The Board of Adjustment Board meeting was called to order by Chairman
John Mark Spencer at 12:00 p.m.

Also present was Lisa Wright, Director of Community Development.
2.
Approval of minutes from previous meetings. Motion to approve the minutes
of the June 9, 2005, meeting was made by Terry Christian, seconded by Kyle
McCarley. Motion carried 4-0.
3.
Public Hearing to consider the petition of Paris Living to grant a variance of
Zoning Ordinance No. 1710, Section 9-601, for a 3.3 foot variance from the
side setback on the north end of the structure and a 2.8 foot variance from the
side setback on the south end of the structure, on Lot 25, Block 1 of the
Gibbons Park Addition, located at 905 E. Polk.
David Glass joined the meeting.
Patsy Daniels, representing her father-in-law, Jesse Clark Daniels, 910 E.
Washington. Mr. Jesse Daniels' property backs up to this property and they
wanted to know why the slab was poured before the variance was granted.
They're also concerned that the alley between the property is all grown up.
The construction manager for Paris Living stated that the reason the slab was
poured was because they had applied for some HOME loan grants and were
in a bind construction-wise and had a time line to get it done. He just took
over as construction manager and was all backed up and not sure of where
the property line was. The manager went ahead with the construction and
after the survey realized they had messed up-that is when construction was

stopped and the variance request was submitted. There are 2 fences on both
sides of the property-50 feet between the 2 fences, and the assumption was
made that that was the property line.

Consideration of and action on the petition of Paris Living to grant a variance
of Zoning Ordinance No. 1710, Section 9-601, for a 3.3 foot variance from the
side setback on the north end of the structure and a 2.8 foot variance from the
side setback on the south end of the structure, on Lot 25, Block 1 of the
Gibbons Park Addition, located at 905 E. Polk. The Board recommended to
Paris Living that they not to pour any more slabs until they surveyed their
properties. Motion to grant the variance was made by Kyle McCarley,
seconded by Rodney Bass. Motion carried 5-0.

Public Hearing to consider the petition of Drew Temple to grant a variance of
Zoning Ordinance No. 1710, Section 13-101 c., for a 7 foot variance from the
rear yard setback, on Lot 5, Block G of the Johnson Woods Addition, located
at 620 Twin Oaks Place. Virginia Miller Black, 650 Twin Oaks Place, wants to
know what Mr. Temple's intentions are, how tall the carport will be, and will
it have sides. Drew Temple stated he would like to build a carport that is 20' -
21' wide to within 3' of his fence-next to the existing garage. The proposal is
for the carport to connect to the existing roof line, and it will be wide enough
for 2 cars-not enclosed on sides. It will be built of metal clad in wood with a
shingle roof-comparable to the roof on the rest of the house. Drew Temple
did not have plans available. According to the plat, there is a utility easement
through the property that could pose a problem.

Consideration of and action on the petition of Drew Temple to grant a variance
of Zoning Ordinance No. 1710, Section 13-101 c., for a 7 foot variance from the
rear yard setback, on Lot 5, Block G of the Johnson Woods Addition, located
at 620 Twin Oaks Place. Motion was made by David Glass, seconded by
Rodney Bass, to table the variance request until plans are drawn up. Motion
carried 5-0.
