agenda Public hearing, deliberate and act on a Ordinance Adopting a Redistricting Plan for City Council Districts for the City of Paris and authorizing the Mayor and City Council to execute said Ordinance and the City Clerk to attest to same. Notice is hereby given that the City Council for the City of Paris, Texas will convene in regular session on the 12th day of September 2011 at 5:30 p.m. to receive public comment on redistricting of City Council districts. Following the public hearing, the City Council will take up for consideration and possible action one or more alternative plans for the redistricting of City Council districts. The City Council reserves the right to take any and all appropriate action regarding the redistricting of the City of Paris's political boundaries, including the acceptance of new boundaries for the City Council districts, modification of any boundaries, and/or tabling the pending proposals for later consideration and/or action. The Public is invited to attend and participate in this meeting. Those wishing to address the City Council should sign a speakers request form provided for this purpose. Each speaker will be asked to come before the Council, to identify themselves, their address, and the City Council district they reside within. Comments should be reasonably concise and to the point. Questions will be answered but the Council will not permit argument or excessive discussion of any particular topic. The hearing will be conducted under rules of judicial decorum. A tape recording of the hearing will be made of this hearing. Your comments will be transcribed and included with the submission of the proposed changes to existing City Council districts to the United States Department of Justice. Por medio de la presente se da aviso de que el Concilio de la Ciudad de Paris, Texas se reunira en sesion regular el dia 12 de septiembre de 2011 a las 5:30 p.m. para recibir comentarios del publico sobre la nueva delimitacion de distritos del Concilio de la Ciudad. Seguido de la audiencia publica, el Concilio de la Ciudad pondra a consideracion y posible accion uno o mas planes alternativos para la nueva delimitacion distritos del Concilio de la Ciudad. Deliberate and act on the Preliminary Plat and Final Plat of Lot 1, Block A, Nepex Realty LTD 313, located at 3930 Lamar Avenue. 11. Deliberate and act on the Replat of Lot 5, Block 2, Clements Fairview Addition, located at 1538 North Main Street. 12. Report from Jeanna Scott on the building permit process. 13. Deliberate and act on a Resolution accepting a utility easement from Paris Junior College for a water line crossing Paris Junior College Campus South of Clarksville Street. 14. First reading, deliberate and possibly act on an Ordinance authorizing the issuance of a solid waste collection permit to Sanitation Solutions for collecting and/or transporting solid waste from commercial and industrial units within the city limits. 15. First reading, deliberate and possibly act on an Ordinance authorizing the issuance of a solid waste collection permit to Trashy Business, for collecting and/or transporting solid waste from commercial and industrial units within the city limits. 16. Deliberate and act on a Resolution declaring certain personal property as surplus property and authorizing the disposal of said surplus city property. 17. Deliberate and act on Resolution adopting a City Council travel policy. 18. Deliberate and act on a Resolution accepting the Routine Airport Maintenance Program (RAMP) Grant; authorizing the execution of a Grant Agreement for TxDOT Project No. AM 2012PARIS. 19. Deliberate and act on a Resolution approving the Contract with the Chamber of Commerce of Lamar County, Inc. to maintain the Visitors & Convention Council for the purpose of managing the Municipal Hotel Occupancy Tax Fund to promote Tourism and the Convention and Hotel Industry in the City of Paris. 20. Deliberate and act on a Resolution acknowledging and approving a Loan Agreement and Promissory Note by and between the Paris Economic Development Corp. "Borrower" and Capital One, N.A. Bank "Lender" for a revolving line of Credit in the amount of Two Million Dollars. 21. Convene into Executive Session: a. Pursuant to Section 551.071 of the Texas Government Code, Consultation with Attorney, to receive legal advice from the City Attorney about pending or contemplated litigation and/or on matters in which the duty of an attorney to his client under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas, clearly conflict with this chapter, to-wit: Texas Supreme Court ruling in Cause No. 09-0257; City of Dallas vs. Heather Stewart; b. Pursuant to Section 551.074 of the Texas Government Code, to deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee as follows: discuss City Manager applicants. 22. Reconvene into Open Session, deliberate and possibly take action on those matters discussed in Executive Session. 23. Consider and approve future events for City Council and/or City Staff pursuant to Resolution No. 2004-081. 24. Adj ournment.
