A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, APPROVING AND AUTHORIZING THE EXECUTION OF CONTRACT CHANGE ORDER NOTICE NO. 1 FOR PUBLIC HEALTH SERVICES, TDH DOCUMENT NO. 7560022067-2005 (ATTACHMENT NO. Ol IMMLTNIZATION DIVISION - LOCALS); MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the State of Texas is a funding partner with the County of Lamar and the City of Paris for the Paris-Lamar County Health Department; and, WHEREAS, the Contract for Public Health Services, Contract Change Notice No. 1,TDH Document No. 7560022067-2005 (Attachment No. 01) Immunization Division - Locals, is the conduit through which the state funds are received; and, WHEREAS, it is appropriate that the form of said Contract Change Notice No. 1, attached hereto as Exhibit A, be approved, and that the City Manager be authorized to execute the same on behalf of the City of Paris, which is the authorized contracting entity for the performing agency, the Paris-Lamar County Health Department; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COLTNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the forms of the Contract for Public Health Services, Contract Change Notice No. 1TDH Document No. 7560022067-2005 (Attachment No. 01) Immunization Division - Locals, attached hereto as Exhibit A, be, and the same is hereby, approved. Section 3. That the City Manager be, and he is hereby, authorized and directed to execute, on behalf of the City of Paris, which is the authorized contracting entity for the performing agency, the Paris-Lamar County Health Department, the Contract for Public Health Services, Contract Change Notice No. 01, under the terms and conditions and in the form shown in Exhibit A, attached hereto. The notifications ir►ay be automated or manual and may consist of mail or telephone contacts. i PERFORMING AGENCY shall complete 100 0 of annual assessments in sub- contracted entities and WIC clinics using the A sessment, Feedback, Incentives, and eXchange (AFIX) methodology as assi ed by RECEIVING AGENCY. PERFORMING AGENCY shall submit asse sment results to RECEIVING AGENCY Program within two (2) weeks after completion. PERFORMING AGENCY will perform the following a~plicable required activities: 1. By December 31, 2004, PERFORMING A~ENCY will implement a plan to improve vaccine coverage levels. ~ J 2. During 2004, PERFORNIING AGENCY !will work with the local WIC agencies for referral of under-vaccinated WI~ enrollees. 3. By December 31, 2004, PERFORMING A~ENCY will ensure that expired, wasted, and unaccounted for vaccines do I not exceed 5% for DTaP, Hib, hepatitis B, IPV, MNIlZ, PCV7, and varicell~ vaccines. 4. By December 31, 2004, PERFORNIINO AGENCY will decrease the proportion of duplicate records or questio~able matches in ImmTrac by a minimum of 5%. ~ ; 5. By December 31, 2004, PERFORMINAGENCY will increase the percentage of children less than six Years of~age participating in ImmTrac by a minimum of 5%. 6. By December 31, 2004, PERFORMING AOENCY will increase the number of registered provider sites for ImmTrac by ~ minimum of 5%. ; 7. By December 31, 2004, PERFORMING~ AGENCY will increase TVFC provider enrollment by a minimum of 5%. 8. In addition, PERFORMING AGENCY shall comply with the following paragraphs: PERFORNiING AGENCY is authorized to payl employees who are not exempt under the Fair Labor Standards Act (FLSA), 29 tJSC, Chapter 8, §201 et seq., for overtime or compensatory time at the rate of time and one-half per FLSA. PERFORMING AGENCY is authorized to pay ~mployees who are exempt under FLSA on a straight time basis for work perfortned on a holiday or for regular compensatory time hours when the taking of regi4ar compensatory time off would be disruptive to normal business operations. ` Authorization for payment under this provision is limited to work directly related to immunization activities and shall be in accordance with the amount budgeted in this contract Attachment. PERFORMING AbENCY shall document proper authorization or approval for any work perfoi'med by exempt or non-exempt employees in excess of forty (40) hours per work week.
