09-H Assistant Police ChiefDRAFT H:\JANICE\ORDWORK\ASSISTANT CHIEF ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, AMENDING ARTICLE I TO CHAPTER 26 OF THE CODE OF ORDINANCES OF THE CITY OF PARIS TO ADOPT A NEW SECTION 26-2 THERETO, AUTHORIZING THE CHIEF OF POLICE OF THE CITY OF PARIS, IN ACCORDANCE WITH SECTION 143.014 OF THE LOCAL GOVERNMENT CODE, TO APPOINT THE ASSISTANT CHIEF OF POLICE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Chapter 143, at Section 143.014 of the Loca1 Government Code (the Civil Service Act), provides a process whereby the governing body of a municipality whose police department is subject to the provisions of Chapter 143 of the Local Government Code, may authorize the Chief of Police to appoint that person occupying an authorized position in the classification immediately below that of Chief of Police, in accordance with the aforesaid Section 143.014; and WHEREAS, the prerequisites for a department being eligible for such authorization under Section 143.014 with regard to the City of Paris Police Department have in all things been satisfied; and WHEREAS, the classification in the City of Paris Police Department immediately below that of Chief of Police is Assistant Chief of Police; and WHEREAS, the City Council of the City of Paris desires to authorize the Chief of Police to appoint the individual to fill the classification position of Assistant Chief of Police as provided in Section 143.014; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COLTNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That there is hereby adopted a new Section 26-2 to Chapter 26, Article I of the Code of Ordinances of the City of Paris, said Section 26-2 to be entitled "Appointment of assistant chief of police" and to read as follows: "Section 26-2 Appointment of assistant chief of police. In accordance with Chapter 143 of the Texas Local Government Code, Section 143.014, the Chief of Police of the City of Paris sha11, in accordance with the aforesaid Civil Service Law, appoint the individual within the Police Department to serve as Assistant Chief of Police. " Section 3. That this ordinance shall be effective from and after its date of passage. PASSED AND APPROVED this 13' day of September, 2004.
