98-068 ORD AMENDING ZONING ORDINANCE NO 1710 ON LOTS 3 AND 4 BLOCK F S.J. WRIGHT'S GRAND AVENUE ADD'NORDINANCE NO. 98-068 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, PARIS, TEXAS, AND CHANGING THE BOUNDARIES ESTABLISHED BY THE ZONING MAP OF SAID CITY; ESTABLISHING A PLANNED DEVELOPMENT COMMERCIAL CENTER (PD-al) ON LOTS 3 AND 4, BLOCK 4, S. J. WRIGHT'S GRAND AVENUE ADDITION, ON PROPERTY BELONGING TO JOHN MARK SPENCER, SO AS TO INCLUDE THEREIN TERRITORY FORMERLY DESIGNATED AS A GENERAL RETAIL DISTRICT (GR); DESIGNATING THE BOUNDARIES OF THE PLANNED DEVELOPMENT COMMERCIAL CENTER (PD-al) SO ESTABLISHED; PROVIDING FOR A PENALTY NOT TO EXCEED $2,000.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF JANUARY 1, 1999. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. That the boundaries heretofore established by the Zoning Map and Ordinailce No. 1710 of the City of Paris, Paris, Texas, be, and the same are hereby, changed, and that a PLANNED DEVELOPMENT COMMERCIAL CENTER (PD-al) be, and the same is hereby, established on LOTS 3 AND 4, BLOCK 4, S. J. WRIGHT'S GRAND AVENUE ADDITION, on property belonging to JOHN MARK SPENCER, so as to include in sucll PLANNED DEVELOPMENT COMMERCIAL CENTER (PD-al) the hereinafter described property, which was formerly and is prese»tly designated as a GENERAL RETAIL DISTRICT (GR), and that the boundaries of said PLANNED DEVELOPMENT COMIVIERCIAL CENTER (PD-al), be, and the same are hereby, established as follows: SITUATED within the corporate limits of the City of Paris, County of Lamar, and State of Texas, being a part of the Asa Jarman Survey, being Lots 3 and 4, Block 4, S. J. Wright's Grand Avenue Addition, according to plat of such addition recorded in Volume 53, Page 476, Lamar County Deed Records, and being mare particularly described by inetes and bounds as follows in accordailce with a survey made by R. G. Berry, Registered Public Surveyor, on September 7, 1965: BEGINNING at a utility pole at the Southwest corner of Lot 2, Block 4, of said addition; THENCE West with the North Boundary Line of a 16-foot alley a distance of 100 feet to an iron pipe at the Southeast corner of Lot 5 of said addition; THENCE North a distance of 145 feet to an iron pipe in the South Boundary Line of Bonham Street (formerly Grand Avenue); THENCE East a distance of 100 feet, a metal standard at the Northwest corner of Lot 2, Block 4, of said addition; THENCE South a distance of 145 feet to the place of beginning, beiilg number 1825 Bonham Street. Section 2. That the zoniilg herein granted is conditioned upon the submission of a Site Plan in accordance with Section 8-302 of Ordinance No. 1710, which after full compliance with the procedure established in Section 21 of said Ordinance No. 1710, must be approved by the City Council prior to the issuance of any building permits. Section 3. That the Chief Building Official of the City of Paris be, and he is hereby, directed to change the Zoning Map of the City of Paris in accordance with the provisions of Ordinance No. 1710 and the land use map accompanying the same, and in accordance with the provisions of this ordinance. Section 4. Any person violating any of the provisions of this ordinance shall be guilty of a Misdemeanor, and, upon conviction, shall be fined in any sutn not to exceed $2,000.00, and each and every day's continuance of any violation of the above-enumerated sections shall constitute and be deetned a separate offense. Section 5. All ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. Section 6. This ordinance shall become effective January l, 1999.
