Enterprises Preliminary Plat I have reviewed the preliminary plat of the above referenced addition. It appears that the preliminary plat complies with the City of Paris subdivision regulations with the following exceptions. 1. Provide a preliminary drainage plan showing existing and proposed runoff calculations. 2. Label all lots as Block A and change to lots 1, 2 & 3. 3. Show the building lines. 4. Show the current zoning for each lot. 5. Add a five (5)-foot utility easement along the Lamar Ave. frontage. 6. Show the existing fire hydrants along Lamar Ave., a fire hydrant may be required for lot 3. 7. Change the contact persons for the City of Paris and SBC. 8. Application Form (PDF Format) What is Home Occupation A home occupation is an occupation conducted as an accessory use in or from a residential dwelling or its accessory building by persons whose principal residence is on the premises and which has no more effect on adjacent property than normal residential use. There are several regulations regarding what type of home occupations are permitted in Arlington County. Some of those home occupations permitted include the following: 1. Artist, photographer, sculptor 2. Author, composer, editor, translator, writer 3. Contractor or service business, with addition requirements as mentioned in Section 31 of the Arlington County Zoning Ordinance 4. Dressmaker, seamstress and tailor 5. Home crafts such as lapidary work/macrame, model making and weaving 6. Office of an ordained minister of religion 7. Office of an accountant, architect, bookkeeper, broker, clerical service, computer programmer, consultant, dentist, engineer, instructor in the arts and crafts, insurance agent, land surveyor, landscape architect, lawyer, musician, physician, real estate broker or telephone service 8. The Walla Walla County Zoning Code (WWCC Title 17) defines Home Occupation as follows: "Home Occupation" means an occupation customarily conducted entirely within a dwelling and carried on by the inhabitants thereof, which use is clearly incidental and secondary to the dwelling for dwelling purposes and does not change the character thereof; provided, the use does not involve more than one-fifth or not more than two hundred square feet of the total square footage of the dwelling. How do I obtain a Home Occupation permit? Submit a Conditional Use Permit for Home Occupation application that includes all the information listed on the form (available at the Community Development Department). The current application fee is $50, due upon application and payable to Walla Walla County. Applications are approved administratively at the staff level. Staff will review the application, the criteria for granting a Home Occupation (as listed below), and all other relevant information. The approval process typically takes 1 0-1 5 days and does not include a public hearing or public notice requirement. Home Occupations must meet the following criteria: . The occupation or profession shall be carried on entirely within the principle dwelling. . Not more than one person outside the family living in the house shall be employed by the home occupation. . There shall be no exterior display, no exterior signs, no exterior storage of materials and no other exterior indication of the home occupation or anything else that would vary from the residential character of the principle building. No special equipment that is different from normal residential equipment shall be installed, and no offensive noise, vibration, smoke, dust, odors, heat or glare shall be produced as a result of the business activity. For example, home occupations may include the following: art studio, dressmaking, professional offices of a dentist, lawyer, physician, engineer, architect, planner, accountant, secretarial service, and music or dancing instruction limited to four pupils at a time. The zoning code specifically prohibits approval of commercial stables, kennels, or restaurants. The establishment of a home occupation shall require approval by the Department and may be revoked upon finding that these regulations have been violated. Home operated businesses are defined in the Zoning Ordinance as "any gainful occupation engaged in by an occupant of a dwelling unit." Application Procedure Contact PDS for an Application Give the address and briefly describe the type of home occupation desired. Applications may be picked up at the Planning office, or downloaded from our website at www.cityofboise.org/pds. . The business will be conducted entirely within the dwelling or an accessory structure, such as a garage or workshop. However, an occupation conducted by means of a home computer linked to a mobile telecommuni- cations network m&y be allowed. The total of all floor space devoted to home occupations is not more than 500 square feet. . The character of the dwelling will be main- tained in appearance, cleanliness, quietness and residential appearance. . The business does not store or use any highly combustible materials or work on internal combustion engines. The size, weight, or power of equipment and tools used in the home occupation do not exceed that of normal household tools and equipment. . No items produced or repaired by the business will be stored or displayed so as to be visible from the outside the building. Only articles produced on the premises are sold or offered for sale. . . The home occupation will not cause any abnormal automotive or pedestrian traffic, exterior unsightliness, or emission of odor, dust, smoke, noise, glare, heat, vibration or other exterior disturbance. . . The business may have one employee in addition to the owner, if a suitable off-street parking space is provided in addition to the parking spaces required for the residence. The application also requires a brief writ- ten statement describing the proposed home occupation. The description should include infor- mation such as the type of business, equipn1ent used, operating hours and the average number of people per day expected to come to the home for products or services. Also explain any problems or conflicts the business may have with the zoning requirelnents or criteria. The Planning Division requires that in addition to the application, a list of signatures of all neigh- bors within 300 feet of the subject property, indicat- ing that they have been notified of your intent to conduct a home occupation, must be submitted. The names and addresses of those unwilling to sign must also be submitted. Questions regarding Home Occupation applica- tions should be directed to the Planning Division at 384-3830. Submit Application Return the cOlnpleted application and fee to the Planning Division Planning Evaluates the Application A planner will make an on-site inspection of the proposed business. Applicants will be notified of the results within 15 days. What if my Application is Denied? If the Home Occupation application is denied, and you believe that the Planning Division make a mistake in administering the Zoning Ordinance, an appeal of the decision may be make to the Boise City Planning & Zoning Commission within ten (10) calendar days following the decision. The intent of this Article is for a home occupation to be allowed if the business use is clearly an office use or artistic use, and is incidental and secondary to the use of the dwelling. In addition, the business use must be compatible with the surrounding residential uses. No home occupation shall be conducted that constitutes or causes an objectionable use of residential property due to potential noise, glare, dust, vibration, increased pedestrian or vehicular traffic, or any other condition that interferes with the general welfare of the surrounding residential area. SECTION 31-203. "HOME OCCUPATION" means an accessory use or activity of a business nature conducted on residential property by the occupants of the dwelling which use is clearly incidental and secondary to the use of the dwelling for dwelling purposes and does not change the character thereof. SECTION 31-672. Specific Regulations. The following regulations shall apply to the conduct of home occupations: a. LIMITATIONS ON NUMBER. A maximum of two (2) home occupations may be conducted on the premises of a residence. Multiple fictitious business names may be considered as part of one home occupation if the businesses are determined by the Community Development Director to be sufficiently similar in nature so as to constitute one business. b. USE CONFINED TO RESIDENTS. Only persons whose primary residence is the dwelling unit may engage in the home occupation. c. EMPLOYMENT LIMITED TO RESIDENTS. Employment for actual work conducted on the premises of the home occupation shall be limited to: the resident or residents who is, or are, principal owner or owners of the business, and any other resident of the dwelling unit. The home occupation may only be conducted and the storage of materials, equipment, inventory, supplies and files for the home occupation(s) is only permitted inside the dwelling unit or an entirely enclosed roofed accessory structure that is not a garage. Storage of materials, equipment, inventory, supplies and files for the home occupation(s) shall not cumulatively occupy more than twenty-five (25) percent of the permitted area for the home occupation as determined pursuant to subsection (d) above. Only materials, equipment, and/or tools recognized as part of a normal household or necessary or convenient for domestic purposes shall be used in the home occupation. Page 3 of 5 PEDESTRIAN AND VEHICULAR TRAFFIC. The home occupation shall not create pedestrian or vehicular traffic in excess of that which is normal to a residential use of the premises. j. COMMERCIAL VEHICLES. (1) No commercial vehicle used for any part of the home occupation activity may be parked, maintained, or stored on the premises with the exception of one commercial vehicle per residence provided the vehicle has a suspension weight of one ton or less. (2) Other than the commercial vehicle permitted pursuant to subsection (j) (1) above, no commercial vehicle may be used for delivery of materials or pickup of materials in conjunction with the home occupation, except that reasonable courier services to or from the premises is permitted. (3) For the purposes of this section, commercial vehicle shall mean any vehicle required by the State of California to have commercial vehicle license plates. k. SIGNS AND ADVERTISING. No sign, nameplate, or other form of advertising shall be displayed on the premises in connection with the home occupation except for a total of one non-freestanding sign per dwelling unit not exceeding one- half (1/2) square foot located on the mailbox or, if there is no mailbox, near the mail delivery area identifying the home occupation(s). There shall not be any alteration of the appearance of the premises for the purpose of attracting attention to a home occupation. I. NUISANCE. The home occupation shall not create any radio or television interference or create discernable noise, glare, dust, odor, vibrations, or unreasonable disturbance in excess of that which is normal to a residential use of the premises. Prohibited Occupations. The following activities are prohibited as home occupations: (a) MOTOR VEHICLE REPAIR AND DETAILING. Those occupations conducted on the premises that entail motor vehicle repair work, including any and all aspects of body or fender work. Also prohibited is auto detailing on the premises. (b) MECHANICAL AND ELECTRONIC REPAIR. Mechanical and electronic repair utilizing, maintaining or storing more mechanical or electronic equipment on the premises than is common to a residence. (c) KENNELS. Those occupations and uses which entail harboring, training, or raising of dogs, cats, birds, or other animals. (d) FOOD HANDLING. Those occupations which entail food handling, food processing, food warehousing, or food packaging. ...' (e) FIREARMS. Those occupations that entail the manufacturing, sale, lease, or rental of firearms and/or ammunition. (f) PRODUCTS PROCESSING. Those occupations which entail the repair, processing or alteration of goods, materials, or objects; provided, however, that custom sewing/tailoring is permitted if the goods are not manufactured or processed as stock for sale or distribution. This code section is not intended to prohibìt artists and artist studios, with the exception of prohibiting welding as a form of artistry for commercial business purposes, or commercial ceramic artistry, wherein a commercial kiln is utilized. This Article does not regulate forms of artistry that are for the sole purpose of non- business hobby-making and/or nonbusiness personal artistic expression. (g) OTHER PROHIBITED HOME OCCUPATIONS. Any activity where the conduct or operations of such activity would violate the provisions of this Article or any statute, ordinance, law or regulation or any activity determined by the Community Development Director to be tp://www. burbank. com/home _occupation. shtml 8/19/2005 I ARTICLE 53 - HOME OCCUPATION Section 53.10 - Puroose & Intent The purpose of this Home Occupation Ordinance shall be to prescribe procedures under which a home occupation may be permitted outright or as a conditional use in Hood River County. The intent of the Home Occupation Ordinance is to recognize and provide the following: Home occupations proposed in dwellings or pre-existing buildings in certain specified zones require obtaining a conditional use permit; and home occupations proposed in resource zones must obtain a conditional use permit and comply with applicable requirements in the following zones: Exclusive Farm Use Zone (EFU); Forest Zone (F-I); and Primary Forest Zone (F-2). Section 53.15 - Definitions A. A home occupation is a business or professional activity operated for income purposes, only by residents in a dwelling or pre-existing building on the same lot or parcel as the resident's dwelling, provided the home occupation is a secondary use and is clearly incidental, accessory or subordinate to the residential use or the pre-existing building. A home occupation shall also be in confonnance with provisions in Article 53 Home Occupations. B. The following definition and standards apply to home occupations proposed in the City of Hood River Urban Growth Boundary: HOrvrn OCCUP A nON: The occupation carried on by a resident of a dwelling unit as an accessory use within the dwelling unit or an accessory building which is incidental or secondary to residential use provided the occupation is conducted so that (1) It does not give the appearance of a business; (2) It does not change the character of the dwelling; (3) There is no display, except by a non-illuminated sign, no larger than one square foot, which may not protrude more than six (6) inches from the exterior of the dwelling unit; (4) No assistants are employed on the site; (5) There is no increase in noise outside the dwelling unit; and (6) There is only minor increase, if any, in the traffic traveling to and from the dwelling unit. Section 53.20 - Permitted Uses Home occupations are pennitted outright in the following zones pursuant to compliance with provisions in the zones in which the use is proposed: Commercial Zone (C-I); Industrial Zone (M-I) and Light Industrial Zone (M-2). ~ Section 53.25 -Conditional Uses The following conditional uses are required to comply with provisions in Article 72 - Planning Director's Review Procedure and Article 53 - Home Occupation, Section 53.30 - Home Occupation Standards: A. A home occupation proposed in the following zones in an existing dwelling or pre- existing building on the same lot or parcel as the resident's dwelling: Residential Zone (R- 1); Residential Zone (R-2); Rural Residential Zone (RR); Rural Center Zone (RC); Historic Preservation Zone (lIP); and Scenic Protection Zone (SP). B, A home occupation proposed in either a dwelling or pre-existing building on the same parcel or lot as the resident's dwelling in the Forest Zone (F-I), Primaty Forest Zone (F-2) and Exclusive Farm Use Zone (EFU) shall comply with the following requirements: 1. A home occupation proposed in the Forest Zone (F-I) and Primaty Forest Zone (F-2) shall also comply with provisions in either Article 5, specifically Section 5.20 - Uses Subject to a Conditional Use Permit, or Section 6.30 - Criteria and Standards for Approval, of the Hood River County Zoning Ordinance. 2. A home occupation proposed in the Exclusive Farm Use Zone (EFU) shall comply with provisions in Article 7, specifically Section 7.40 - Uses Subject to a Conditional Use Pennit of the Hood River County Zoning Ordinance. 3. Compliance with applicable requirements of the zone ,in which the home occupation is located. C. Expansion or change in use of home occupations or one or two person businesses existing prior to the adoption date of this ordinance (see Section 53.35 Nonconforming Use). Section 53.30 - Home Occupation Standards Applicants for home occupations shall demonstrate through affirmative findings of compliance with the following standards: A. Submittal of a site plan (site plan provided by the County Planning Department). B. The nature of the use shall be specified at the time of application. Any proposed change in the use of an approved home occupation shall require additional County review, Any departure from the uses and activities initially specified shall be considered grounds for revocation. C. Compliance with Section 53.15 - Definition, Home Occupation, as stated above. D. The home occupation is clearly incidental, accessory and subordinate to the residential use. I E. The use will not take an outward appearance nor manifest any characteristics of a business or operation of a retail or wholesale nature. F. There shall be no visible evidence of conduct of a home occupation from any road or adjacent property. G. Structural alterations shall not occur. H. Only two residents of the dwelling or parcel who are either owners, leasing, or renting shall be engaged in the home occupation. No more than one home occupation. shall be permitted in conjunction with any dwelling or parcel. I. Only limited retail sales and sales accessory to services associated with the home occupation are permitted. 1. The existence of a home occupation shall not be justification for a plan and zone change to commercial or industrial use. K. Approval is personal to the applicant and shall not run with the land, Approval shall expire two years from the date of issuance, at which time the permit may be renewed by the County Planning Department based upon findings that the requirements of this ordinance are being met. The applicant is required to contact the Planning Department before the end of two years. L. If selling, leasing or allowing another individual to use the property is contemplated, applicant will infonn the County Planning Department. If selling, leasing or allowing another individual to use the property and home occupation occurs, this approval becomes null and void. Further use by other than the applicant requires additional review and approval by the Hood River County Planning Department. M. Signing is not permitted unless required by the State for the protection of the public's health, safety and welfare. N. The use shall not generate additional traffic or parking beyond what normally occurs in the applicable zoning district. O. Compliance with applicable requirements of the zone in which the use is located. P. Pre-existing buildings on the same parcel or lot as the resident's dwelling must also comply with the following: 1. The building is pre-existing to the adoption date of this ordinance. 2. The pre-existing building must be located on the same parcel or lot as the dwelling in which the persons engaged in the home occupation reside. - I 3. Compliance with applicable requirements of the zone in which the use is located. 4. Compliance with other requirements deemed necessary by the County. Q. Home occupations proposed in the City of Hood River's Urban Growth Boundary shall comply with the City's definitions and standards in Section 53.15 - Definitions, paragraph B. Section 53.35 - Nonconfonnin2 Use A. Compliance with Article 65 - Nonconforming Use, of the Hood River County Zoning Ordinance. B. Any proposed expansion or change in use of either a home occupation or one or two person business in operation prior to the adoption date of this ordinance shall be subject to the requirements of this ordinance and shall require a conditional use permit. In the event of a denial of such application, the home occupation or one or two person business shall be allowed to continue as originally approved, as a nonconforming use. I
