MINUTES OF THE REGULAR MEETING OF THE PLANNI G AND
ZONING COMMISSION
AUGUST 2, 2004
The Planning and Zoning Commission met Monday, August 2, 004, 5:30
P.M., Love Civic Center, 2025 S. Collegiate, Paris, Texas with the following
members present:

The meeting was called to order by Reeves Hayter.

The minutes from the (July 6, 2004) meeting were approv d with a
motion by Carl Lucas, seconded by Brad Archer. Motion ca ried by a
vote of 7 ayes and 0 nays.
Barbara Forrest is now present at the meeting.

Public Hearing to consider the petition of Jim and Sandra L ssiter for
a change in zoning from a One-Family Dwelling District No. (SF-2) to
a Two-Family Dwelling District (2F) on Lot 17, City Block 25 -A, being
located at 224 25th Street NE.
The public hearing was declared open.
Jim Lassiter, 725 42nd SE, spoke in favor of the petition stati g that he
had a rental house on the property that recently burned, in aYe Mr.
Lassiter is requesting zoning on the property for a dup ex. The
property right behind him, that adjoins his property on th east side
(the back of his property), has 2 duplexes on it. There re other
duplexes in the area around Mr. Lassiter's property. Mr Lassiter

stated that the duplexes would increase the tax base. The co t to build
the duplex is approximately $58,000 to $60,000 dollars. M . Lassiter
stated that none of the neighbors that he has contacted have problem
with a nice new brick structure being built on the property.
There was no opposition, the public hearing was declared c osed.

Motion was made to approve the petition by Benny Plata, se onded by

Arvin Starrett, 629 Church Street, Historic Preservation C mmission
Chairman, spoke in favor of the petition stating that the Com issioners
looked at this district long and hard and there were revisi ns over a
period of time. A public hearing was held earlier this year nd later a
neighborhood meeting was held in order to answer quesf ons or get
input from citizens with regard to the district and then held he second
formal public hearing with results which were forwar ed to the
Planning and Zoning Commission. The nine members and lternates

of the Commission were unanimous in their decision, six of hose nine
members are property owners within the district.
Troy Elliot, 643 Church Street, new resident in the district, tated that
he bought his house in the area for 2 reasons, (1) for his tori purposes
to teach his son a lesson about the value of his street an (2) as an
investment for himself and other members of his family. r. Elliot
stated that he doesn't quite know what he is doing but t ust those
people that he knows on the historic commission to lead him i the right
direction.
Sue Lancaster, who owns a historic house on S. Church spo e in favor
of the petition stating that when KPB was started and hey were
cleaning S. Church and one of the properties was a very di apidated,
historic home that was in very, very bad condition. Many embers of
the group that was cleaning stated that the house should be t rn down.
There was something that said "don't pull me down, I'm pa of Paris
history." Ms. Lancaster contacted the man who bought the house from
the family who had lived there since 1887 (the Kirpatrick Fa ily). Ms.
Lancaster stated that she purchased the house, much to her husbands
alarm, and began to work on it. They worked on the house ~ r 3 years.
There is a world of history in that house, a lot of it is being onated to
the museum, some of it has gone to Holy Cross because t at family
attended Holy Cross. Three generations grew up in the hou e. Elnita
Kirpatrick was a reporter for the Dinner Bell which was the ~ rerunner
of the Paris News. Ms. Kirpatrick wrote about the Paris Fir from her
front steps, that house did not burn. All of her neighbors cross the
street burned and then it jumped over and got the other nd of her
Church Street. It was a real labor of love to restore the ho se and it
would have been so easy to have been torn down and a lot f history
would have been lost. We have a real unique opportunity he e with all
the historic buildings. Weare sixth in the State of Texas of having
historic buildings but they are dropping at an alarming ate. Ms.

Lancaster would like to see the buildings covered with t e Historic
Overlay.
Linda Vandever, 540 21st Street NE, spoke in favor of t e petition
stating that she would like to own a historic home but feels ike at this
time she is not in a position to properly maintain one. She is interested
in preserving the history of Paris and properties in Paris. M ny homes
in Paris were destroyed by the great fire of 1916 and 0 hers that
survived that disaster were later torn down in the name 0 progress.
Some still in restorable condition while others were beyond repair. A
prime example of needless destruction of one of the fines homes in
Paris, one previously owned by the House Family, was tor down on
Clarksville Street several years ago to build the Williamsbur Shopping
Center. The areas of South Main and South Church are one of the few
areas left in Paris with a concentrated group of historic h meso The
others are scattered throughout the city and are rapidly det riorating.
Over the last few years Ms. Vandever has visited several cities and
towns that have historic designations and the value of tho e cities is
indescribable. Ms. Vandever would like avoid the destructi n and the
defacing of property that adds so much to the rich history 0 this city.
Linda Ridder, Executive Director of Paris Living C mmunity
Development Corporation, spoke in favor of the petition sting that
part of their mission is to revitalize the neighborhoods of owntown
Paris and is dedicated to doing so in a style that is ae thetically
compatible with the architecture of the area. The homes hav a vintage
look and the colors are appropriate for the area. Ms. Ridd r came to
Paris two years ago for her interview and while driving arou d noticed
a lot of deterioration and thought that this was going to be a big job.
One of the things that helped her to take on the task was dri ing down
South Church and Main and seeing some of the beautiful ho es there.
Ms. Ridder stated that she saw those "diamonds." Paris Liv ng hosted
a meeting in June to provide residents the opportunity to alk about

historic designations and to get their questions answered. uring the
meeting Ms. Ridder heard some of the residents say "this i fringes on
our personal rights", or we have already spent a lot of time nd money
preserving our homes so why do we need to be told now hat to do.
Paris Living owns property on both SW 1st Street and Churc Street as
well as in some of the areas that are on streets that will ev ntually be
covered by the overlay of this historic district. Ms. Ridde feels that
historical preservation is a good tool for economic de elopment,
providing outside dollars in the form of tourism, for exampl . Historic
preservation is much more than that, it is much more than th se dollars
that we will gain, it is about being good stewards of hat past
generations have left for us. It is about providing a way, means to
preserving that history for future generations. On beha f of Paris
Living's Board and those future generations, Ms. Ridder urged the
Commission to pass the historic designation.
A.W. Clem spoke in favor of the petition stating that severa years ago
they were considering what to do with their law firm. One de ision that
was made was to buy the old Texas Hotel from Margie Bell nd spend
a pot full of money on restoring it. Mr. Clem stated that hey could
have gutted the building, made it contemporary, put a false ront on it
but they really had faith in this community. Mr. Clem rem mbers the
homes on Clarksville and Church Street, how beautiful they ere. Mr.
Clem and others bought several buildings downtown and in ested a lot
because they really believed the downtown area is going to b a "spiffy
place" if the Planning and Zoning Commission does what it i supposed
to do.
Pike Burkhart, 524 Church, spoke in favor of the petition sating that
he thinks Mr. Clem had many good points. Ms. Burkhart's ouse was
built in 1869 and he probably would not have bought the ho se had he
not felt like the City of Paris was headed in the right direction.

that area. Mr. Burkhart is chairman of the Keep Paris Be utiful with
thirty board members and over 200 members on the com ittee and
their vote is unanimous for the historic designation. eep Paris
Beautiful has been in existence for 4 years and the prima aims is to
see that the Historic Overlay District be put in place. It is e sential for
the well being of the community to get this done.
Ann Wyche, Church Street, spoke in favor of the petition tating that
she has lived there for 12 years and when she moved here s e thought
that Paris had some of the nicest people of any town that s e has ever
lived in. Also, Ms. Wyche stated that Paris has done the orst job in
preserving their historical areas of any town that she has ver seen.
Ms. Wyche stated that when she moved here, there was a be utiful park
with beautiful large trees across the street from St. Joseph s Hospital.
There was a letter to the editor regarding the park stating hat a large
grocery chain was wanting to come in and build there. Th lady who
wrote the article was present at the meeting. The letter sa d, "do you
remember why 3 Oaks Shopping Center was named 3 Oaks' and if you
drive by there today you will have no idea why it was na ed 3 Oaks
because there is not an oak tree left. "I hate to see that ha pen to our
historic districts."
Louise Hagood, 556 Fitzhugh Avenue, spoke in favor of t e petition
stating that Fitzhugh and Pinebluff has been designated as historic
districts. Ms. Hagood stated that her husband's grandpar nts bought
the property where 3 Oaks Shopping Center is and the bought it
simply because there were 3 Oaks there. Ms. Hagood stat d that she
previously went to a meeting and there were pros and cons. Ms.
Hagood wanted the cons to be considered because they have ears of the
historic designation, fearing that property taxes will be ra sed. Their
fears are not founded in fact or truth. Maintenance does ot increase
taxes. The cons also, fear the committee themselves, th y fear the
committee is going to say you have got to do so and so. The ons should

be asking what can you do for us, not what are you going t make me
do. Ms. Hagood stated that visitors have come in fro England,
Norway, The Netherlands, Mississippi, Michigan, and lots of parts of
Texas and they always say tell us where your beautiful his oric homes
are so that we may see the beauty of this city that dates fro 1844. Ms.
Hagood stated that the Commission has the power to recom end to the
city the acceptance of this historic district so that it can co tinue to be
beautiful and to prosper.
Susy Harper, 545 Johnson Woods, spoke in favor of the peti ion stating
that she has been attending all the historic preservation me tings. Ms.
Harper states that the commission asks is for cer ificates of
appropriateness to be presented. Since last October, 32 ce ificates of
appropriateness have been submitted and approved, actuall , none have
been denied. Members of the commission have been really elpful and
people have taken their advice.
Kelly Wickersham, 574 Church Street, stating that he as there to
speak against the misguided attempt to control privat property.
Saving our historic landmarks is a noble goal but t rough the
implementation of these over bearing regulations that go gainst our
basic ideas concerned with private property rights. People re already
taking care of these houses without this ordinance being in place. Mr.
Wickersham and his family moved out of his home and r stored and
repaired the interior. Mr. Wickersham stated that the pr ponents of
the ordinance stated that they already have laws pertaini g to zoning
and environmental land management, these are well deft ed statues
that contain clear objectives pertaining to health and s fety. This
ordinance is not clear or objective and is not relevant t health or
safety. The ordinance presumes to deny or grant permiss on slips for
everything from ordinary maintenance to setting up swi g sets from
weekend landscaping projects to hanging a basketball go lover your
garage. Ms. Wickersham stated that the Ordinance 2002- 33, Section

157, Paragraph C, takes a sledge hammer to home owners ip rights.
Mr. Wickersham stated that this section covers all exterior structures
in your yard from the dog house to the outhouse. Mr. ickersham
stated that if this just a commission that they are trying to ~ rm just to
give advice then why does Section 7-164 back up this law wi h a $2,000
a day fine and a separate misdemeanor fine charge per da to anyone
who refuses to go along with it. This ordinance discrimina es against
the poor and elderly who cannot afford these restrictive m intenance
requirements. In other cities people have been forced t sell their
homes that they have lived in for most of their lives.
Margie Bell, 624 Church, has lived there since 1940, spoke gainst the
petition stating that this is not the proper way to go about hat we are
trying to do. Ms. Bell stated that they are all trying to p eserve the
history of Paris and trying to preserve their homes. Ms. Bell stated that
downtown has lost several businesses and if we are doing s ch a good
job of historical preservation, then where did these people g to? What
businesses have replaced them? What is the historical sig ificance of
well over half the homes in the designated areas. You have h me values
from 0, and some should be bull dozed, to a few houses worth over $150,
000. The homes in the area are not homogeneous, they vary greatly, in
age, size, architecture, and certainly in value. The trul historical
homes on Church and Main are owned by responsible peopl who have
successfully maintained them to the best of their abilities a d finances
and it is an insult to the intelligence and capabilities of thes owners to
give the control of their homes to a committee no matte how well
intentioned those members are. Ms. Bell stated they will be equired to
pay for the improvements that they may not even like. Ms. Bell stated
that 1st Street is not suited for this designation.

The question was asked of the people for the petition, how any lives
in the area, Winnona Carpenter, 618 S. Main, stated that she lives in the
area as well as several raised their hands.
Melissa Wickersham, Kelly Wickersham's wife, spoke gainst the
petition stating that she is Margie Bell's granddaughter and t is like the
Bell family against the rest of Church Street. Ms. Wickers am stated
that she grew up on Church Street, goes to church on Ch rch Street
and she know lives on Church Street. Ms. Wickersham i proud of
what they have accomplished. Ms. Wickersham stated that their
neighborhood is improving with or without historic prese ation.
There was no further opposition, the public hearing w s declared
closed.

Benny Plata asked Arvin Starrett ifhe were to own a house nd wanted
to change the color of the trim and went through the commis ion, could
the commission stop him from changing the trim.
Mr. Starrett stated that the Ordinance states that if you re aint your
house or reroof your house or do repairs to your house an keep it in
the condition that it is currently in, the commission has no hing to do
with that. A certificate of appropriateness would be requir d and that'
is issued out of the historic preservation office. Only in th event of a
change in color or materials does it come across to the co mission to
help in that decision. If it involves less than 25% of the vis al area of
the house then it can still be issued from City Hall ithout the
commission making the decision. In one instance, there w re certain
colors that were approved but the commission let the prop rty owner
know that they did not think that it was the most appropr ate for the
building that they were about to paint. They got their ap roval and
went and painted it their colors. The next meeting they w re back at
the commission saying we want to apply again, help us with ur colors.
The commission have looked at 33 applications and only has been
denied, it is in litigation. Ms. Starrett stated that what the do is put
people in contact with contractors or materials that actuall save them
money in the long run. Mr. Starrett stated that there are gr nt monies
that are available for historic properties that have loc I historic
designations. State and national designations do not trigge those

monies, local designations trigger those monies. The overl y will help
to protect the district so that people will do the rieht thine.
Carl Lucas asked for clarification of a point that he has been hearing on
the streets, he asked if people would be forced to do somethi g, to repair
their house.
Mr. Starrett stated that there is nothing in the ordinance hat would
require a property owner to do anything but it requires a c rtificate of
appropriateness to be necessary when they intend to do w rk on their
property. It does not require them to do the work.
The question was asked, if they cannot stop you from doing nything to
your home then why Section 7-164? If it is just advice, w yare there
criminal aspects in the ordinance?
Mr. Starrett stated that the fines in the ordinance are set y the State
of Texas for your commission, they are simply zoning requir d fines and
the ordinances states up to $2,000 and it is his understand ng that the
Judge in our local city has never assessed a fine nearing that agnitude.
Ms. Bell asked why was nothing done about some of the hou e on South
Main that have been in the process of being redone for 3 ears? Ms.
Bell stated that one of these houses belong to Mr. Malone.
Chairman Hayter asked for everyone who is opposed to thi ordinance
to stand. Seven people stood up.
Motion was made to approve as Historic Overlay District No.2 (HD)
by Brad Archer, seconded by Carl Lucas. Motion carried y a vote of
7 ayes and 1 nay (Russell McCain).

Public hearing to consider the petition of the Historic P eservation
Commission for a changê in zoning to intludê a Risto it Ovêrlay
District No.4 (HD) on Part of Lot 12, City Block 52, bein located at
714 Graham Street.
The public hearing was declared open.
Mr. Starrett stated that the property is owned by a property owner who
has left the city and the city cannot find the person. The roperty is
being vandalized.
Chairman Hayter asked how this stand alone designation ould work.
Mr. Starrett stated that the significance that the local design tion would
give to that stand alone property is the same to any of t e districts.
Future owners of that property would have access to funds for
restoration, etc. It also would be sure that we save the st ucture for
generations to come. If we lose it, it is gone, it is one of and.
Chairman Hayter asked if this and the following structure savable.
Mr. Starrett answered, yes. The commission reviews a list 0 properties
that comes from the Building and Standards Commission. inety-five
percent, the commission says to take them out because t ey are not
savable but the properties that are savable, this Commissi n wants to
look after.
Mr. Kent asked if the property came up for sale, wo ld it be a
hindrance.
Mr. Starrett stated that it would be an aid in finalizing th sale. The
property would be worth more to the buyer. Mr. Starrett stated that
historic designations increase property values.

Marshall Kent asked, what if the present owner comes back t town and
he is not pleased with the home being part of this plan, he on't have
to make any improvements on it but he is going to follow the guidelines
if he does.
Mr. Starrett stated that only if that person were to desire t keep that
property in the condition that it is in now, to keep the roof r paired, to
keep paint on the property, to keep the windows painted-it c uld simply
go on like it is. With the designation, it gives the property ower outlets
down the road for help and then when someone comes alon and says,
"I want to restore this property,"-then we have saved a Par.s treasure.
Sue Lancaster spoke in favor of the petition stating that s e and her
husband became aware of the home and some of its history ates back
to 1892. It was a magnificent home in its time. The hous has been
vandalized and she and her husband boarded up the ack. Ms.
Lancaster stated that the house is a solid house. Before the wner left,
the house was rewired and replumbed. Ms. Lancaster stat d that she
has been talking with some people in the area about turni g it into a
Community Center or a place for Girl Scouts, possibly a Bla Museum
was mentioned. It would be a shame and a loss for Paris fo the house
not to get its designation and protection.
No opposition, the public hearing was declared closed.

Motion was made to approve as Historic Overlay District No 4 (HD) by
Bobby Myers, seconded by Brad Archer. Motion carried a vote of
7 ayes and 1 nay (Russell McCain).

The public hearing was declared open.
Arvin Starrett spoke in favor of the petition stating that this s a Second
Empire French Style home, the last remaining example of his type of
architecture in Lamar County and one of the few remainin examples
in this part of the State of Texas. It is probably one 0 the most
important structures in the City of Paris. Mr. Starrett enc uraged the
passing of the designation with the understand of the com ission that
it is with the blessing of the property owner.

Arvin Starrett spoke in favor of the petition stating that the E rly Home
is a very important pre-fire structure for the City of Paris. he owner,
Linda, petitioned the commission at their hearing for this d signation.
Jim Wright, 805 20th SE, spoke in favor of the petition stati g that this
house is really important to his neighborhood, it is good for t e rats, the
squirrels, the birds, the cats, the cats live off the rats-he w uld like to
see it preserved for that reason. It is unoccupied 90% of th time.
Arvin Starrett stated that this structure has been submitted t the Texas
Historical Commission as one of the 13 most endangered pr perties in
the City of Paris which would enable property owner financial
assistance.

District No.6 (HD) on Lot 3, City Block 248-B, being loca ed at 1970
Clarksville Street.

Arvin Starrett spoke in favor of the petition stating that th s property
has already been named a State Historic Landmark an is on the
National Registry of Historic Places, one of the treasurers 0 the church
did appear at the hearing that the commission conducte and had
questions and the commission unanimously passed the desi nation for
this lot.
Lisa Wright, Director of Community Development for the C tyofParis,
stated that elders of the church came to her office and pick d up some
information from her and said that after they had met they ecided that
they supported this designation.

Church. This is a very noted building in the comm nity, not
structurally occupied.
The owner of Grand Oxygen Supply spoke in opposif n to the
designation stating that whatever they do at this property wil not affect
him directly but sooner or later they will get around to his pr pertyand
that is when it will affect him. He is trying to paint his bu iness now
and he does not want to paint it and cause these peo Ie drastic
problems.
There was no further opposition, the public hearing wa declared
closed.
