05-F Annex Pet-Final-Hills IV FORM H:ATTORNEY\JANICE\CURRENT RES\Annex by Petition Res July 28, 2004 RESOLUTION NO. _______________ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, GRANTING A PETITION FOR ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 13.635 ACRES, MORE OR LESS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Paris is in receipt of a Petition for Annexation for the annexation of certain territory consisting of 13.635 acres, more or less; and, WHEREAS, the City Council finds and determines that the petition was signed by all of the qualified voters residing or owning property in the area requested to be annexed in compliance with Section 6 of the Charter of the City of Paris; and, WHEREAS, the City Council further finds and determines that the property requested to be annexed into the city of Paris is one-half mile or less in width, is contiguous to the existing city limit line, and is vacant and without residents or has fewer than three (3) qualified voters who reside on the property, in compliance with Section 43.028 of the Local Government Code; and, WHEREAS, the City Council further finds and determines that the petition is in proper form and in all things complies with the requirements of Section 43.028(c) of the Local Government Code and the applicable provisions of the City Charter; and, WHEREAS, the City Council further finds and determines that, in accordance with Section 43.028(d) of the Local Government Code, a hearing on the petition was had before the City Council after the 5th day but on or before the 30th day after the date the petition was filed with the City Clerk in order to hear the petition and the arguments for and against the annexation; and, WHEREAS, after hearing such petition and the arguments for and against the same, the City Council deems it appropriate to grant such petition to annex said territory into the city of Paris, NOW, THEREFORE, Texas; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the Petition for Annexation, a copy of which is attached hereto and for all purposes incorporated herein, for the annexation of the following described property, to wit: Being all that certain tract of land situated in Lamar County, Texas, a part of the Wesley Askins Survey, Abstract No. 7, a part of the 100.00 acre tract of land conveyed to D. Wayne Brown, et al., by deed recorded in Volume 939, Page 31 of the Lamar County Real Property Records, and a part of the 121.76 acre tract of land conveyed to D. Wayne Brown, et al., by deed recorded in Volume 949, Page 296 of the Lamar County Real Property Records, and being further described as follows: BEGINNING at an iron pin found at the Northeasterly corner of Lot 17, Block B, of The Hills Phase III as recorded in Envelope No. 371-C of the Lamar County Plat Records; THENCE South 58° 32' 57" West a distance of 411.55 feet to an iron pin found for corner at the most Northwesterly corner of Lot 20, Block B, of said The Hills Phase III, said pin being in the Northeast R.O.W. of North Hills Drive; THENCE South 53° 54' 04" West a distance of 60.10 feet to an iron pin found for corner at the most Northeasterly corner of Lot 1, Block E, of said The Hills Phase III, said pin being in the Southwest R.O.W. of said North Hills Drive; THENCE South 51° 05' 37" West, a distance of 511.48 feet to an iron pin found for corner at the most Northerly corner of Lot 6, Block E, of said The Hills Phase III, said pin being the most Westerly corner of Lot 5, Block E, of said The Hills Phase III; THENCE South 54° 54' 28" West a distance of 300.67 feet to an iron pin found for corner at the most Northerly corner of Lot 9, Block E, of The Hills Phase II as recorded in Envelope No. 364-D of the Lamar County Plat Records, said pin being the most Westerly corner of Lot 8, Block E, of said The Hills Phase III; THENCE South 51° 05' 37" West a distance of 208.93 feet to an iron pin set for corner at the most Westerly corner of Lot 10, Block E, of said The Hills Phase II, rd said pin being in the Northeast R.O.W. of 33 Street N.E.; THENCE North 44° 12'46" West a distance of 58.31 feet to an iron pin set rd for corner in the Northeast R.O.W. of said 33 Street N.E.; THENCE South 45° 47' 14" West a distance of 294.24 feet to an iron pin found for corner at the most Westerly corner of Lot 2, Block K, of said The Hills Phase II, said pin being in the Northeast line of Lot 8, Block K, of said The Hills Phase II; THENCE North 58° 36'30" West a distance of 203.47 feet to an iron pin found for corner at the most Northerly corner of said Lot 8; THENCE South 71° 29'59" West a distance of 75.88 feet to an iron pin set for corner in the most Northerly line of said Lot 8; THENCE North 45° 47'14" East a distance of 363.20 feet to an iron pin set for corner; THENCE North 44° 12'46" West a distance of 26.67 feet to an iron pin set for corner; THENCE around a curve to the right having a radius of 741.20 feet long, chord bears North 43° 11'45" West a distance of 41.10 feet, an arc distance of 41.11 feet to an iron pin set for corner; THENCE North 51° 05'37" East a distance of 1299.36 feet to an iron pin set for corner; THENCE South 89° 02'43" East a distance of 150.82 feet to an iron pin set for corner; THENCE South 64° 08'23" East a distance of 364.46 feet to the point of beginning and containing 13.635 acres of land, be, and the same is hereby, granted. Section 3. That this resolution shall be effective from and after its date of passage.
