A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, RESCINDING ITS PRIOR ACTION AND REPEALING RESOLUTION NO. 2002-157, PASSED OCTOBER 10, 2002, WHICH APPROVED AND RATIFIED THE EXECUTION OF AN APPLICATION FOR A TEXAS PARKS AND WILDLIFE DEPARTMENT NATIONAL RECREATION TRAILS GRANT AND AUTHORIZED THE ACCEPTANCE OF SAID GRANT; AUTHORIZING THE NOTIFICATION OF THE TEXAS PARKS AND WILDLIFE DEPARTMENT AS TO THE CITY' S INTENTION NOT TO PARTICIPATE IN THAT PROJECT DESIGNATED THE LAKE CROOK TRAILS PROJECT; AUTHORIZING THE EXECUTION OF ANY AND ALL DOCUMENTS NECESSARY FOR RESCISSION AND RETURN OF SAID GRANT; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Paris, Paris, Texas, previously ratified a grant application and authorized the acceptance of the grant for that project designated the Lake Crook Trails Project, said project to have a total cost of $102,050.00, with $81,640.00 to be provided by said grant from the Texas Parks and Wildlife Department through the National Recreational Trails Grants Program, and $20,410.00 to be provided by the City of Paris in the form of matching funds; and, WHEREAS, the aforesaid project has not begun and no grant funds have been expended; and, WHEREAS, the City Council of the City of Paris finds and determines that in consideration of current budgetary restraints for fiscal year 2004-2005, the expenditure of the City's matching grant funds for the aforesaid project would not be in the best interest of the City of Paris; and, WHEREAS, as a consequence, the City Council desires to take appropriate action to rescind acceptance of the aforesaid grant and repeal the resolution in support thereof, and advise the Texas Parks and Wildlife Department accordingly; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COLTNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That City Council Resolution No. 2002-157, passed and approved October 10, 2002, which approved and ratified the execution of an application for and authorized the acceptance of a Texas Parks and Wildlife Department National Recreational Trails Grant in support of that project known as the Lake Crook Trails Project, be and is hereby in all things repealed, and the aforesaid acceptance of said grant by the City of Paris shall be and is hereby in a11 things rescinded, due to consideration of current budgetary restraints for the City's fiscal year 2004-2005. Section 3. That the Texas Parks and Wildlife Department sha11 be notified by the City Manager or his designee that due to and in consideration of severe budgetary restrictions for fiscal year 2004-2005 and potentially beyond, the City Council deems it not in the best interest of the City of Paris to proceed with the aforesaid Lake Crook Trails Project which included a City match of $20,410.00. Section 4. That the Texas Parks and Wildlife Department be notified on behalf of the City Council as to the Council's sincere appreciation for the consideration by the Department in determining that the City was qualified for the aforesaid grant, with the sincere hope that when budgetary conditions improve, the Department will continue, as it has in the past, to consider favorably future projects of the City of Paris for similar grant funding. Section 5. That this resolution shall be effective from and after its date of passage. PASSED AND APPROVED this 13' day of September, 2004.
