96-009 ORD PROVIDING THE CODE OF ORDINANCES BE AMENDED BY REVISING CHAPTER 12 ARTICLE IV SECTIONS 12-86, 12-87 AND 12-89 OF SAID CODE
ORDINANCE NO. 96-009
AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT THE
CODE OF ORDINANCES, CITY OF PARIS, BE AMENDED BY REVISING CHAPTER
12, ARTICLE IV, SECTIONS 12-86, 12-87 AND 12-89 OF SAID CODE; PROVIDING
FOR ADOPTION OF THE STANDARD FIRE PREVENTION CODE, 1994 EDITION;
PROVIDING FOR DELETIONS, MODIFICATIONS AND AMENDMENTS TO SUCH
CODE; PROVIDING FOR A PENALTY NOT TO EXCEED $2,000.00; REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING FOR AN EFFECTIVE DATE OF MARCH 1, 1996.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS:
Section 1. That Chapter 12, Article IV, Sections 12-86, 12-87 and 12-89 of the Code
of Ordinances of the City of Paris, Paris, Texas, be, and the same are hereby, amended so that
such shall read as follows:
"Sec. 12-86. Standard Fire Prevention Code - Adoption.
"For the purpose of establishing rules and regulations for fire prevention
relating to public safety, health and general welfare within the City and its
extraterritorial jurisdiction, where applicable, that certain fire prevention code
known as the Standard Fire Prevention Code, 1994 Edition, save and except such
portions as are deleted, modified or amended by this article, is hereby adopted
and incorporated as fully as if set out at length herein. A copy of such Code has
been and is now on file in the office of the City Clerk, and the provisions thereof
shall be controlling as above stated.
"Section 12-87. Standard Fire Prevention Code - Amendments.
"The Code adopted by Section 12-86 is hereby amended as set out in this
section:
"Section 105, Board of Adjustment & Appeals, is revised to read as follows:
"`The board of appeals established in Section 7-20 of the Code
of Ordinances is hereby designated to serve as the board of appeals
and adjustments with regard to matters pertaining to the Standard
Fire Prevention Code, with powers to recommend variances to the
application of any provision of such Code and to pass on related
matters. The Fire Official, or his authorized representative, shall
be an ex-officio member of such board when acting with regard to
the Fire Prevention Code and shall serve as secretary to such
board in such matters.'
"Section 107, Compliance and Penalty, is added to read as follows:
"`Any person operating or maintaining any occupancy, premises
or vehicle subject to this Code who shall permit any fire hazard to
exist on premises under his control, or who shall fail to take
immediate action to abate a fire hazard when ordered or notified
to do so by the Fire Official, or his duly authorized representative,
shall be guilty of a misdemeanor and, upon conviction, shall be
fined in any sum not to exceed two thousand dollars ($2,000.00),
and each and every day's continuance of any violation of the
provisions hereof shall constitute and be deemed a separate
offense.'
"Section 506.2, Hazardous Season, is deleted.
"Section 603.5, Fire Extinguishers in Recreational Vehicle Parks, is deleted.
"Section 603.7, Fire Protective Signaling System, is amended by adding the following
paragraph thereto:
"`Section 603.7.7, Residential Fire Alarm Installation
"`(a) In addition to the requirements of Section 603.7, every
dwelling unit henceforth constructed or placed within the City shall
have fire detection devices capable of sensing products of
combustion installed which are supplied by a direct connection to
the 120 volts alternating current electrical system.
"`(b) Alarm devices operating from a battery power source or
those utilizing a cord for plug into electrical outlets are expressly
prohibited in such new construction; however, a battery power
source used as a backup to 120 volts alternating current electrical
system is permitted and encouraged.
"`(c) Installation, design and operation of all residential single
station alarms shall conform to the Standard for the Installation,
Maintenance and Use of Household Fire Warning Equipment,
1989 Edition (NFPA 74) and the Standard for the Installation,
Maintenance and Use of Local Protective Signaling Systems for
Guard's Tour, Fire Alarm and Supervisory Service, 1990 Edition
(NFPA 72A) and shall be listed by a nationally accepted testing
authority.
"`(d) It shall be a violation of this Code for any person to
remove, tamper, destroy, disconnect or in any manner render
detectors inoperative.
"`(e) It shall be unlawful to maintain a residence with an alarm
which is not totally operable.'
"Sec. 12-89. Permit fees.
"The City Manager is authorized to establish permit fees for all permits required
by the Standard Fire Prevention Code, 1994 Edition. Such permit fees as
established by the City Manager shall be made available to the public through the
Fire Marshal's office."
Section 2. Any person violating any of the provisions of this ordinance shall be guilty
of a misdemeanor and, upon conviction, shall be fined in any sum not to exceed $2,000.00, and
each and every day's continuance of any violation of the above enumerated section shall
constitute and be deemed a separate offense.
Section 3. All ordinances or parts of ordinances in conflict herewith are hereby
expressly repealed.
Section 4. This ordinance shall become effective on March 1, 1996.
