ORDINANCE PIO. 2630 AN ORDIDTANCE PROVIDING FOR THr- EXTENS ION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF PARIS, PARIS, TEXAS, AND THE ANNEXATION OI' CERTAIN TERRITORY CONSISTING OF 8.99 ACRES, MORE OR LESS, [,TiICH IS LESS THAN TEN PER CENT (10%) -OF THE TERRITORY INCLUDED 47ITHIN ITS PRESENT CITY LIMITS, Tv'HICH SAID TERRITORY LIES ADJACENT TO AND AUJOINS THE PRE- SENT BOUNDARY LIMITS OF THE CITY OF PARIS, PARIS, TEXAS, AND PROVIDING ZONING FOR SAID TERRITORY. ti1IiEREAS, public hearings before the City Council of the City of Paris, Paris, Texas, where all interested per- sons were provided with an opportunity to be heard on the proposed annexation of the following described property: Situated in the County of Lamar and State of Texas, a part of the Isaac Cruse Survey and being more particularly described as follows: BEGINNING a.T a point in the South Right-of-way of U. S. Highway No. 82, said point being in the West City Limit Line of the City of Paris, Texas, said point being West, a distance of 92 feet from the Northeast corner of an 18 acre tract of land out of the Isaac Cruse Survey, conveyed to Jaries L. Broclcway and wife, Martha B. Brockway, by deed filed March 7, 1957, recorded in Volurne 353, Page 356, Deed Records, Lamar County, Texas; THE?VCE along the South Right-of-way of U. S. Highway No. 82, West, a distance of 777.2 feet to a point, said point being the Northwest Corner of an 18 acre tract of land conveyed Curtis McDaniels and wife, Kay McDaniels, by deed filed June 23, 1980, recorded in Volume 625, Page 930, Deed Records, Lamar County, Texas; THi:NCL South along the jaest Boundary Line of said McDaniels 18 acre tract of land, a distance of 504 feet to a point; THENCE East parallel witn the South Right-of-way of U. S. rIighway No. 82, a distar_ce of 777.2 feet to apoint in the Gdest City Limit Line of the City of Paris; TNENCE Nortiz along the existing city limit line of the City of Paris, a distance of 504 feet to the place of beginning and containing 8.99 acres of land, more or less, was held at Paris, Texas, on tne lst day of March, 1982, in Special Session convened, at 6:00 o'cloclc P. M., at Montgomery's Exxon Service Station, Highway 82 West, Route 5, Paris, Texas; and on the $th day of March, in Regular Session convened, at 7:00 o'clock P. M,, in the Council Room, City Hall, Paris, Texas, which dates are not more than forty (40) nor less than twenty (20) days prior to the institution of annexation proceedings; and, WdEREAS, notice of such public hearings wa5:pub:lished in a newspaper having general circulation in the City of Paris, Texas, and in the above described territory, on the 14th, 19th, and 21st day of February, 1982, which dates are not more than t;aenty (20) nor less than ten (10) days prior to the date of such pub 1ic hearings; and, WIiEREAS, the total corporate area of the City of Paris, Paris, Texas, on the first day of January, 1982, was 14,100.5 acres; and, WHEREAS, the population of the City of Paris, Paris, Texas, is in excess of25,000 and less than 50,000 inhabitants; an d , WHEREAS, the above described territory lies within the extraterritorial jurisdiction of the City of Paris, Paris, Texas; and, WHEREAS, the above described territory lies adjacent to and adjoins the City of Paris, Paris, Texas; and, tJHEREAS, the above described territory contains 8,99 acres, more or less, wnich when added to other property annexed in the year 1982 is less than ten per cent (10%) of the pre- sent acreage contained in the corporate limits of the City of Paris, Texas; and, W?iEREAS, tfie above described property should be properly zoned as of the date of annexation; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section l. The following described land and territory lying adjacent to and adjoining the City of Paris, Paris, Texas, is hereby added and annexed to the City of Paris, Paris, iexas, and said territory hereinafter described shall hereafter be included within the boundary limits of the City of Paris, Texas, and the present boundary limits of said city at the various points contiguous to the area hereinafter de- scribed, are altered and amended so as to include said area within the corporate limits of the City of Paris, Texas, to- wit, Situated in the County of Larnar and State of Texas,_,a part of the Isaac Cruse Survey and being more particularly described as follows: BEGINNING at a point in the South Right-of-way of U. S. Higliway No. 82, said point being in the West City Limit Line of the City of Paris, Texas, said point being West, a distance of 92 feet from the Northeast corner of an 18 acre tract of land out of the Isaac Cruse Survey, conveyed to James L. Brockway and wife, Martha B, Brockway, by deed filed March 7, 1957, recorded in Volume 353, Page 356, Deed Records, Lamar County, Texas; THENCE along the South Right-of-way of U, S. Highway No. 82, West, a distance of 777.2 feet to a point, said point being the Northwest Corner of an 18 acre tract of land conveyed Curtis McDaniels and wife, Kay McDaniels, by deed filed June 23, 1980, recorded in Volume 625, Page 930, Deed Records, Lamar County, Texas; THENCE South along the West Boundary Line of said McDaniels 18 acre tract of land, a distance of 504 feet to a point; THENCE East parallel with the South Right-oF-way of U. S. Highway No, 82, a distance of 777,2 feet to a point in the West City Limit Line of the City of Paris; THENCE North along the existing city limit line of the City of Paris, a distance of 504 feet to tne place of beginning and containing 8.99 acres of land, more or less. Section 2, The above described territory and area so annexed shall be a part of the City of Paris, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Paris, Paris, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the ` acts, ordinances, resolutions and regulations of the City of Paris, Paris, Texas, Section 3, The above described territory is hereby zoned Commercial District (C) upon annexation as provided for in Zoning Ordinance No. 1710 of the City of Paris, Paris, Texas. Section 4. It is hereby declared to be the intention of the City Council of the City of Paris that the sections, para- graphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional or invalid by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any of the remaininb phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any unconstitutional or invalid phrases, clauses, sentences, paragraphs or sections. It is further hereby declared to be the intention of the City Council of the City of Paris to exclude any area or areas de- scribed in the description of the property to be annexed, w'nich are not within said City's jurisdiction to annex and ~hat such area or areas should be carved out of the description of the property herein described by the valid judgment or de- cree of any court of competent jurisdiction, in order that such area or areas would not cause this annexation ordinance to be found to be invalid, voidable or void.
