RESOLUTION NO.
A RESO L UTI ON OF THE CITY CO UN CIL OF THE CITY OF PARIS,
PARIS, TEXAS, DECLARING CERTAIN PERSONAL PROPERTY
SURPLUS; APPROVING AN AUCTIONEER SERVICE AGREEMENT;
MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE
SUBJECT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the several departments of the City of Paris have furnished the list of personal
property, attached hereto as Exhibit A, which no longer serves a useful purpose for the City of Paris
and its operation, and it would be appropriate that said personal property be declared surplus
property; and,
WHEREAS, it would be appropriate to dispose of said surplus property by auction duly
advertised and conducted in conjunction with a larger such auction conducted for Lamar County and
various area school districts by CLC Auction Services, 7915 Hwy 82 East, Blossom, Texas, Texas
Auctioneer License Number 15039, which firm has heretofore been approved for use by State of
Texas agencies; and,
WHEREAS the form of the Auctioneer Service Agreement, attached hereto as Exhibit B,
should, in all things, be approved, and the Mayor should be authorized to execute the same; NOW,
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in all things
approved.
Section 2. That the personal property described in Exhibit A, attached hereto, be, and the
same is hereby, declared to be surplus property of the City of Paris, and the same may be disposed
in accordance with the laws of the State of Texas and the Charter of the City of Paris.
Section 3. That the form of the Auctioneer Service Agreement with CLC Auction Services,
attached hereto as Exhibit B, be, and the same is hereby, approved.
Section 4. That the Mayor be, and he is hereby, authorized and directed to execute, on behalf
of the City of Paris, the Auctioneer Service Agreement with CLC Auction Services, under the terms
and conditions and in the form shown in Exhibit B, attached hereto.
Section 5. That this resolution shall be effective from and after its date of passage.

AUCTIONEER SERVICE AGREEMENT
This agreement is entered into by CLC AUCTION SERVICES, hereinafter referred
to as Auctioneer, of Paris, Texas, and the CITY OF PARIS, PARIS, TEXAS, hereinafter
referred to as Owner, under the following terms and conditions:
1. Auctioneer agrees to conduct a public auction sale or to otherwise sell the property
described in Exhibit A, attached hereto, belonging to Owner. The auction sale to be
conducted at 7915 Hwy 82 East, Blossom, Texas, beginning on the 25th day of June,
2005. Owner agrees to turn over and deliver to Auctioneer the listed items.
2.
Owner will furnish Inventory (Exhibit A) attached to this contract.
3. Auctioneer agrees to prepare all advertising material and publicity necessary to
properly advertise and promote the attendance of buyers at no cost to Owner. Auctioneer
agrees to perform all services and conduct the auction in compliance with Auctioneer's
Proposal for Services presented to Lamar County, a copy of which is appended hereto as
Exhibit B and incorporated herein for all purposes.
4. All items will sell without reserves to the highest bidder with the exception of items
specified in writing to be protected. No item shall be sold or withdrawn from sale prior
to auction except by mutual agreement of the parties. Owner agrees that all items are
free of liens and has a clear title to all items requiring a title.
5. Owner agrees to pay Auctioneer for the services rendered by Auctioneer a
commission of ten percent (100/0) of the total income from all sales of Owner's property
made at public auction.
6. This agreement shall be binding upon the parties for a period offorty-five (45) days
after the execution hereof.

CtC Auction Services is licensed by the state of Texas and is capable of going anywhere
in Texas or Oklahoma to conduct an auction with a full experienced staff including a
certified appraiser. We have a large extensive man list that we mail to for our auctions.
We use black and white and full-color brochures. We use extra large brochures for our
store ttont bang ups' to catch mo,re attention and we also use a smaller size to lay out on
store counters. We cover a wide area with our hang ups and layouts. We nm ads in
several different papers. We do all the work from advertising, setting up the auction"
everything on auction day, cleanup, and the final paper work. We do most of the work to
ease the sellers work load. CLC Auction Services has a regular monthly auction that you
can seU items in if they miss the designated auction date. CLC Auction Services is
located on a main Highway in a highly visible area. We are set up as an indoor or outdoor
auction. We have indoor seatin,gt a drive thru, restrooms, concessions, and a forklift for
unloading and loading.
CLC Auction Services has conducted many auctions for other people~ auctions such as
estates, business seHouts and repo's for banks.
Enclosed in this folder are some brochures of a few auctions CLC Auction. Services has
conducted and letters of recommendation.

#2 We will set up the auction & make ready, take care of everything during the auction~
and take care of UIÙoading & load out & clean up after auction. We will take care of all
the advertising, sign up registration for bidders to buy, we will take in the money~ keep
up with what items sell for, & all the final paper work.
#3 We arc capable of selling items throughout the year that miss the designated auction
date at one of our monthly auction sales whether it be equipment, vehicle~ or furniture &
appliances.
#4 We have a forklift for unloading & loading, we have all the items needed for bidders
registration & payout, we have lot tags & stickers, bid cards, clerk sheets, checkout
receipts, a copier, a po.rtapotty if needed & we also provide food & drinks.
##5 All buyers must register with Auction Company in order to bid or buy. All bidders &
buyers must have a valid drivers license in order to register, upon registration bidder will
be given a buyers nwnber and Auction Company will keep bidders & buyers address,
drivers license number & buyers number on file.
N6 AU buyers must pay for merchandise before buyer & items leave premises. Payments
must be paid for by cash, cashiers check, company check, or personal check, but no
temporary checks or credit cards. If buying for resale buyer .must have a copy of his resale
tax exemption fonn.
#7 Auction items will be set out in an order that auction company feels will bring the
best results for the seller. Each lot or item will be given a lot number and inventory will
be taken and a representative of Lamar County Auditor's Office is more than welcome to
help or supervise.
During the sale the clerk wil1 record the activi.ties of the sale with what each lot or item
brings on a three pan: carbon copy in. which Lamar County, the Auction Co.mpany and
the buyer will receive a copy.

#9 CLC Auctio.n Services advertises in many different papers and also. hangs up flyers in
many places and layout flyers en many counters. We also. have a large extensive mail1ist
that we mail out flyers to..
Advertisements we use are -
Shoppers Edge, (They cover a large area in stands and mail out as well).
American Classifieds (They cover a very large area in stands)
Dollar Saver Shopper (They cover a large area in stMds and mail out as well).

TIlese four advertising agencies do. real well for us, however our best results come fTom
our mail outs of about 1500 people and our flyers that we put out allover Paris, SuJphur
Springs, Shennan, T cxarkana , Mt. Pleasant & all the little towns between these towns
& Paris.
#10 Lamar County shall be responsible for getting items to the auction site.
Lamar County can turn titles over to auction company and let auction company turn titles
over to customer or Lamar County can turn titles over to customer whi.cbever they would
like, however auction company would like to have all titles held for ten banking days if
possible.
