" ORDINANCE NO. 2369
AN ORDINANCE PROVIDING FOR THE EXTENSION OT CER-
TAIN BOUNDARY LIMITS OF THE CITY OF PARIS, PARIS, TEXAS,
AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF
3.30 ACRES, MORE OR LESS, WHICH IS LESS THAN TEN PER
CENT (10°/~0) Or TI-IE TERRITORY INCLUDED WITHIN ITS PRESENT
CITY LIMITS, WHICH SAID TERRITORY LIES ADJACENT TO AND
ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF PARIS,
PARIS, TEXAS, AND PROVIDING ZONING rOR SAID TERRITORY.
Whereas, a public hearing before the City Council of the City
of Paris, Paris, Texas, where all interested persons were provided
with an opportunity to be heard on the proposed annexation of the
following described territory, to-wit:
TRACT l: Being all that certain tract or parcel of
land situated within the County of Lamar and State of Texas,
being a part of the Joseph Leach Survey, a part of a 44
acre tract of land conveyed George O. Fisher, Jr. , by deed
recorded in Volume 312, Page 381 of the Deed Records of
said County and State, and also being a part of 57 acres
conveyed J. L. Jopling by deed recorded in Volume 312,
Page 505 of the Deed Records of said County and State
and being further described as follows:
BEGINNING at the Southeast corner of Lot 13,
Block G, Morningside Estates No. 8, said point being in ,
~ the East Boundary Line oE the above rrentioned 44 acre
Fisher Tract and being in the present City Limit Line;
TIIENCE S 0 Degree 3 Minutes E, a distance of
204. 5 feet to a point for corner in the North Boundary Line
of the above mentioned 57 acre Jopling tract, said point
also being the Southeast corner of the above mentioned
44 acre Tisher tract and the Southeast corner of Lot 14,
Block "G" of Morningside Estates No. 8;
THENCE S 89 Degrees 34 Minutes E along the
North Boundary Line oF the above mentioned Jopling tract,
a distance of 164. 0 feet to a point for corner, the

acres of land, more or less, owned by D. Wayne Brown
and G. Eugene Brown.
TRACT 2: Being a11 that certain tract or parcel of
land situated within the County of Lamar and State of Texas,
a part of the Reddin Russell Survey, and being a part of
tract 6 as shown in Will of Sarah A. Hull to Estelle Council.
BEGINNING at a stake for corner in the South
Boundary Line of said Council tract of 1and, said point
being South 85 Deg. East a distance of 294 Et. from the
Southwest corner oE same, said point for corner being
the Southeast corner of a 0.78 acre tract of land
conveyed Nathan Bell by Estelle Council.
THENCE North 4 Deg. West a distance oE 175 Et.
to a stake for corner at the Northeast corner of said
Bell tract of land;
THENCE North 85 Deg. West a distance of ~200
ft. to a stake for corner at the Northwest corner of
said Bell tract of land;

THENCE North 85 Deg. West along the North
Boundary Line of Stone Ave. a distance of 50 ft. to the
place of _beginning and containing 1.06 acres of land,
owned by J. S. Maple.
was held at Paris, Texas, on the 14th day of November, 1977, which
date is not more than twenty nor less than ten days prior to the in-
stitution of annexation proceedings; and,
WHEREAS, notice of such public hearing was published in a
newspaper having general circulation in the City of Paris, Texas, and
in the above described territory, on the 27th day of October, 1977,
which date is not more than twenty nor less than ten days prior to
the date of such public hearing; and,
WHEREA S, the total corporate area oE the City of Paris,
Paris, Texas, on the first day of January, 1977, was 13, 879. 539 •
acres; and,

WHEREAS, the population of the City oE I'aris, Paris, Texas,
is in excess of 5, 000 and less than 25, 000 inhabitants; and,
WHEREAS, the above described territory lies within the ex-
traterritorial jurisdiction of the. City of Paris, Paris, Texas; and,
_ WHEREAS, the above described territory lies adjacent to
and adjoins the City of Paris, Paris, Texas; and,
WHEREAS, the above described territory contains 3. 30
acres, more or less, which when added to other property annexed
in the year 1977 is less than ten per cent (1070) of the present
acreage contained in the corporate limits of the City of Paris,
Texas; and,
WHEREAS, the above described property should be properly
zoned as oE the date oE annexation; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PARIS:
Section l. The following described land and territory lying
adjacent to and adjoining the City of Paris, Paris, Texas, is hereby
added and annexed to the City oE Paris, Paris, Texas, and said
territory hereinafter described shall hereafter be included within
the boundary limits of the City of Paris, Texas, and the present
boundary limits of said city, at the various points contiguous to the
area hereinafter described are altered and amended so as to include
said area within the corporate limits of the City of Paris, Texas,
to-wit:

to a stake for corner in the South Boundary Line of
said Council tract of land;
THENCE North 85 Deg. West along the North
Boundary Line of Stone Ave, a distance of 50 ft. to the
place of beginning and containing 1.06 acres of land,
owned by J. S. Maple.
Section 2. The above descr.ibed territory and area so annexed
shall be a part of the City of Paris, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the
City of Paris, Paris, Texas, and the inhabitants thereof shall be en-
titled to all of the rights and privileges of all the citizens and shall
be bound by the acts, ordinances, resolutions and regulations of the
, City of Paris, Paris, Texas.
Section 3. The above described Tracts 1 and 2 are hereby
annexed under zoning classifications provided for in Zoning
Ordinance No. 1710 of the City oE Paris, Paris, Texas, as follows:
PROPERTY ZONiNG CLASSIFICATION
a. Tract 1 herein One-Iiamily Dwelling District No. 2(SF-2)
b. Tract 2 herein Commercial District (C)
Section 4. , It is hereby declared to be the intention of the
City Council of the City of Paris that the sections, paragraphs, sen-
tences, clauses and phrases of this ordinance are severable, and if
any phrase, clause, sentence, paragraph or section of this ordinance
shall be declared unconstitutional or invalid by the valid judgment or
decree of any court of competent jurisdiction, such unconstitutionality
or invalidity sha11 not affect any of the remaining phrases, clauses,
sentences, paragraphs and sections of this ordinance, since the same
would have been enacted by the City Council without the incorporation
in this ordinance of any unconstitutional or invalid phrases, clauses,
sentences, paragraphs or sections. It is further hereby declared to
be the intention of the City Council of the City of Paris to exclude any
area or areas described in the description of the property to be
annexed, which are not within said City's jurisdiction to annex and
that such area or areas should be carved out of the description of
the property herein described by the valid judgment or decree of any
court of competent jurisdiction, in order that such area or areas
wauld not cause this annexation ordinance to be found to be invalid,
, voidable or void.
Section 5. This ordinance shall be published and passed in
the manner provided in Article II, Section 7, oE the Charter of the
City of Paris, Paris, Texas.
