99-026ORDINANCE NO. 99-026 AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF PARIS, PARIS, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF APPROXIMATELY 158 ACRES, MORE OR LESS; GRANTING TO SAID TERRITORY AND TO ALL FUTURE INHABITANTS OF SAID PROPERTY ALL OF THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BINDING SAID FUTURE INHABITANTS BY ALL OF THE ACTS AND ORDINANCES OF THE CITY OF PARIS; AND PROVIDING ZONING FOR SAID TERRITORY. WHEREAS, a petition of annexation has been duly signed and acknowledged by each and every person or corporation having an interest in the following described territory, to-wit: Tract 1 Situated about 3 miles southerly from the City of Paris, Lamar County, Texas, being a part of the George Bason Survey, Abstract No. 58, being a part of an 87.45 acre tract of land conveyed Blake Lee by Deed dated May l, 1939, recorded in Volume 251, Page 164, Deed Records, Lamar County, Texas, also being a part of a 73 acre tract of land allotted to Wilma Lee by partition deed dated March 8, 1933, recorded in Volume 234, Page 322, Deed Records, Lamar County, Texas, and being more particularly described as follows: BEGINNING at a highway right-of-way marker at the intersection of the Northwest Boundary Line of State Highway No. 24 with the West Boundary Line of a public road; also being a point in the East Boundary Line of the tract described in said partition deed; THENCE along the Northwest Boundary Line of said highway on the following calls: along a curve to the right having a radius of 22,833 feet and a certain angle of 01 Deg. 12 Min. a distance of 478.7 feet to a highway right-of-way , marker; South 25 Deg. 07 Min. West a distance of 371.1 feet to a highway right- of-way marker; South 70 Deg. 31 Min. West a distance of 70.7 feet to a highway right-of-way marker; THENCE North 88 Deg. 37 Min. West a distance of 1,545.8 feet along the North Boundary Line of a public road to an iron pin set for corner; THENCE North 00 Deg. 19 Min. West a distance of 106.6 feet along a fence line to an iron pin set for corner; THENCE North 89 Deg. 36 Min. West a distance of 679.3 feet along a fence line to an iron pin set for corner at the most Southern Southwest corner of said Blake Lee tract; THENCE continuing along a fence line on the following calls: North 14 Deg. 53 Min. West a distance of 286.3 feet to an iron pin set; South 80 Deg. 27 Min. West a distance of 100.9 feet to an iron pin set; North 15 Deg. 54 Min. West a distance of 952.8 feet to an iron pin set; North 18 Deg. 19 Min. East a distance of 332.3 feet to an iron pin set; North 44 Deg. 36 Min. East a distance of 38.6 feet to a point; , - THENCE North 89 Deg. 37 Min. East a distance of 2,946.1 feet to a point in the West Boundary Line of a public road; THENCE South 00 Deg. 31 Min. East a distance of 891.0 feet along the West Boundary Line of said public road to the place of beginning, containing 105.15 acres of land. Being the same property conveyed Delmar-West Lamar Consolidated Independent School District by deed recorded in Volume 601, Page 647, Deed Records, Lamar County, Texas. Tract 2 Situated about 3 miles Southerly from the City of Paris, Lamar County, Texas, being a part of the George Bason Survey, Abstract No. 58, being a part of an 87.45 acre tract of land conveyed Blake Lee by deed dated May 1, 1939, recorded in Volume 251, Page 164, Deed Records, Lamar County, Texas, and being more particularly described as follows: BEGINNING at an iron pin set for corner in the West Boundary Line of a public road, at the present Northeast corner of said 87.45 acre tract; THENCE South 00 Deg. 31 Min. East a distance of 872.2 feet along the West Boundary Line of said public road to a point; . THENCE South 89 Deg. 37 Min. West a distance of 2,946.1 feet to a point; THENCE North 44 Deg. 36 Min. East a distance of 129.8 feet along a fence line to an iron pin set for a corner; THENCE North 24 Deg. 33 Min. East a distance of 294.5 feet along a fence line to an iron pin set for corner; THENCE North 39 Deg. 16 Min. East a distance of 666.7 feet along a fence line to an iron pin set for corner at the Northwest corner of said 87.45 acre tract; THENCE North 89 Deg. 37 Min. East a distance of 2,302.7 feet along a fence line and along or near the North Boundary Line of the Bason Survey to the place of beginning, containing 52.88 acres of land. Being the same property conveyed Delmar-West Lamar Independent School District by deed recorded in Volume 693, Page 133, Deed Records, Lamar County, Texas; and, WHEREAS, said tract of land is contiguous and adjacent to the City of Paris, Paris, Texas, and is not more than one-half (1 /2) mile in width; and, WHEREAS, said petition was presented to the City Council on the 18th day of February, 1999; and, WHEREAS, after hearing such petition and the arguments for and against the same, the City Council has voted to grant such petition and to annex said territory to the City of Paris, Paris, Texas; and, WHEREAS, the above-described property should be properly zoned as of the date of annexation; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. Being the same property conveyed Delmar-West Lamar Independent School District by deed recorded in Volume 693, Page 133, Deed Records, Lamar County, Texas, be, and the same is hereby, annexed to the City of Paris, Paris, Texas, and that boundary limits of the City of Paris, Paris, Texas, be, and the same are hereby, extended to include the above- described territory, and the same shall hereafter be included within the tenitorial limits of the City of Paris, and that said land and the future inhabitants thereof shall hereafter be entitled to all of the rights and privileges of other citizens of the City of Paris, Paris, Texas, and shall be bound by the acts and ordinances of the City of Paris. Section 2. The above-described territory is hereby zoned Public Lands and Institution District (PLI) upon annexation as provided for in Zoning Ordinance No. 1710 of the City of Paris, Paris, Texas. Section 3. It is hereby declared to be the intention of the City Council of the City of Paris that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional or invalid by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any unconstitutional or invalid phrases, clauses, sentences, paragraphs or sections. It is further hereby declared to be the intention ef the City Council of the City of Paris to exclude any area or areas described in the description of the property to be annexed which are not within said City's jurisdiction to annex, and that such area or areas should be carved out of the description by the valid judgment or decree of any court of competent jurisdiction, in order that such area or areas would not cause this annexation ordinance to be found to be invalid, voidable, or void. Section 4. That the City Clerk of the City of Paris be, and she is hereby, directed to file with the County Clerk of Lamar County a certified copy of this Ordinance. Section 5.
