03 Council Minutes 8-1-05 .. T SPECIAL MEETING OF THE CITY COUNCIL, CITY OF PARIS August 1,2005 1. The City Council of the City of Paris met for a special meeting at 6:00 P. M. Monday, August 1,2005, at the Love Civic Center, 2025 South Collegiate Drive, Paris, Texas. Present: Mayor: Curtis Fendley Council Members: Tim Ray, Richard Manning, Mayor Pro Tern, Mary Ann Fisher, Karen Wilkerson, Rick Poston and Don Wilson City Staff: City Manager Tony N. Williams, City Attorney Larry W. Schenk, City Clerk Janice Ellis 2. Public Hearing pursuant to Chapter 7 of the City Charter and Section 43.142 of the Local Government Code, to consider the disannexation of two tracts of land forming a portion of the current outer boundaries of the city limits of the City of Paris, being a 63.397 acre tract at the most westerly boundary line and a 193.94 acre tract at the most easterly boundary line. Mayor Fendley opened the public hearing and asked for anyone speaking in favor of this item to do so. No one spoke in support of this item. Mayor Fendley asked for anyone speaking against this item to do so. With no one speaking, Mayor Fendley closed the public hearing. 3. ORDINANCE NO. 2005-034: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF PARIS, BE REVISED BY AMENDING CHAPTER 30 OF SAID CODE; PROVIDING FOR THE ESTABLISHMENT OF REINVESTMENT ZONE NO. 11; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF AUGUST 1, 2005. Larry Schenk explained that this item was in support of a proposed tax abatement agreement on behalf of Turner Pipe that will be presented to Council August 8th. It involves a proposed expenditure of$2,905,000.00, of which $600,000.00 would be spent to reinforce the foundation of the existing building and the remainder would be used to install two pieces I '" Special City Council Meeting August 1, 2005 Page 2 of heavy manufacturing equipment. The tax abatement would be for 7 years and include 10 additional employees. Council Member inquired as to who monitors these tax abatements to make sure that everyone is doing what they are suppose to be doing. Tony Williams informed Council that PEDC has to certify to the city annually that they are in compliance, contract by contract. If someone falls out of compliance and does not qualify, it is the responsibility of PEDC to notify the city. Council Member Ray asked what type of penalty would be imposed. Tony said the company would not qualify for the Abatement. Motion to approve by Council Member Poston. Council Member Manning - second. Motion carried - 7 ayes, 0 nays. 4.
