MINUTES OF THE SPECIAL MEETING OF THE PLANNING AND
ZONING COMMISSION
JUNE 6, 2005
The Planning and Zoning Commission met Monday, June 6, 2005, 5:30,
Lamar County Fairgrounds, Westside Building, 570 E. Center Street,
Paris, Texas with the following members present:
1. Reeves Hayter
2. Marshall Kent
3. Carl Lucas
4. Barbara Forrest
5. Bobby L. Myers
6. Russell McCain
7. Benny Plata
Lisa Wright, Director of Community Development, was also present.

The meeting was called to order by Chairman Reeves Hayter.
2.
Approval of minutes from previous meetings. (April 25, 2005, Special
Joint Meeting; May 2,2005, Regular Meeting; May 16,2005, Special
Meeting; May 23, 2005, Special Joint Meeting) Motion was made to
approve the minutes by Bobby Myers, seconded by Carl Lucas.
Motion carried by a vote of 7 ayes and 0 nays.
3.
Public Hearing to consider the petition of Mitch 'Wofford for a change
in zoning from a One-Family Dwelling District No.3 (SF -3) to a One-
Family Dwelling District No.3 (SF -3) With Specific Use Permit (39)
Mobile Home on Lot 3, City Block 234, being number 1631 W.
Henderson.
The public hearing was declared open.
Mitch Wofford, 1631 W. Henderson, spoke in favor of the petition
stating that he wants to put in a mobile home behind his house. The
house on the property is not level, the ground has sunken down so low
that it has busted a gas line. Mr. Wofford stated that he cannot get

approve the minutes by Marshall Kent, seconded by Brad Archer.
Motion carried by a vote of 6 ayes and 0 nays.
3.
Public Hearing to consider the petition of Clay Yates for a change in
zoning from a Light Industrial District (LI) to a One-Family Dwelling
District No.2 (SF-2) on Part of Lot 4, City Block 188-A, being
number 1345 8th Street S.E.
The public hearing was declared open.
Clay Yates' sister, Ms. Calhoun, 1115 NW 16th Street, spoke in favor
or the petition stating that their parents want to build a house on this
property. There is no house currently on the property. Mr. Yates'
parents presently live at 1427 SE 8th Street. Mr. Yates wants to build
on the vacant lot that they own instead of tearing the down the house
where they are currently living.
There was no opposition, the public hearing was declared closed.

Consideration of and action on the petition of Clay Yates for a change

Motion was made to approve by Carl Lucas, seconded by Bobby
Myers. Motion carried 6 ayes and 0 nays.
5.
Public Hearing to consider the site plan approval requested by Todd
Stephens, on Lot 13C, City Block 259, located on North Collegiate
Drive.
Motion was made to bring this item from the table by Bobby Myers,
seconded by Brad Archer. Motion carried by a vote of 6 ayes and 0
nays.
The public hearing was declared open.
Todd Stephens, 2910 Meandering Way, requested an approval on the
site plan. Mr. Stephens stated that he will contain water on his
property so that it does not drain onto the neighbors property.
There was no opposition, the public hearing was declared closed.
6.
Consideration of and action on the site plan approval requested by
Todd Stephens, on Lot 13C, City Block 259, located on North
Collegiate Drive.
Motion was made to approve the site plan request by Brad Archer,
seconded by Carl Lucas, subject to the City Engineer's Memo dated
June 29, 2005, and with the stipulation that water at the Southwest
corner be re-routed or otherwise so that it will not run onto the
adjoining property. Motion carried 6 ayes and 0 nays.

Consideration of and action on the Preliminary Plat on Lot 1, Block
1 of Paris CVS Addition.
Motion was made to approve by Carl Lucas, seconded by Brad
Archer, subject to the City Engineer's Memo dated, June 29, 2005,
with drainage to accommodate that shown on Master Drainage Plan.
Motion carried 6 ayes and 0 nays.
8.
Consideration of and action on the Final Plat for Brandywine
Business Park on Lot ll-E, City Block 316, located on Pine Mill
Road.
Motion was made to approve by Carl Lucas, seconded by Bobby
Myers subject to the City Engineer's Memo dated, June 29, 2005.
Motion carried 6 ayes and 0 nays.
9.
Consideration of and possible action on amendments to the Future
Land Use Map, which is a part of the Comprehensive Plan, as it
relates to the northwest quadrant of Paris.
After review and discussions, a marked up map was given to the
Director of Community Development and she was requested to have
Engineering draw up a draft of West Paris showing all the
recommendations to date. She was also asked to place an East Paris
quadrant on the next meeting agenda.
Meeting adjourned at 6: 15 p.m.

anyone out to fix it. He plans to use the house for storage and
eventually in about 5 years tear it down.
Lisa Wright stated that at the time of the request, there was no
mention that there was already a house on the property that would
remain. When there is already a structure on a lot and you want to
put another house on it, that is a multi-family lot and the petitioner
requested single family lot with Specific Use Permit.
Benny Plata stated that he does not like to see mobile homes go in
where stick home are being built.
Reeves Hayter agreed with Mr. Plata that there are quite a bit of new
homes in the area and there are a couple of mobile homes in the area
about a block away.
There was no opposition, the public hearing was declared closed.
4.
Consideration of and action on the petition of Mitch Wofford for a
change in zoning from a One-Family Dwelling District No.3 (SF -3)
to a One-Family Dwelling District No.3 (SF-3) With Specific Use
Permit (39) Mobile Home on Lot 3, City Block 234, being number
1631 W. Henderson.
Motion was made to deny by Benny Plata due to a technicality that
the petitioner requeste"d the wrong classification and that no mobile
home should go in the area because new homes are being built
nearby, seconded by Russell McCain. Motion carried 5 ayes and 2
nays.
5.
Consideration of and action on the Master Plat of Pecan Place.
Motion was made by Carl Lucas, seconded by Bobby Myers to
approve the plat, subject to the City Engineer's Memo dated June 1,

2005, with a recommendation to City Council to waive curb and
gutter along 36th Street N.E. and Clement Road in exchange for a 60'
wide street built continuously across the Addition and exiting onto
FM 195 by no later than Phase III which would ultimately take the
place of 36th Street as a collector road. Motion carried by a vote of
7 ayes and 0 nays.
6.
Consideration of and action on the Preliminary Plat of Pecan Place,
Phase I.
Motion was made by Benny Plata, seconded by Carl Lucas to approve
the plat, subject to the City Engineer's Memo dated June 1, 2005,
with an amendment to Item #2 of the Memo to add off-site ROW for
Candice Drive to FM 195, with a recommendation to City Council to
waive curb and gutter along 36th Street N .E. and Clement Road in
exchange for a 60' wide street built continuously across the Addition
and exiting onto FM 195 by no later than Phase III which \vould
ultimately take the place of 36th Street as a collector road. Motion
carried 7 ayes and 0 nays.
7.

Reeves Hayter stated that the review of the southwest quadrant of
town was completed at the last meeting. Ms. Wright sent the
'northwest quadrant this month. Mr. Hayter asked if everyone had
time to look over it sufficiently to begin discussions at this meeting or
.if they. would prefer to begin next month. The consensus was to
discuss next month after some additional information could be
reviewed.
lJÎsa Wright stated she would get a good definition of Heavy
Industrial and Light Industrial, and will get a study of Lake Crook.

Benny Plata said that Council decided, when he was there, that it
would cost a lot to develop, therefore, they voted to leave Lake Crook
as a park; but he thought they might be discussing other possibilities

The question on the definition of Moderate Density Residential and
Heavy Density Residential came up during the last discussion of the
Master Plan. "
Reeves Hayter asked the Commissioners to look over the Future Land
Use Map as it relates to the northwest quadrant of Paris.

Jay Spencer, Spencer Dental Clinic, on Lot 14A-3, City Block 259,
located on Pine Mill Road.
Motion was made by Russell McCain, seconded by Brad Archer, to
recuse Reeves Hayter from considering of this item because his firm
prepared the plan. Motion carried, 6 ayes 0 nays.
The public hearing was declared open.
Bobby Smallwood, 343 FM 2121, Paris, wants to build a dental clinic
on this property for Dr. Jay Spencer. Mr. Smallwood is aware of the
corrections noted on the memo regarding the site plan.
There was no opposition, the public hearing was declared closed.

Motion was made by Benny Plata, seconded by Brad Archer to
approve the site plan. Motion carried, 5 ayes 0 nays.
Motion was made by Brad Archer, seconded by Russell McCain for
Reeves Hayter to return to the meeting. Motion carried, 5 ayes 0
nays.

Drive.
The public hearing was declared open.
There was no one present to speak in favor of or against the site plan.

The following zoning change requests will be presented at the July 5, 2005, meeting of the
Planning and Zoning Commission for its consideration:

Clay Yates is requesting that the property located on Part of Lot 4, City Block 188-A, being
number 1345 8th Street S.E., be rezoned from a Light Industrial District (LI) to a One-Family
Dwelling District No.2 (SF-2). The Comprehensive Plan recommends that this area be
zoned Light Industrial. I have attached a copy of the Comprehensive Plan showing this
vicinity. As you can see, the Plan recommends residential zoning in a large area surrounding
the location where the subject property is located. Furthermore, there are numerous
residential structures located in the vicinity of the property requested to be rezoned.

I have reviewed the site plan of the above referenced location. It appears that the plan complies
with'the City of Paris subdivision regulations with the following corrections.

Provide existing and proposed drainage calculations.
Provide detailed elevation information for the Southeast comer of the building,
including existing ground shots. .
Provide spot elevations for the proposed driveway and existing gutter line.
3.
I recommend approval of the site plan upon completion of the above items.
