83-069~ ORDINANCE N0. 83-069 AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, SEPARATING, DISANNEXING, REMOVING AND EXCLIJDING FROM THE INCORPORATED AREA OF THE CITY OF PARIS, LAMAR COUNTY, TEXAS, AN AREA EMBRACING APPROXIMATELY 77.41 ACRES OF PROPERTY OWNED BY PARIS, TEXAS INDUSTRIAL FOUNDATION, INC., DESCRIBED IN TWO TP.ACTS, TRACT ONE OF WHICH CONTAINS APPROXIMATELY 76.41 ACRES, AIQD TRACT TWO CONTAINING APPROXIMATELY 1 ACRE, SAID PROPERTY BEING I-IEREINAFTF.R DESCRIBED BY METES AND - BOUNDS AND SAID PROPERTY BEING WHOLLY UPdINHABITED BY RESI- DENCES OR COMNIERCIAL STRUCTURES; CHANGING TIiE BOUNDARIrS OF DISTRICT THREE OF THE CITY OF PARIS SO AS TO EXCLUDE THE HEREINAFTFR DESCRIBED PROPERTY FROM SAID DISTRICT; INSTRUCT- ING THE CITY ENGINEER TO MAKE A SURVEY FIXING AND ESTABLISHING THE BOUNDARY LIMITS OF SAID CITY IN ACCORDANCE HEREWITH ArIU TO CONSTRUCT A COMPLETE MAP OF SUCH TERRITORY HEREIN AND HEREBY EXCLUDED FROM TIiE CORPORATE AREA OF THE CITY OF PARIS; AND ESTAI3LISHING THE CITY LIMIT LINE RESULT- ING FROM THIS DISANNEXATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1, That the following described property presently located within the corporate limits of the City of Paris, Lamar County, Texas, which is wholly uninhabited, owned or being acquired by Paris, Texas Industrial Founda- tion, Inc., be, and the same is hereby separated, disan- nexed, removed and excluded from the corporate area of said City, and the boundary limits of the City of Paris are hereby amended, changed and corrected, so as to include said territory and to conf_orra to the same as herein set out in four tracts, to-wit: TRACT ONE: Situated within the Corporate Limits of the City of Paris, County of Lamar, and State of Texas, a part of the James Bourland Survey #69, and being a part of a 135.29 acre tract of land conveyed Jack Smith by deed recorded in Vo1. 285, Page 598, of the Deed Records of said County and State and part of a 4.74 acre tract conveyed to the Texas Midland Railroad by W. S. Chambers by deed recorded in Volume B2, Page 160, of the Deed Recor.ds of Lamar County, Texas and also being all of a 2,09 acre tract conveyed to the Texas Midland Railroad by H. L. Obenchain by deed recorded in Book 87, Page 329, of the Deed Records of Lamar County, Texas. BEGINNING at a stake for corner in the South boundary line of the Old Brookston Road at the present Northeast corner of,said Smith tract of land; THENCE along the South boundary line of said Old Brookston Road as fallows: South 78° West a ciistance of 100 feet; South 82° West a distance of 100 feet; South 89° kTest a distance of 100 feet; West, a distance of 2,083.92 feet; North'87° West a distance of 178 feet to a stake the Northwest corner of said Smith tract of land; THENCE South a d.istance of 966.5 feet to a point in the Plorth boundary line of Loop Highway 286; TfIENCE along the North boundary line of Loop Highway 286 as follows: Easterly around a curve to the left a distance of 206 feet; South 70° East a distance of 195 feet; Easterly around a curve to the left a distance of 292 feet; South 67° East a distance of 141 feet; South 72° East a distance of 1153.79 feet; Sout 76° 35' East a distance of 250.5 feet; South 72° East a distance of 273.5 feet to a stake for corner in the East Boundary Line of said Smith tract of land; THENCE North 0° 15' East a distance of 1805 feet to the place of beginning and containing 76.41 acres of land more or less. TRACT TWO: Situated within the corporate limits of the City of Paris, County of Lamar and State of Texas, a part of the James Bourland Survey No. 69 and George Bason Survey No. 58, and being a part of a 108.90 acre tract of land now owned by Jack Smith. BEGINNING at a stal;e for corner in the South Boundary line of Loop Highway 286, 1,248.5 feet Westof the West Boundary line of the Southern Pacific Failroad; said point being the most Northerly Northwest corner of said 108.90 acre tract of land; THENCE Southeasterly along the South Boundary line of Loop Highway 286 around a curve to the left a distance of 208 feet to a point for corner; THENCE South a distance of 208 feet to a point for corner; - THENCE Northwesterly along a line 208 feet South and parallel to the South Boundary line of Loop Highway 286 a distance of 208 feet to a point in the West Boundary line of said 108.90 acre tr_act of land; THENCE North along the West Boundary line of said tract a distance of 208 feet to the place of beginning, and containing one acre of land, more or less. Section 2. That the present boundaries of District Three of the City of Paris are hereby corrected and changed, so as to exclude the said above described property, and the same is hereby removed and excluded from said District Three of the City of Paris, Texas. Section 3. The City Engineer is hereby instructed to make a complete survey of the above described territory and to mark the boundaries of the City Limit Lines as estab- lished by this ordinance after the removal and exclusion of the above described tracts from'the existing or present corporate limi_ts oi' the City of $aris, and he is further instructed to immediately correct the map of the City of Paris so as to remove and exclude therefrom the territory described herein, indicating on such map the date of the separation and disannexatian of the said above described tracts from the corporate limits of the City of Paris. Section 4. Thi.s ordinance shall become effective immediately upon passage.
