2293ORDINANCE NO. 2293 . AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OT PARIS, PARIS, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 12.247 - ACRES, MORE OR LESS, WHICH IS LESS THAN TEN PER CENT (1070) OF THE TERRITORY INCLUDED WITHIN ITS PRESENT CITY LIMITS, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE _ PRESENT BOUNDARY LIMITS OF THE CITY OF PARIS, PARJ.S, TEXAS,' WHEREAS, a public hearing before the City Council of the City of Paris, Paris, Texas, where all interested persons were provided with an opportunity to be heard on the proposed annexation of the following described territory: TRACT 1: Situated in the Isaac Cruise Survey in Lainar County, Texas, and being part of a 216.02 acre tract of land conveyed Ernest Randle by deed recorded in Vol. 272, Page 617, Deed Records of Lamar County, Texas, and being more particularly described as follows: BEGINNING at the Southwest Corner of a 1 acre tract of land conveyed Darrell White by deed recorded in Vol. 446, Page 80, of said Deed Records, and lying in the present City Limit Line; THENCE N 78 ° 30' E with the south line of said White tract and the present City Limit Line, 100.0 feet to a point; THENCE South, 160. 0 feet to a point; TIiENCE West, 197.0 feet to a point in the east line of Gordon Lake Road (private); THENCE North, with the east line of Gordon Lake Road, 119. 86 feet to a point in the present City Limit Line; THENCE N 78 ° 30' E 101. 03 feet to the place of beginning and containing 0.64 acres of land more or less. TRACT 2: Situated partly within the Corporate Limits of the City of Paris, County of Lamar, State of Texas, a part of the Joseph Leach Survey and being a part of a tract of land now owned by D. Wayne and G. Eugene Brown and being a part of 57 acres of land conveyed J. L. Jopling in Vol. 312, Page 509, of the Deed Records of said County and State, and being further described as follows: BEGINNING at a stake in the East Boundary Line of the above mentioned 57 acre tract, said stake being South 987 feet from the Northeast corner of said 57 acre tract; THENCE South along the East Boundary Line of said ~ 57 acre: tract a distance of 633 feet to its Southeast corner in the North Boundary Line of the Old Clarksville Road; THENCE along the North Boundary Line of the Old Clarksville Road as follows: S 69 Degrees W 550 feet; S 80 Degrees W 135 feet; S 87 Degrees W 143 feet, a stake for coi ner; - THENCE along the Eas t Boundary Line of Loop Highway 286 as follows: N 36 Degrees W 369 feet; N 57 Degrees W 122 feet; N 29 -Degrees W 70 feet to a stake for corner; - THENCE East 380 feet to a stake for corner; THENCE North 405 feet to a stake for corner; THENCE East 60 feet to a stake for corner; THENCE North 185 feet to a stake for corner; THENCE East 500 feet to a stake for corner; THENCE South 135 feet to a stake for corner; THENCE East 200 feet to the place of beginning and containing 17. 502 acres, of which 5.895 acres are presently in the City Limits. was held at Paris, Texas, on the lOth day of May, 1976, which date is not more than twenty nor less than ten days prior to the institution of annexation proceedings; and, WHEREAS, notice of such public hearing was published in a newspaper having general circulation in the City of Paris, Texas, and in the above described territory, on the 25th day of April, 1976, which date is not more than twenty nor less than ten days prior to the date of such public hearing; and, WHEREAS, the total corporate area of the City of Paris, Paris, Z'exas, on the first day of January, 1976, was 13, 983. 961 acres; and, WHEREAS, the population of the City of Paris, Paris, Texas, is in excess of 5, 000 and less than 25, 000 inhabitants; and, WHEREAS, the above described territory lies within the extra- territorial jurisdiction of the City of Paris, Paris, Texas; and, ~ WHEREAS, the above described territory lies adjacent to and adjoins the City of Paris, Paris, Texas; and, WHEREAS, the above described territory contains 12.247 acres, more or less, which when added to other property annexed in the year 1976 is less than ten per cent (lOJ) of the present acreage contained in the corporate limits of the City of Paris, Texas; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF ?HE CITY OF PARIS: Section 1. Section 2. The above described territory and area so annexed shall be a part of the City of Paris, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Paris, Paris, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Paris, Paris, Texas. Section 3. It is hereby declared to be the intention of the City Council of the City of Paris that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional or invalid by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality or in- validity shall not affect any of the remaining phrases, clauses, sen- tences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any unconstitutional or invalid phrases, clauses, sentences, paragraphs or sections. It is further hereby declared to be the intention of the City Council of the City of Paris to exclude any area or areas described in the description of the property to be annexed, which are not within the City's jurisdiction to annex and that , such area or areas should be carved out of the description of the property herein described by the valid judgment or decree of any court of competent jurisdiction, in order that such area or areas would not cause this annexation ordinance to be found to be invalid, voidable or void. ' Section 4. lhis ordinance shall be published and passed in the manner provided in Article II, Section 7, of the Charter of the City of Paris, Paris, Texas.
