CITY COUNCIL AGENDA
Notice is hereby given that the City Council of the City of Paris shall meet in regular session
at 5:30 p.m. on Monday, February 27, 2012. The meeting will be held at the City Council
Chamber, 107 E. Kaufman Street, in Paris, Texas. The matters to be discussed and acted
upon are as follows:
Opening Agenda
1. Call meeting to order.
2. Invocation.
3. Pledge of Allegiance.
4. Citizens' forum.
(Persons desiring to address the Council must limit their presentation to no more than two minutes. Unless
an item is posted on the Agenda, the Texas Open Meetings Act prohibits the Council from responding to
any comments other than to refer the matter to a future agenda, to an existing policy, or to a staff person
with specific factual information. Claims against the City, Council Members, or employees, as well as
individual personnel appeals are not appropriate for citizens' forum.)
Consent Agenda
Items on the Consent Agenda are approved by a single action of the Council, with such approval applicable
to all items appearing on the Consent Agenda. A Council Member may request any item to be removed
from the Consent Agenda and considered as a separate item.
5. Deliberate and act on the approval of minutes from the meetings on January 23, 2012;
January 27, 2012; and February 6, 2012.
6. Receive and deliberate on reports and/or minutes from the following boards,
commissions, and committees:
a. Paris Public Library Advisory Board (11-16-2011; 12-14-2011; and 1-17-2012)
b. Historic Preservation Commission (12-14-2011 and 1-11-2012)
c. Planning and Zoning Commission (1-3-2012)
d. City Council Task Force on Substandard Structures (2-2-2012)
e. Traffic Commission (10-4-2011)
7. Deliberate on January monthly financial report.
8. Deliberate on January drainage ditch maintenance report.
9. Deliberate on dilapidated structure report.
10. Deliberate on possible future amendments to the City of Paris Charter.
11. Deliberate and act on a Resolution authorizing a Professional Services Agreement with
the American Red Cross, Lamar County Chapter to perform certain specialized services
to the City of Paris and its citizens; and authorizing the City Manager to negotiate and
execute all necessary documents.
12. Deliberate and act on a Resolution authorizing a Professional Services Agreement with
the Lamar County Historical Society to perform certain specialized services to the City of
Paris and its citizens; and authorizing the City Manager to negotiate and execute all
necessary documents.
13. Deliberate and act on a Resolution authorizing a Professional Services Agreement with
the Children's Advocacy Center to perform certain specialized services to the City of
Paris and its citizens; and authorizing the City Manager to negotiate and execute all
necessary documents.
14. Deliberate and act on a Resolution authorizing a Professional Services Agreement with
the East Texas Council on Alcohol and Drugs to perform certain specialized services to
the City of Paris and its citizens; and authorizing the City Manager to negotiate and
execute all necessary documents.
15. Deliberate and act on a Resolution authorizing a Professional Services Agreement with
the CASA For Kids to perform certain specialized services to the City of Paris and its
citizens; and authorizing the City Manager to negotiate and execute all necessary
documents.
16. Deliberate and act on a Resolution authorizing a Professional Services Agreement with
the Lamar County Human Resources Council to perform certain specialized services to
the City of Paris and its citizens; and authorizing the City Manager to negotiate and
execute all necessary documents.
17. Deliberate and act on a Resolution authorizing a Professional Services Agreement with
Shelter Agencies for Families in East Texas, Inc. to perform certain specialized services
to the City of Paris and its citizens; and authorizing the City Manager to negotiate and
execute all necessary documents.
18. Deliberate and act on a Resolution authorizing a Professional Services Agreement with
Models of the Maker to perform certain specialized services to the City of Paris and its
citizens; and authorizing the City Manager to negotiate and execute all necessary
documents.
Regular Agenda
19. Public hearing, first reading, deliberate and possibly act on an Ordinance approving the
site plan for Richard B. Rooney on Lot 1, Block A, Water Tower Place CB 258 Addition,
located at 625 25th Street N.E.
20. First reading, deliberate and possibly act on an Ordinance establishing a construction
speed on State Loop 286 in the corporate limits of Paris, Lamar County, Texas, during
the Texas Department of Transportation's Construction Project STP2011(701)SB; fixing
penalties for violation thereof, and declaring an emergency.
21. Presentation on Bywaters Park landscape.
22. Update on the progress of the City Council Task Force on Substandard Structures.
23. Report on code requirements for testing of natural gas systems and requirement of
pressure test, deliberate and provide direction to staff for possible new policy for pressure
testing.
24. Deliberate and act on creation of a city planner position.
25. Deliberate on the 2012-2013 Budget and provide direction to City Staff.
26. Deliberate and act on a Resolution suspending the March 6, 2012, effective date of
Atmos energy Corp., Mid-Tex Division ("Atmos Mid-Tex") requested rate change to
permit the City time to study the request and to establish reasonable rates; approving
cooperation with Atmos Cities Steering Committee (ACSC") and other cities in the
Atmos Mid-Tex Service Area to hire legal and consulting services and to negotiate with
the Company and direct any necessary litigation and appeals; requiring reimbursement of
Cities' rate case expenses; finding that the meeting at which this Resolution is passed
open to the public as required by law; requiring notice of this Resolution to the Company
and ACSC's legal counsel.
27. Deliberate and act on a Resolution accepting the bid of Paris Iron & Metal to purchase
from the City scrap meters, brass, copper and miscellaneous scrap metal.
28. Deliberate and act on a Resolution approving a hangar lease assignment from Bill Boothe
to Magnum Performance, Inc.
29. Deliberate and provide direction to City Staff on the possible expansion of the remaining
portion of a two lane road on S. Collegiate Drive between Clarksville Street and Jefferson
Road and a second entry into the Police and Court Building from S. Collegiate Drive.
30. First reading, deliberate and possibly act on an Ordinance adding Article VI, Hire Paris
First, to Chapter 2, Administration, of the City of Paris, Texas Code of Ordinances,
relating to Local Contracting Preferences; containing findings and other provisions
relating to the foregoing subject; providing a repealer clause, a severability clause, a
savings clause; and declaring an effective date.
31. Deliberate on funding for the Clarksville Street Sidewalk Project; and provide direction
to City Staff.
32. Deliberate on re-evaluation of placing the 4B Sales Tax Option on the May 12, 2012 City
Ballot; and provide direction to City Staff.
33. First reading, deliberate and possibly act on an Ordinance declaring support for funding a
portion of the right-of-way acquisition costs and utility relocation costs for upgrading and
widening State Highway 24 from the City of Cooper, Texas to the Delta-Hunt County
line in an amount of $1,450,000.00.
34. Deliberate and possibly act on a Resolution approving an Interlocal Cooperative
Agreement between the Sulphur River Regional Mobility Authority (SURRMA), Delta
County, Texas, Lamar County, Texas, City of Paris, Texas, City of Cooper, Texas and
the Paris Economic Development Corporation related to the funding a portion of the cost
of widening a 10.4 mile segment of Texas Highway 24 and approving a State
Infrastructure Bank loan between the Texas Department of Transportation and
SURRMA.
35. Convene into Executive Session:
• Pursuant to Section 551.071 of the Texas Government Code, Consultation with
Attorney, to receive legal advice from the City attorney about pending or
contemplated litigation and/or on matters in which the duty of an attorney to his
client under the Texas Disciplinary Rules of Professional Conduct of the State Bar
of Texas clearly conflicts with this chapter, to-wit:
➢ SURRMA Project;
➢ Cecelia Kane vs. Paris Lamar County Health Board and Anthony Bethel,
Directors of Paris Lamar County Health Department; in the 62nd Judicial
District Court; Cause No. 81106.
• Pursuant to Section 551.074 of the Texas Government Code, to deliberate the
appointment, employment, evaluation, reassignment, duties, discipline, or
dismissal of a public officer or employee as follows: review applications and
conduct interview of candidates for the position of City Manager.
36. Reconvene into open session and possibly take action on those matters discussed in
Executive Session.
37. Consider and approve future events for City Council and/or City Staff pursuant to
Resolution No. 2004-081.
38. Adjournment.
