MINUTES OF THE REGULAR MEETING OF THE PLANNING AND
ZONING COMMISSION
MARCH 7, 2005
The Planning and Zoning Commission met Monday, March 7,2005,5:30,
Lamar County Fairgrounds, Westside Building, 570 E. Center Street,
Paris, Texas with the following members present:
1. Reeves Hayter
2. Barbara Forrest
3. Brad Archer
4. Carl Lucas
5. Benny Plata
6. Bobby L. Myers
Lisa Wright, the Director of Community Development, was also present.

The meeting was called to order by Reeves Hayter at 5:30 p.m.
2.
The minutes from the February 7,2005, meeting were approved with
~ motion by Bobby Myers, seconded by Brad Archer. Motion carried
by a vote of 6 ayes and 0 nays.
3.
Public Hearing to consider the petition of Mitzi Rader for a change
in zoning from an Agriculture District (A) to a One-Family Dwelling
District No.2 (SF -2) on Part of the Wesley Askins Survey and
Mathias Click Survey, being located south of FM 195 and west of
36th Street NE.
This item was tabled at the January 3, 2005. Motion was made by
Bobby Myers to remove from the table, seconded by Carl Lucas.
Motion carried by a vote of 6 ayes and 0 nays.
The public hearing was declared open.
A.W. Clem, attorney representing Mitzi Rader, stated that the
proposed subdivision will complement the area and create tax
revenue for the City of Paris, which is very much needed. Initially the
subdivision will be small and later expand into a larger subdivision.

Shannon Pasternak, 3610 Brownwood, spoke in opposition to the
petition stating that she is concerned with traffic and also where the
outlets would be-it is hard to get out now. Mrs. Pasternak is
concerned with traffic patterns and restrictions for the subdivision.
There was no further opposition, the public hearing was declared
closed.

Motion was made to approve the petition by Bobby Myers, seconded
by Benny Plata. Motion carried by a vote of 6 ayes and 0 nays.

Public Hearing to consider the petition of James and Tennie Wooten
for a change in zoning from a One-Family Dwelling District No.2
(SF-2) to a Neighborhood Service District (NS) With Specific Use
Permit (28) Mortuary or Funeral Parlor on Lots 16 and 17, Block 4
of the Mayer Addition, being located at 235 32nd Street N. W.
The public hearing was declared open.
James Wooten, who owns a funeral home in Clarksville, Texas, spoke
in favor of the petition stating that he is trying to purchase the church
to turn into a funeral home. The property is not on the tax roll now
but if turned into a funeral home, it will be. Mr. Wooten stated that
there is parking in the rear and the church next to this location has
been approached to share their parking lot, although they have not
agreed yet.

Judy Thielman, 270 32nd Street NW, who has lived at this location
for 20 years, stated there is not adequate parking to accommodate a
funeral and cars will line the street.
Kenneth Posey, 220 32nd Street NW, spoke in opposition to the
petition stating that he purchased his property because of the
neighborhood. He wants to see his child grow up in a happy place,
and with a funeral home there, he would see the hearse and people
going into the funeral home. Mr. Posey stated that there would be
noise from the policemen escorting the funeral. Mr. Posey presented
a petition with 26 signatures in opposition. A funeral service is not
needed in the neighborhood-there will be more people, more
crime-not every funeral is a good thing, sometimes there are
murders, crime, and disgruntled families.
Liz Nichols, 139 32nd Street NW, spoke in opposition to the petition
stating that she is a single parent and her son has to spend time alone
at home. Along with security issues, there is not enough parking and
with the bus thoroughfare, funeral traffic would be a problem.
Alvin Cole, 280 32nd Street NW, spoke in opposition to the petition
stating that he has lived at this location for 40 years and it is quiet.
He does not want a funeral home in the neighborhood. The traffic
would be bad with the funeral home and the school up the street.
Lisa Wright, Director of Colnmunity Development, advised the
Commission that she had certified 12 of the signatures on the petition,
which was more than the necessary 200/0 needed. She explained to the
Commission that this meant the City Council would need a 3/4 vote
to approve the zoning even if the P&Z recommended approval.
There was no further opposition, the public hearing was declared
closed.

Consideration of and action on the petition of James and Tennie
Wooten for a change in zoning from a One-Family Dwelling District
No.2 (SF-2) to a Neighborhood Service District (NS) With Specific
Use Permit (28) Mortuary or Funeral Parlor on Lots 16 and 17, Block
4 of the Mayer Addition, being located at 235 32nd Street N. W.
Motion was made to deny the petition by Benny Plata, seconded by
Reeves Hayter. Motion carried by a vote of 6 ayes and 0 nays.

Public Hearing to consider the petition of Cody Woodard for a
change in zoning from an Agricultural District (A) to a General Retail
District (GR) on a one (1) acre tract which is a part of the John
Skidmore Survey, Abstract No. 889, being located on FM 1508.
The public hearing was declared open.
Cody Woodard spoke in favor of the petition stating that he wants to
build a beauty shop for his wife at this location. The shop would be
30' x 30' with a front porch and an asphalt parking lot. Only his wife
and maybe 1 more operator would work in the shop.
Peggy Worthy Wilson spoke in opposition to the request. She stated
that she purchased her mother and dad's home place across from this
property. This is already a high traffic area~ Ms. Wilson stated the
area has always been an open area and she would rather see a home
built there. She is afraid that it would not be a beauty shop for long
and something else would open up there.
Todd Worthy spoke in opposition to the petition stating that if you
put in retail now, it will hurt the future growth of homes in the area.

Motion was made to approve by Benny Plata, seconded by Carl
Lucas. Motion carried by a vote of 6 ayes and 0 nays.
9.
Consideration of and action on the Master Plat of Pecan Place.
A.W. Clem, on behalf of the Raders, stated regarding Item No.6 on
the memo from the City Engineer that this is a problem because the
developers do not own the property to FM 195, therefore, it is
impossible to do.
Mr. Hayter stated that it is not impossible but it would cost money.
Barney Bray inquired whether the City could condemn the property
for the street, and Mr. Plata stated he felt the City Council should
contribute to the cost of the street.
Motion was made to deny the plat by Brad Archer, seconded by Carl
Lucas. Motion carried by a vote of 6 ayes and 0 nays.
10. Consideration of and action on the Preliminary Plat of Pecan Place,
Phase I.
Motion was made to deny the plat by Benny Plata, seconded by Carl
Lucas. Motion carried by a vote of 6 ayes and 0 nays.
11. Consideration of and action on the Final Plat of Lot 1, Block A of the
Tractor Supply Addition, being located at 2035 Spur 139.
Motion was made to approve by Carl Lucas, seconded by Bobby
Myers, subject to the City Engineer's Memo dated, February 21,
2005. Motion carried by a vote of 6 ayes and 0 nays.

12.
Consideration of and possible action on amendments to the Future
Land Use Map, which is a part of the Comprehensive Plan, as it
relates to the southwest quadrant of Paris.
Lisa Wright introduced Barbara Wilson as a representative of the
Historic Preservation Commission who would be on hand to answer
any questions they might have concerning areas designated historic.
Mrs. Wilson pointed out that the Wise House was listed as a public
park. She inquired as to the Commission's thoughts on the central
area. Mr. Hayter explained that there had been discussion on
whether to leave central area on the map or simply recommend a
specific use, such as retail. Mrs. Wilson said she was concerned about
the uses which were permitted in the central area, and Mr. Hayter
stated that this was an issue that could be handled once the actual
zoning ordinance was looked at.
Motion was made to table by Carl Lucas, seconded by Benny Plata.
Motion carried by a vote of 6 ayes and 0 nays.

were approved with a motion by Carl Lucas, seconded by Bobby
Myers. Motion carried by a vote of 7 ayes and 0 nays.

Public Hearing to consider the petition of Brad Drake for a change in
zoning from a Commercial District (C) to a Light Industrial District
(LI) on Lot 27-A, City Block 251, being located at 205 Loop 286 NW.
The public hearing was declared open. There was no one present to
speak for or against the petition. The public hearing was declared
closed.

Consideration of and action on the petition of Brad Drake for a
change in zoning from a Commercial District{C) to a Light Industrial
District (LI) on Lot 27 -A, City Block 251, being located at 205 Loop
286 NW.
The petitioner was not present, and no other people were present for
the public hearing to speak for or against the zoning change, and the

Commission discussed whether they should bring the item from the
table. Carl Lucas reminded the Commission that, in the past, it had
been their practice to deny zoning requests when the petitioner failed
to appear twice in a row. The Commission agreed.
Motion was made to remove the item from the table by Bobby Myers,
seconded by Carl Lucas. Motion carried by a vote of 6 ayes and 1
nay.
Motion was made to deny the petition by Brad Archer, seconded by
Bobby Myers. Motion carried by a vote of 6 ayes and 1 nay.
5.
Consideration of and action on the Replat of the Northwest Paris
Industrial Park.
Reeves Hayter was excused from consideration of this item. Gary
Vest of the Paris Economic Development Corporation was present
and reported to the Commission that work was complete and that two
lots had been sold. He told the Commission he had met with the City
Engineer regarding his recommendations and that many were
. already completed and the remainder could be completed within a
week.
Motion was made to approve by Carl Lucas, seconded by Bobby
Myers, subject to the City Engineer's Memo dated, February 7,2005.
Motion carried by a vote of 7 ayes and 0 nays.
Reeves Hayter returned and assumed the chair.

Consideration of and possible action on revisions to the future land
use categories on the Comprehensive Plan.

Brad Archer stated that the more general the plan is, the better it will
be and it will last longer. Reeves Hayter handed out pages 45 and 46
from the Comprehensive Plan with appropriate zoning written in.
The Commission agreed that "Planned Development" was too broad
a category to list on the map since there were several types of planned
development, such as residential, commercial, etc., and believed it was
better to specify a use from which a type of planned development
could be selected. The Commission questi9ned what "Central Area"
use was and whether it would be better to specify a more specific use
such as retail or commercial in the location known as the Central
Area versus having a zoning classification called Central Area.
Motion was made by Carl Lucas, seconded by Bobby Myers to
remove from the categories of future land use "Long-Term
Development" and "Planned Development," to combine "Retail,"
"Office," and "Commercial" categories into one, and to combine all
"Residential" categories into one. Motion carried by a vote of 7 ayes
and 0 nays.

The following zoning change requests will be presented at the March 7,2005, meeting of the
Planning and Zoning Commission for its consideration:
1.
Mitzi Rader is requesting that the property which is Part of the Wesley Askins Survey and
Mathias Click Survey, being located south of FM 195 and west of 36th Street N.E., be
rezoned from an Agriculture District (A) to a One-Family Dwelling District No.2 (SF-2) for
the purpose of establishing a housing development. The Comprehensive Plan recommends
that this area be zoned residential; therefore, this request is consistent with the Plan.
2.
James and Tennie Wooten are requesting that the property located on Lots 16 and 17, Block
4 of the Mayer Addition, being located at 235 32nd Street N.W., be rezoned from a One-
Family Dwelling District No.2 (SF-2) to a Neighborhood Service District (NS) With
Specific Use Permit (28) Mortuary or Funeral Parlor. The Comprehensive Plan recommends
that this area be zoned residential; therefore, a request to zone these lot Neighborhood
Service is consistent with the Plan.
3.
Cody Woodard is requesting that a one (1) acre tract of land, which is a part of the John
Skidmore Survey, Abstract No. 889, being located on F.M. 1508, be rezoned from an
Agricultural District (A) to a General Retail District (GR). The Comprehensive Plan
recommends that this area be zoned Light Industrial (LI).

Pecan Place Master Plat
I have reviewed the master plat of the above referenced addition. I recommend denial of the
master plat based on the items listed below.
1. Eliminate Milan St. or Chantelle Drive, the street should only have one name.
2. Provide data for all of the curves and angles at all of the intersections.
3. Provide the channel widths on the open ditch flumes.
4. Revise block letters and lot numbers to show the construction phases.
5. The water lines should be looped as the subdivision is developed. The water lines should
be looped to F .M. 195 and to Oak Creek Subdivision.
6. A direct access is needed onto F.11. 195 froin this proposed subdivision. It should be a
collector level roadway (39-feet back to back width).

Pecan Place Addition Phase 1
I have reviewed the preliminary plat of the above referenced addition. It appears that the
preliminary plat complies with the City of Paris subdivision regulations with the following
exception
1. Show the storm water flow patterns along 36th N.E. and Clement road, show the capacity
of the two 30-inch pipes (upstream and downstream flow line elevation and length)
flowing into Brownwood Subdivision and the size and slope of the channel downstream
of 36th St. Northeast through Brownwood.
2. Show the coefficient, intensities and time of concentration on all drainage data.
3. Change Block D to Block C, this will create a Block A, B and C in Phase I.
4. Provide data on the Oak Creek lift Station. Provide elevations of the existing gravity pipe
into the lift station and the proposed pipe elevation for Phase I.
5. Show the required off site easements required to sewer Phase I into the Oak Creek lift
Station. This will include a portion of the proposed Rene Drive and N.E. 34th St.
6. Block D, Lot 1 will need to sewer to the proposed sewer line on the West side ofN.E.
36th Street or removed from Phase I.
7. Please revise the following items in the general notes: under 1. change 34th St. to 36th St.
and under 6. change streets to Right-of-Ways.
8. Provide construction plans to the Engineering Department.
9. I recommend that the curb and gutter variance requested on Clement road and 36th St.
N .E. not be granted. The intersection of 34th St. N .E. and Clement road should be
regraded to allow water to flow down curb and gutter and! or storm sewer and inlets if
necessary .
I recommend approval of the preliminary plat upon completion of the above items.

Tractor Supply Addition Final Plat
I have reviewed the final plat of the above referenced addition. It appears that the fmal plat
complies with the City of Paris subdivision regulations with the following exception.
1. Change the scale of the drawing on sheet 2 of2 to I-inch equals lOO-feet.
2. Please add the word "EASEMENT" to the title of the curve table and line table on sheet 1
of2.
3. The fire hydrant and associated water line have moved west. Please revise the drawing to
show the existing fire hydrant and water line in the middle of the IS-foot utility easement.
4. Please add. a certificate of guarantee of workmanship and materials used in the
construction and installation of water mains, sanitary sewer mains and street paving for a
period of one (1) year from the date of acceptance of the final plat. The certificate shall
be executed by the developer and owner or owners and by all other parties who have a
mortgage or lien interest in the property or subdivision.
s. Remove the tax certificate from the plat and submit an actual statement from the Lamar
County Appraisal District that all taxes and fees have been paid.
6. Remove the Acceptance Certificate for the City Manager.
7. Submit a list of any deed restrictions for the subdivision.
I recommend approval of the final plat upon completion of the above items.
