AN ORDINANCE OF THE CITY OF PARI5, PARIS, TEXAS, PROVIDING THAT
THE CODE OF ORDINANCES, CITY OF PARIS, BE AMENDED BY REVISING
SUBSECTIONS (b) AND (c) OF SECTION 34-22 OF SAID CODE TO ESTABLISH WATER
RATES FOR RESIDENTIAL, COMMERCIAL, AND INDU5TRIAL CUSTOMER5 THAT
IS BASED UPON THE COST TO SERVE EACH CLASS; BY REVISING SUBSECTION
(a) OF SECTION 34-23 TO ESTABLISH A SEWER SERVICE RATE FOR CITY WATER
CUSTOMERS; BY REVISING SUBSECTION (a) OF SECTION 34-28 TO ESTABLISH
DEPOSITS TO ASSURE PAYMENT; PROVIDING FOR A PENALTY NOT TO EXCEED
$2,000.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF OCTOBER
1, 1998.
WHEREAS, on the 15th day of January, 1998, the City Council of the City of Paris,
Paris, Texas, received a water and sewer rate study prepared by David M. Griffith and Associates
with certain findings and proposed rate increases of 4.6% average for water and 6.4% average for
sewer; and,
WHEREAS, on the 9th day of February, 1998, a public hearing was had by the City
Council of the City of Paris, Paris, Texas, regarding the water and sewer rates; and,
WHEREAS, on the 30th day of April, 1998, the City Council was presented with a water
and sewer rate study by David M. Griffith and Associates with a proposed rate increase of 4.6 %
average for water and 6.4 % average for sewer; and,
WHEREAS, on the 19th day of August, 1998, the amendments to the water and sewer rate
study were presented by DMG - Maximus (formerly David M. Griffith and Associates), with a
proposed rate increase of 4.6% average for water and 6.4% average for sewer; NOW
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS:
Section 1. That Subsections (b) and (c) of Section 34-22 of the Code of Ordinances of the
City of Paris, Paris, Texas, be, and the same are hereby, amended so that such shall read as
follows:
"Sec. 34-22. Water rates.

"(b) Charges for water furnished by the City, measured in cubic feet, are
established as follows based upon customer class and meter size and incorporate a
base monthly cost which includes the cost for the first increment of water, and a
cost per one hundred (100) cubic feet used above the first increment:

Section 2. That Subsection (a) of Section 34-23 of the Code of Ordinances of the City of
Paris, Paris, Texas, be, and the same is hereby, amended so that such shall read as follows:
"Sec. 34-23. Sewer rates - For customers using City water.
"(a) Charges for sewer service furnished by the City to residential, commercial
and industrial customers shall be based upon customer class and meter size,
incorporating a base monthly cost for the first increment of usage and a cost for
each additional one hundred (100) cubic feet above the first increment, as follows:

Section 3. That Subsection (a) of Section 34-28 of the Code of Ordinances of the City
of Paris, Paris, Texas, be, and the same is hereby, amended so that such shall read as follows:
"Sec. 34-28. Deposit to assure payment.
"(a) Each purchaser or consumer of city water shall, at the time of making
application for water service, make a deposit, with the division, in the following
about:
"(1) Residential consumers and business or commercial users, wherein
water is not a part of their business operations, fifty dollars
($50.00).
"(2) Apartment houses, sevenry-five dollars ($75.00) for the first two (2)
units and thirty dollars ($30.00) for each additional unit, not to
exceed a total of seven hundred fifty dollars ($750.00).
"(3) Convenience store with snack bars and/or fuel pumps and
greenhouse/nursery, one hundred dollars ($100.00).
"(4) Cafes, restaurants and other similar businesses, two hundred fifty
dollars ($250.00).
"(5) Car dealerships, service stations, and car washers, two hundred fifty
dollars ($250.00).
"(6) Laundries and waste haulers, five hundred dollars ($500.00).
"(7) Fire plug meters, seven hundred dollars ($700.00) or current cost
of ineter.
"(8) Nursing home/retirement home, tourist courts, hotels and motels,
seven hundred fifty dollars ($750.00).
5ection 4. That the rates established in Sections l, 2, and 3 above will be effective with
billings beginning October 1, 1998.
Section 5. Any person violating any of the provisions of this ordinance shall be guilty of
a Misdemeanor, and, upon conviction, shall be fined in any sum not to exceed $2,000.00, and
each and every day's continuance of any violation of the above-enumerated section shall constitute
and be deemed a separate offense.
Section 6. All ordinances or parts of ordinances in conflict herewith are hereby expressly
repealed.
Sectaon 7, This ordinance shall become effective on October 1. 1998.
