96-002 ORD AMENDING ZONING ORDINANCE NO 1710 FOR LOT 9 CITY BLOCK 287 WITH WOOD FENCES 8 FEET HIGH ORDINANCE NO. 96-002 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, PARIS, TEXAS, AND CHANGING THE BOUNDARIES ESTABLISHED BY THE ZONING MAP OF SAID CITY; ESTABLISHING A PLANNED DEVELOPMENT DISTRICT (PD-a,b,d AND f) WITH NO ENTRY TO THE PROPERTY FROM AUDUBON STREET, TWO GREEN BELTS 30' WIDE AND 230' LONG BOTH BEGINNING AT THE SW CORNER OF THE PROPERTY AND RUNNING PARALLEL WITH THE COMMON BOUNDARIES ON ADJOINING PROPERTIES BEING LOT 6, BLOCK A, AUDUBON ESTATES, AND LOT 9, CITY BLOCK 287, WITH WOOD FENCES 8 FEET HIGH TO BE CONSTRUCTED ALONG THE ENTIRE SOUTH AND WEST BOUNDARIES OF LOT 8C, CITY BLOCK 287 WHEN ANY CONSTRUCTION BEGINS, ON LOT 8C, CITY BLOCK 287, ON PROPERTY BELONGING TO B. J. McCARLEY, SO AS TO INCLUDE THEREIN TERRITORY FORMERLY DESIGNATED AS A ONE FAMILY DWELLING DISTRICT NO. 2(SF-2); DESIGNATING THE BOUNDARIES OF THE PLANNED DEVELOPMENT DISTRICT (PD-a,b,d AND t) SO ESTABLISHED; PROVIDING FOR A PENALTY NOT TO EXCEED $2,000.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF FEBRUARY 1, 1996. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. That the boundaries heretofore established by the Zoning Map and Ordinance No. 1710 of the City of Paris, Paris, Texas, be, and the same are hereby, changed, and that a PLANNED DEVELOPMENT DISTRICT (PD-a,b,d and fl WITH NO ENTRY TO THE PROPERTY FROM AUDUBON STREET, TWO GREEN BELTS 30' WIDE AND 230' LONG BOTH BEGINNING AT THE SW CORNER OF THE PROPERTY AND RUNNING PARALLEL WITH THE COMMON BOUNDARIES OF ADJOINING PROPERTIES BEING LOT 6, BLOCK A, AUDUBON ESTATES, AND LOT 9, CITY BLOCK 287, WITH WOOD FENCES 8 FEET HIGH TO BE CONSTRUCTED ALONG THE ENTIRE SOUTH AND WEST BOUNDARIES OF SAID LOT 8C WHEN ANY CONSTRUCTION BEGINS, be, and the same is hereby, established on LOT 8C, CITY BLOCK 287, on property belonging to B. J. McCARLEY, so as to include in such PLANNED DEVELOPMENT DISTRICT (PD-a,b,d and fl, as restricted, the hereinafter described property, which was formerly and is presently designated as a ONE FAMILY DWELLING DISTRICT NO. 2(SF-2), and that the boundaries of said PLANNED DEVELOPMENT DISTRICT (PD-a,b,d and f), as restricted, be, and the same is hereby, established as follows: SITUATED within the corporate limits of the City of Paris, County of Lamar, and State of Texas, and being a part of the Joseph Leach Survey Number 524, and being a part of a 24.28 acre tract of land conveyed to Charles E. Beachley by deed of record in Volume 577, Page 592, of the deed records of said County and State and being more particularly described as follows: BEGINNING at an iron pin for corner at the northeast corner of the said Beachley tract, said point being in the West right-of-way line of Loop Highway 286, said right-of-way line being a curve to the left whose radius is 17,353.7; THENCE in a southeasterly direction along said curve a distance of 345 feet to a concrete monwnent for corner; THENCE S 20° 30' E along said west right-of-way line a distance of 463.2 feet to an iron pin for corner in the bottom of a small stream; THENCE S 89° 23' W a distance of 554.4 feet to a point in the east boundary line of 36th Street S.E., and the West boundary line of the said Beachley tract; THENCE North along the said West boundary line a distance of 767 feet to an iron pin at the Northwest corner of said Beachley tract; THENCE East along the North boundary line of said Beachley tract a distance of 284 feet to the PLACE OF BEGINNING, located in the 4800 Block of S.E. Loop 286. Section 2. That the zoning herein granted is conditioned upon the submission of a Site Plan in accordance with Section 8-302 of Ordinance No. 1710, which after full compliance with the procedure established in Section 21 of said Ordinance No. 1710, must be approved by the City Council prior to the issuance of any building permits. Section 3. That the Chief Building Official of the City of Paris, be, and he is hereby, directed to change the Zoning Map of the City of Paris in accordance with the provisions of Ordinance No. 1710 and the land use map accompanying the same, and in accordance with the provisions of this ordinance. Section 4. Any person violating any of the provisions of this ordinance shall be guilty of a Misdemeanor, and, upon conviction, shall be fined in any sum not to exceed $2,000.00, and each and every day's continuance of any violation of the above enumerated ordinance shall constitute and be deemed a separate offense. Section 5. All ordinances and parts of ordinances in conflict herewith are hereby expressly repealed. Section 6. This ordinance shall become effective February l, 1996.
