RECOMMENDED MOTION:
Deliberate and act on a resolution approving Change Order No. 1 to the contract with to Bobby
Smallwood Construction Co. Inc., for the Clarksville Street Sidewalk Project; authorizing the City
Manager to negotiate and execute all necessary documents.

BACKGROUND:
The Original bid amount is $237,006.62 and the change order is a deduction of $17,479.25. The new
contract amount will be $219,527.37. The attached change order lists what is proposed to be changed.
Other estimated fees include: the transfer of electric services from weather heads to underground lines
and replacing the meter bases that are not up to code -$8,800.00, The fee for Suddenlink to install cable
into the PVG -$1,262.30, Cost for additional easements (surveyor) and bollards around pad mounted
transformers - cost will primarily depend on easement acquisition. The light poles for the project cost
$17,406.40.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
APPROVING CHANGE ORDER N0. ONE TO THE CONTRACT BETWEEN
BOBBY SMALLWOOD CONSTRUCTION CO., INC. AND THE CITY OF PARIS,
FOR CLARKSVILLE STREET DOWNTOWN SIDEWALK PROJECT; MAKING
OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND
DECLARING AN EFFECTIVE DATE.
WHEREAS, on March 12 2012, the City Council of the City of Paris passed
Resolution No. 2012-024, awarding the contract for the Clarksville Street Downtown
Sidewalk Project to Bobby Smallwood Construction Co., Inc. of Paris, Texas; and,
WHEREAS, the City Engineer, Shawn Napier, acting as project engineer,
recommends the amendment of the contract for said project based on the actual materials
to be used, and providing for a net decrease amount of $17,479.25 in the contract price, for
a revised contract price of $219,527.37, the contract time will not be increased. The date
for completion of all work will be June 26, 2012; and,
WHEREAS, Change Order No. One attached hereto as Exhibit "A", should in all
things, be approved, and the Interim City Manager should be authorized to execute the
necessary documents.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
Section 1. That the findings set out in the preamble of this resolution are hereby
in all things approved.
Section 2. That Change Order No. One to the Contract between Bobby Smallwood
Construction Co., Inc. and the City of Paris for the Clarksville Street Downtown Sidewalk
Project, attached hereto as Exhibit "A", providing for a net decrease of $17,479.25 in the
contract price, for an amended total contract price of $219,527.37, and no increase in
contract time be, and the same is hereby approved.
Section 3. That the Interim City Manager be, and he is hereby, authorized and
directed to execute, on behalf of the City of Paris, any necessary documents, upon the terms
and conditions in Exhibit "A", attached hereto.
Section 4. That this resolution shall be effective immediately upon passage.
