07 Council Min 1-24-05.wpd REGULAR MEETING OF THE CITY COUNCIL, CITY OF PARIS January 24, 2005 1. The City Council of the City of Paris met in regular session at 6:00 P. M., Monday, January 24, 2005 at the Love Civic Center, 2025 South Collegiate Drive, Paris, Texas. Present: Mayor: Curtis Fendley Council Members: Jim Bell, Mary Ann Fisher, Jay Guest. Karen Wilkerson, Rick Poston City Staff: City Manager Tony N. Williams, City Attorney Larry W. Schenk, Asst. City Clerk Sherian Dixon, Finance Director Gene Anderson Absent: Councilman: Don Wilson 2. Mayor Fendley called for consideration of and action on the following ordinance: A. ORDINANCE NO. 2005-005: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING ARTICLE I TO CHAPTER 17, HEALTH, OF THE CODE OF ORDINANCES OF THE CITY OF PARIS, TO ADD A NEW SECTION 17-6 THERETO ESTABLISHING A PERMIT FEE FOR INSPECTING SEPTIC SYSTEMS AND SIMILAR SANITATION SYSTEMS PERFORMED BY THE LAMAR COUNTY SANITARIAN; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. City Manager Williams said that would be changing the fee from $75.00 to $250.00, which would bring our fee more up to date and comparable with other entities. Councilman Bell - Motion to approve. RESOLUTION NO. 2005-011 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, APPOINTING ZENETTA FULBRIGHT AS A MEMBER OF THE FIRE FIGHTERS’ AND POLICE OFFICERS’ CIVIL SERVICE COMMISSION OF THE CITY OF PARIS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATED. Mayor Fendley indicated this item had been tabled at the January 10, 2005 Council meeting and would need a motion to bring it from the table. Councilman Guest - motion to bring from table. RESOLUTION NO. 2005-012 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, AUTHORIZING THE EXECUTION OF A PURCHASE ORDER FOR ONE (1) AMBULANCE THROUGH THE TEXAS LOCAL GOVERNMENT PURCHASING COOPERATIVE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. Mayor Fendley related that this item had also been tabled at the January City Council meeting and would require a motion to bring it from the table. Councilman Bell - motion to bring from table. Regular Meeting of the City Council January 24, 2005 Page 3 City Manager Williams said that they would be going through the Texas Local Government Purchasing Cooperative and the ambulance would cost $90181.00. He said this was already in the budget. Councilwoman Wilkerson - motion to approve. Councilman Guest - second. Motion carried 6 ayes, 0 nays. C. RESOLUTION NO. 2005-013 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, AWARDING THE BID AND AUTHORIZING THE EXECUTION OF A CONTRACT FOR THE CONSTRUCTION OF A PARKING LOT ON A PORTION OF THE PARIS SANTA FE-FRISCO DEPOT PROPERTY TO BE USED JOINTLY BY THE CHAMBER AND PATRONS OF HERITAGE PARK; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. Mayor Fendley called the Council’s attention to the bid tabulation sheets attached to the ordinance and explained that Drake Construction was the lowest bidder. Councilman Guest - motion to approve. Councilwoman Wilkerson - second. Motion carried 6 ayes, 0 nays. D. RESOLUTION NO.2005-014 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, APPROVING AND AUTHORIZING A NEW CITY OF PARIS PERSONNEL POLICIES HANDBOOK; REPEALING ALL PRIOR PERSONNEL POLICIES HANDBOOKS; REPEALING ALL OTHER RESOLUTIONS OR POLICIES IN CONFLICT THEREWITH; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. Mayor Fendley reminded Council that they had requested amendments, Regular Meeting of the City Council January 24, 2005 Page 4 which were reviewed at the last meeting and have been made, and an addendum about the dress code will be added. Councilman Bell - Motion to approve. Councilwoman Wilkerson - second. Motion carried 6 ayes, 0 nays. E. RESOLUTION NO. 2005-015 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, APPROVING AND DESIGNATING A CITY CLERK AS RECOMMENDED BY THE CITY MANAGER IN CONFORMANCE WITH SECTIONS 23 AND 26 OF THE CITY OF PARIS CHARTER; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. Mayor Fendley said the recommendation was for Janice Ellis. Councilman Bell - motion to approve. Councilwoman Fisher - second. Motion carried 6 ayes, 0 nays. F. RESOLUTION NO. 2005-016 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, APPROVING THE CITY MANAGER’S APPOINTMENT OF A CITY LIBRARY DIRECTOR; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. Mayor Fendley indicated that the appointment was for Priscilla McAnally. Councilwoman Wilkerson - motion to approve. Councilman Poston - second. Motion carried 6 ayes, 0 nays. 4. Mayor Fendley called for discussion and consideration of and possible direction to staff regarding the problem of drainage areas around the City. Regular Meeting of the City Council January 24, 2005 Page 5 Councilman Bell had pictures of areas in Morningside, where there are drainage problems. Several other problem areas in the City were discussed. Mayor Fendley asked City Engineer Shawn Napier if he had a master plan for dealing with drainage problems in the City. Mr. Napier said the top priority was for people who were getting water in their house. City Manager Williams suggested that he get with Mr. Napier to get his recommendations as to the worst drainage problems and then, they could come up with a plan of dealing with and financing those. Councilman Guest asked to see the minutes of the Drainage Sub-Committee meetings held several years ago. Councilman Bell asked for a record of how the money allotted for the drainage problems was spent. 5. There were no future agenda items mentioned. City Attorney Schenk noted that there were some Eagle Scouts present in the audience for their Citizenship Award. Councilman Bell said he and Mr. Schenk have the privilege of working with the Eagle Scouts and one of the requirements for the Eagle Badge is to attend a public meeting. Council recognized Will Henderson of Troop2, who was working on his Eagle and First Classman, and Micah Halbert of Troop 2, who was working on his Attendance. The scouts said their sponsor was Mike Taylor. There were no referrals.
