06-A 34th NE & Loop 286 DRAFT h F:ATTORNEY\RESWORK\CURRENT\ 34 Street NE Crossover Res June 8, 2005 RESOLUTION NO. __________ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, APPROVING AND AUTHORIZING A REQUEST TO THE TEXAS DEPARTMENT OF TRANSPORTATION TO CLOSE THE TH EXISTING CROSSOVER IN THE IMMEDIATE VICINITY OF 34 STREET NE ON US 82/US 271 (WHICH IS ALSO LOCALLY KNOWN AS LOOP 286) AS A PART OF ITS GRADE SEPARATION OF US 82/ US 271 AT PINE MILL ROAD PROJECT; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Intermodal Surface Transportation and Efficiency Act of 1991 (ISTEA) st and the Transportation Equity Act for the 21 Century (TEA-21) codified under Title 23 U.S. Code Section 101 et seq. authorize transportation programs to meet challenges of protecting and enhancing communities, and advancing the nation’s economic growth and competitiveness; and WHEREAS, the Texas Department of Transportation (TxDOT) has received federal Hazard Elimination Safety (HES) Program funding under these Acts to construct a grade separation along US 82 / US 271 (which is also locally known as Loop 286) at Pine Mill Road, within the City of Paris; and WHEREAS, TxDOT has prepared design work for the construction of said grade separation; and WHEREAS, the proposed alignments of the travel lanes of US 82 / US 271 and the access ramps on the north end of the proposed grade separation facility all converge in the th immediate vicinity of the existing 34 Street NE crossover on US 82 / US 271; and WHEREAS, this proposed convergence of alignments in the immediate vicinity of the th existing 34 Street NE crossover on US 82 / US 271 will become a great safety concern for all traffic in this area due to the potential of crossing traffic conflicting with merging and through traffic in a relatively short distance; and WHEREAS, both Pine Mill Street (the location of the proposed grade separation project) th and 34 Street NE (the location of the expected safety concern should this crossover remain open) are on the City of Paris’ roadway system; and WHEREAS, TxDOT has asked the City of Paris to evaluate the need to retain the th existing 34 Street NE crossover on US 82 / US 271, given the previously-cited proposed grade separation safety concerns at this crossover, and then to make recommendations to TxDOT regarding the future operation of said crossover. WHEREAS, the City Manager of the City of Paris and his staff have studied the issues related to the proposed grade separation project on US 82 / US 271 at Pine Mill Road, and the potential safety concerns that will occur due to cross traffic conflicts with merging and through traffic on US 82 / US 271 at this crossover location, and hereby recommend that the existing th crossover on US 82 / US 271 at 34 Street NE be closed by TxDOT as a part of its grade NOW, THEREFORE, separation of US 82 / US 271 at Pine Mill Road project; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the City Council of the City of Paris concurs with the recommendations of the City Manager of the City of Paris and his staff, and hereby instructs the Paris City th Manager to formally request that TxDOT close the existing crossover at 34 Street NE on US 82 / US 271 (which is also locally known as Loop 286) as a part of its grade separation of US 82 / US 271 at Pine Mill Road project. Section 3. That this resolution shall be effective from and after its date of passage.
