87-084~ , - . , ~ ORDINANCE N0. 87-084 AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF PARIS, PARIS, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 121.37 ACRES, MORE OR LESS, WHICH IS LESS THAN TEN PERCENT (10%) OF THE TERRITORY INCLUDED WITHI:N ITS PRESENT CITY LIMITS, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF PARIS, PARIS, TEXAS; APPROV- ING SERVICE PLAN AND PROVIDING ZONING FOR SAID TERRITORY. WHEREAS, public hearings before the City Council of the City of Paris, Paris, Texas, where all interested persons were provided with an opportunity to be heard on the proposed annexation of the following described property: TRACT 1: Situated in the Enoch Crow Survey, Lamar County, Texas and more particularly described as follows: BEGINNING at a point in the East boundary line of a tract of land conveyed to W. Elmer and Fleta Skidmore by deed recorded in Vol. 396, Page 418, Deed Records, Lamar County, Texas, said point being 500 feet North of and perpendicular to the North boundary line of U. S. Highway No. 82 and being in the present city limits line of the City of Paris; THENCE North with the said East boundary line of said Skidmore tract, 300 feet more or less to the Northeast corner of said tract; THENCE West with the North boundary line of said Skidmore tract and continuing West with the North boundary line of a tract of land owned by Donald R. Lewis, et al, 510 feet more or less to the East boundary line of a 16.5 acre tract of land conveyed W. T. Ford by deed recorded in Vol' 274, Page 499, Deed Records of Lamar County, Texas; THENCE South with the East boundary line of said Ford tract, 305 feet more or less to the Northeast corner of a tract of land conveyed to Zed Smith, III and Michael B. Smith by deed rPCOrded in Vol 611, Page 12 and Vol. 626, Page 901, Deed Records, Lamar County, Texas; THENCE West with the North boundary line of said Smith tract and continuing West along the North boundary lines of properties owned by ~ Hilliard and Sons, Inc., John Yerby and a tract awned by Hoyt and Charline Langley and Gerald and Nadine Farmer, 855 feet more or less to the Northwest corner of said Langley-Farmer tract, said point being in the East boundary line of 46th N.E. and being 764 feet North of and perpendicular to the North boundary line of U.S. Highway No 82; THENCE Westerly with 'a line that is 764 feet North of and parallel with the North Uoundary line of. U.S. Highway No. 82, 1290 feet more or less to the center of_ a creek which runs North and South, said point being in the present city limits line; THENCE Souther]_y with said center line of creek and the present city limit line, 310 feet more or less to its intersection with a'iine that is 500 feet North of and parallel with the North botindary line of. U. S. Highway No. 82 ; THENCE Easterly with said line that is 500 feet North of and paral]_el with the North boundary line of U. S. Highway No. 82 and the present city limit line, 2,050 feet more or less to the place of beginning and containing 15.75 acres, more or less. TRACT 3 A: BEING situated in the J. Ames survey and the B. F. Bourland Survey and more particularly described as follows: BEGINNING at a point being the Southeast corner of a tract of land conveyed L. J. Henson by deed recorded in Vol. 535, Page 207 of the Deed Records of Lamar County, Texas; THENCE East, across 19th N.W. to said North- west corner of said Henson 7.09 acre tract; THENCE East 312 feet with the North line of said Henson tract to an interior corner of the same; THENCE North 120 feet to the most Easterly Northwest corner of sa3_d Iienson tract; THENCE East 843 feet to a point in the West line of Lot 1-A, Wright Commercial Addition; THENCE North with the West line of said Lot 1-A, Wright Commercial Addition, 270 feet more or less to the Northwest corner of said Lot 1-A; THENCE East with the North boundary line of said Wright Commercial Addition, 730 feet more or less to a point in the present city limit line of the City of Paris and the place of beginning and containing 9.35 acres more or less. were held at Paris, Texas, on the lOth day of September, 1987, in Regular Session convened, at 5:15 o'clock P.M., in the Council Room, City Hall, Paris, Texas, on the 14th day of September, 1987, in Regular Session convened, at 7:00 o'clock P.M., in the Council Room, City Hall, Paris, Texas, which dates are not more than forty (40) nor less than twenty (20) days prior to the institution of annexation proceedings; and, WHEREAS, written protest was filed with the City Clerk of the City of Paris by more than twenty (20) adult resi- dents wha reside in the area to bP annexed described as Tract 2 and an additional public hearing was held within the area described as Tract 2 at 6:00 P.M. on September 28, 1987, at the residence of Clyde Darnell located on the South side of FM Hwy 195; and, WHEREAS, notice of such public hearings was published in a newspaper having general circulation in the City of Paris, Paris, Texas, and in the above described territory, on the 23rd, 26th and 30th days of August, 1987, and on the 15th day of September, 1987, which dates are not more than twenty (20) nor less than ten (10) days prior to the date of such public hearings; and, WHEREAS, the total corporate area of the City of Paris, Paris, Texas, on the first day of January, 1987, was 14,284 acres; and, WHEREAS, the population of the City of Paris, Paris, Texas, is in excess of 25,000 and less than 50,000 inhabi- tants; and, WHEREAS, the above described territory lies within the extraterritorial. jurisdiction of the City of Paris, Paris, Texas; and, WHEREAS, the above describeo territory lies adjacent to and adjoins the City of Paris, Paris, Texas; and, WHEREAS, the above described territory contains 121.37 acres, more or less, which when added to other property annexed in the year 1987 is less than ten per cent (10%) of the present acreage contained in the corporate-limits of the City of Paris, Paris, Texas; and, WHEREAS, a service plans providing for the extension of municipal services to the above described territory should be approved; and, WHEREAS, the above described property should be pro- per1y zoned as of the date of annexation; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. The following described land and terri- tory lying adjacent to and adjoining the City of Paris, Paris, Texas, is hereby added and annexed to the City of Paris, Paris, Texas, and said territory hereinafter de- scribed shall hereafter be included within the boundary limits of the City of Paris, Paris, Texas, and the present boundary limits of said City, at the various points contiguous to the area hereinafter described are altered and amended so as to include said area within the corporate limits of the City of Paris, Paris, Texas, to-wit: TRACT 1: Situated in the Enoch Crow Survey, I,amar County, Texas and more particularly described as follows: BEGINNING at a point in the East boundary line of a tract of land conveyed to W. Henson by deed recorded in Vo1. 535, Page 207 of the Deed Records of Lamar County, Texas; THENCE East, across 19th N.W. to said North- west corner of said Henson 7.09 acre tract; THENCE East 312 feet with the North line of said Henson tract to an interior corner of the same; THENCE North 120 feet to the most Easterly Northwest corner of said Henson tract; THENCE East 843 feet to a point in the West line of Lot 1-A, Wright Commercial Addition; THENCE North with the West line of said Lot 1-A, Wright Commercial Addition, 270 feet more or less to the Northwest corner of said Lot 1-A; THENCE East with the North boundary line of said Wright Commercial Addition, 730 feet more or less to a point in the present city limit line of the City of Paris and the place of beginning and containing 9.35 acres more or less. Section 2. The above described territory and area so annexed shall be part of the City of Paris, Paris, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Paris, Paris, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Paris, Paris, Texas. . Section 3. The service plan providing for the extension of municipal services into the above described territory, attached hereto as Exhibit A, B and C, is hereby approved. Section 4. The above described territory is hereby zoned Agricultural District (A) upon annexation as provided for in Zoning Ordinance No. 1710 of the City of Paris, Paris, Texas. + Section 5. It is hereby declared to be the inten- tion of the City Council of the City of Paris that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence paragraph or section of this ordinance shall be declared unconstitutional ar invalid by the valid judgment or decree of any court of competent jurisdiction, such unconsti- tutionality or invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been' enacted by the City Council without the incorporation in this ordinance of any unconstitutional or invalid phrases, clauses, sentences, paragraphs or sections. It is further hereby declared to be the intention of the City Council of the City of Paris to exclude any area or areas described in the description of the property to be annexed, which are not within said City's jurisdiction to annex and that such area or areas should be carved out of the description of the property herein described by the,valid judgment or decree of any court of competent jurisdiction, in order that such area or areas would not cause this annexation ordinance to be f.ound to be invalid, voidable or void. Section 6. This ordinance shall be published and passed in the manner provided in Article II, "Section 7, of the Charter of the City of Paris, Paris, Texas.
