2003-009ORDINANCE NO. 2003-009 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING FOR THF. EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF PARIS, PARIS, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 11.316 ACRES, MORE OR LESS, AS REQUESTED BY PETITION OF THE OWNERS THEREOF; GRANTING TO SAID TERRITORY AND TO ALL F'i1TURE INHABITANTS OF SAID PROPERTY ALL OF THE RIGHT S AND PRIVILEGES OF OTHER CITIZENS AND BINDING SAID FUTURE INHABITANTS BY ALL OF THE ACTS AND ORDINANCES OF THE CITY UF PARIS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; REPEALING ALL ORDINANCES OR PARTS OF OItDINPiNCES 1N CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVF. DATE. WHEREAS, a petition of annexation lias been duly signed and acknowledged by each and every person or corporation having an interest in the following .izscriheci territory, to-wit: Being all that certain tract of land situated in the City of P;iris, Lamar County, Texas, a part of the Wesley Askins Survey; Abstract No. 7, a part of the 100.00 acre tract of land conveyeci to D. Wayne Brown, et al., by deed recorded in Volume 939, Page 31 of th.e I amar County R:.al Property Records, and a pari of the 121.76 acre tract of land conveyed to D. Wayne Brown, et al., by deed recorded in Volume 949, Page 296 of the Lamar County Real Property Records, and beinb further described as follows: BEGINNING at an iron pin found at the Southeast corner of Lot 9, and being in the North line oi Lot 8, Blxk D, of T'he Hills No. 2 as sliown by plat recorded in Envelope 364-D of the Lamar County P!at Records; THENCE Norfh 3$° 54' 2?" West, a dis±ance of 200.00 feet to an iron pin found at the Northeast corner of Lot 9, Block F, of said The Hills No. 2; THENCE North 54° 54' 28" East a distance of 300.67 feet to an iron pin set for corner; THENCE North 51 ° OS' 37" East a distance of 511.48 feet to an iron pin set for corner in the West boundary line of North Hilis Drive; THENCE North 53° 54'04" East a distance of 60.10 feet to an iron pin set for corner in the East boundary line of said North Hills Drivc:; THENCE North 58° 32' S7" Eact a distance of 411.55 feet to an iron pin set for corner in the East Line Lif the 100' TXLJ Utility easemeirt: THENCE South 64° 08'23" East a distance of 420.41 feet to an iron pin set for corner in the East line of said Easement; THENCE South 58° 32'57" West a distance of 630.37 feet to an iron pin found at Northeast corner of Lot 11, Block A, of The Hills No. 1 as shown by plat recorded in Envelope 364-D of the Lamar County Plat Records, said pin being in the West boundary line of said North Hills Drive; THENCE South 55° 43'26" West a distance of 60.00 feet to an iron pin found at the Northeast corner of Lot 1, Block D, said The Hills No. 1, said pin being in the West boundary line of said North Hills Drive; THENCE South 51 ° 05'37" West a distance of 516.09 feet to an iron pin found at the Northeast corner of Lot 5, Block D, said The Hills No. 1; THENCE South 56° 46' 15" 201.00 feet to an iron pin found at the Northeast corner of Lot 8 and the Northwest corner of Lot 7, Block D, said The Hills No. 1; THENCE South 51 ° 05'37" West a distance of 117.11 feet to the place of beginning, and containing 11.316 acres of land; and, WHEREAS, said iract of land is contiguous and adjacent to the current city limits of the city of Paris, Texas, and is not more than one-half (1 /2) mile in width; and, WHEREAS, said petition fully conformed with the requirements of Section 6 of the Charter of the City of Paris and Section 43.028 of the Local Government Code; and, WHEREAS, said petition was presented to the City Council on the l Oth day of February, 2003; and, WHEREAS, after hearing such petition and the arguments for and against the same, the City Council adopted Resolution No. 2003-026 granting such petition to annex said territory into the city of Paris, Texas; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That the following described property, to-wit: Being all that certain tract of land situated in the City of Paris, Lamar County, Texas, a part of the Wesley Askins Survey, Abstract No. 7, a part of the 100.00 acre tract of land conveyed to D. Wayne Brown, et al., by deed recorded in Volume 939, Page 31 of the Lamar County Real Property Records, and a part of the 121.76 acre tract of land conveyed to D. Wayne Brown, et al., by deed recorded in Volume 949, Page 296 of the Lamar County Real Property Records, and being further described as follows: BEGINNING at an iron pin found at t?ie Southeast corner of Lot 9, and being in the North line of Lot 8, Block D. of The Hills No. 2 as shown by plat recorded in Envelope 364-D of the Lamar County Plat Records; THENCE North 38° 54' 23" West a distance of 150.00 feet to an iron pin found at the Northeast corner of said Lot 9, Block D; THENCE North 51 ° OS' 37" East a distance of 59.26 feet to an iron pin set in the South Boundary Line of Abby Lane; THENCE North 38° 54' 23" West, a distance of 200.00 feet to an iron pin found at the Northeast corner of Lot 9, Block E of said The Hills No. 2; THENCE North 54° 54' 28" East a distance of 300.67 feet to an iron pin set for corner; THENCE North 51 ° OS' 37" East a distance of 511.48 feet to an iron pin set for corner in the West boundary line of North Hills Drive; THENCE North 53° 54'04" East a distance of 60.10 feet to an iron pin set for corner in the East boundary line of said North Hills Drive; THENCE North 58° 32' S7" East a distance of 411.55 feet to an iron pin set for corner in the East Line of the 100' TXU Utility easement; THENCE South 64° 08'23" East a distance of 420.41 feet to an iron pin set for corner in the East line of said Easement; THENCE South 58° 32'57" West a distance of 630.37 feet to an iron pin found at Northeast corner of Lot 11, Block A, of The Hills No. 1 as shown by plat recorded in Envelope 364-D of the Lamar County Plat Records, said pin being in the West boundary line of said North Hills Drive; THENCE South 55° 43'26" West a distance of 60.00 feet to an iron pin found at the Northeast corner of Lot 1, Block D, said The Hills No. 1, said pin being in the West boundary line of said North Hills Drive; THENCE South 51 ° 05'37" West a distance of 516.09 feet to an iron pin found at the Northeast corner of Lot 5, Block D, said The Hills No. l; THENCE South 56° 46' 15" 201.00 feet to an iron pin found at the Northeast corner of Lot 8 and the Northwest corner of Lot 7, Block D, said The Hills No. 1; THENCE South 51 ° 05'37" West a distance of 117.11 feet to the place of beginning, and containing 11.316 acres of land, be, and the same is hereby, annexed to the city of Paris, Texas, and that boundary limits of the city of Paris, Texas, be, and the same are hereby, extended to include the above-described territory, and the same shall hereafter be included within the territorial limits of the city of Paris, and that said land and the inhabitants thereof shall hereafter be entitled to all of the rights and privileges and subject to all of the obligations and responsibilities of other citizens of the city of Paris, Texas, and shall be bound by the acts and ordinances of the City of Paris. Section 3. That, pursuant to Section 43.057 of the Local Government Code, the City Council finds and determines that, although this annexation would cause an area to be entirely surrounded without being within the city of Paris, because the surround~d property is owned by one or more of the parties requesting annexation, sunounding said area will foster development in both the annexed and un-annexed area, will enhance tax revenue to the City, and is therefore in the public interest. Section 4. That the City Clerk be, and she is hereby, directed to file with the County Clerk of Lamar County, Texas, a certified copy of this Ordinance accompanied by a copy of the Petition for Annexation. Section 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. Section 6. That this ordinance shall become effective on March 6, 2003.
