RECOMMENDED MOTION:
Request from property owners to disannex approximately 386 acres located in an area East of U.S. 271
North, North of NLISD Property and West of Stillhouse Road (see attached map).
POLICY ISSUE(S):
Disannexation
BACKGROUND:
Staff seeks City Council direction on the disannexation request (see attached request). The request that
was submitted was not signed by all of the property owners. The two property owners who did not sign
the request own Sterling House (6.5 ac.) and Christian Fellowship Church (4 ac.). The area described by
the petition is the same legal description used by the City of Paris to annex the property on Apri126th,
1999. This area was annexed by the City of Paris prior to September l, 1999, the date the State
Legislature passed new Annexation laws requiring municipalities to prepare service plans and
committing to full infrastructure development in the annexed area within a 2.5 year period.
Petitioner states in bullet point number 3 of his petition that the land should be disannexed because the
City has not provided municipal services to the area, but in reality the city has provided water and sewer
services to tracts in that area as they have developed Police, Fire and EMS services have been provided
to entire annexed area since April 26, 1999 (date of annexation).
Attached is a spread sheet that shows the properties included in the legal description that list the area,
market value and taxes paid. The majority of the taxes paid in the area are paid by Sterling House.
These ad valarem taxes are used to fund the general fund, not the water and sewer fund.
Staff recommends that the entire area/developed and undeveloped acreage remain inside the City limits.
When developed these areas will have a significant impact on the City's tax base. If these areas are
disannexed the City of Paris will have no control over zoning and what is built in these areas.

Pursuatlt to Section 43.141 of the Teaas Local Governinent Code, the undersigned
petitione.rs file tllis petition for disannexation. and in support show as follows:
1. Tlie petitionel-s signiiig this petition below t-epresent a majority of ihe qualified voters in
the Stillhouse Road area (Tl•act l l), which was annexed by the City of Paris, Texas on or about
April 26, 1999.
2. On April 26, 1999, pursuant to Ordinance No. 99-034, the city of Paris, Texas passed an
ordinance an ordinance annexing the Stillhouse Road area (Tract 1]).
3. The City of Paris, "I,exas has failed or refuses to provide services or cause services to be
provided to the Stillhouse Road area (Tract 11) within the two aud one-half year period specified
by Sectioii 43.056 of the Texas Local Government Codc (or the service plan prepared 1or the area
under Section 43.056 of the Texas Local Government Code).
4. Pursuant to Section 43. ] 41 (b) of the Texas Local Government Code, petitioners there-
fore request the disannexation of the Stillhouse Road area ("Tract 1 1) froni the City of Paris.
5. The Stillhouse Road area ("lract 11) is legally described as follows:
BEGINNING at a point in the existing Paris city limit line as described in Tract 3 of
Ordinance No. 97-059, said point being in the west right-of-way line of US Hwy 271 North and
the north right-of=way line of County Road 31700;
THENCE East a distance of 7,432.445 fcet, more or less, to a point in the west right-of-
way lii1e of County Road 41100 (StillhoL►se Road);
THENCE along the west boundary line of County Road 41100 (Stillhouse Road) as
follows: South 02 Deg. 50 Min. 41 Sec. West a distance of 304.756 leet, more or less; South 18
Deg. 32 Min. 02 Sec. West a distance of 164.1431 feet, niore or less; South 33 Deg. 51 Min. 45
Sec. West a distance of 743.873 feet, more or less; South 38 Deg. 12 Min. 18 Sec. West a
distance of 973.094 feet, more or less; South 53 Deg. 58 Min. 14 Sec. West a distance of
2,504.014 feet, more or less; South 42 Deg. 15 Min. 45 Sec. West a distance of 315.296 feet,
moi-e or less, to a point, said point being in the intersection of the west boundary line of a 31.6]
acre tract of land owned by the North Lamar Independent Scliool Dist1-ict;

THEREFnRF, pursuant to Section 43.141 of the Texas Local Government Code,
petitioners request that the City of Paris, Texas disailnex the Stillllouse Road al•ea (Tract 11) so
that it is no longer part of the City of Paris, Texas.
